Question 1367: A man passes away with no children, but has a wife, several sisters, and several nephews. Do his nephews also inherit?

لَو أَنَّ رَجُلَاً ماتَ وَ تَرَکَ زوجَتَهُ وَ أَخَوَاتِه وَ لَمْ یَکُنْ لَهُ وَلَدٌ و لَهُ إبْنُ أَخٍ، هَلْ یَرِثُ مِنهُ إِبْنُ أخِیه؟
✅Answer: Please pay attention to the following narrations:
1 عَنْ أَبِی أَیُّوبَ الْخَزَّازِ وَ غَیْرِهِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِی جَعْفَرٍ قَالَ: لَا یَرِثُ مَعَ الْأُمِّ وَ لَا مَعَ الْأَبِ وَ لَا مَعَ الِابْنِ وَ لَا مَعَ الِابْنَةِ إِلَّا الزَّوْجُ وَ الزَّوْجَةُ وَ إِنَّ الزَّوْجَ لَا یُنْقَصُ مِنَ النِّصْفِ شَیْئاً إِذَا لَمْ یَکُنْ وَلَدٌ وَ الزَّوْجَةَ لَا تُنْقَصُ مِنَ الرُّبُعِ شَیْئاً إِذَا لَمْ یَکُنْ وَلَدٌ فَإِذَا کَانَ مَعَهُمَا وَلَدٌ فَلِلزَّوْجِ الرُّبُعُ وَ لِلْمَرْأَةِ الثُّمُنُ.

Imam Baqir (peace be upon him) said: With the presence of a father, mother, son, or daughter, no one inherits except the husband and wife!
And indeed, the husband's share is not less than half if there are no children, and the wife's share is not less than a quarter if there are no children. And if there are children with them, the husband's share is one-quarter and the wife's share is one-eighth!
2 عَنْ أَبِی أَیُّوبَ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ إِنَّ فِی کِتَابِ عَلِیٍّ أَنَّ الْعَمَّةَ بِمَنْزِلَةِ الْأَبِ وَ الْخَالَةَ بِمَنْزِلَةِ الْأُمِّ وَ بِنْتَ الْأَخِ بِمَنْزِلَةِ الْأَخِ وَ کُلَّ ذِی رَحِمٍ بِمَنْزِلَةِ الرَّحِمِ الَّذِی یُجَرُّ بِهِ إِلَّا أَنْ یَکُونَ وَارِثٌ أَقْرَبَ إِلَی الْمَیِّتِ مِنْهُ فَیَحْجُبُهُ.

Imam Sadiq (peace be upon him) said: Indeed, it is mentioned in the book of Ali (peace be upon him): Indeed, the paternal aunt is like the father, and the maternal aunt is like the mother, and the brother's daughter is like the brother, and every relative is like the relative through whom he or she is drawn and has a close relation, unless there is an heir who is closer to the deceased, in which case he or she will prevent him or her from inheriting!
3 عَنْ أَبِی عُبَیْدَةَ عَنْ أَبِی جَعْفَرٍ فِی رَجُلٍ مَاتَ وَ تَرَکَ امْرَأَتَهُ وَ أُخْتَهُ وَ جَدَّهُ قَالَ هَذِهِ مِنْ أَرْبَعَةِ أَسْهُمٍ لِلْمَرْأَةِ الرُّبُعُ وَ لِلْأُخْتِ سَهْمٌ وَ لِلْجَدِّ سَهْمَانِ.

Imam Baqir (peace be upon him) said about a man who dies and leaves behind his wife, his sister, and his grandfather: This is from the cases of four shares: one-fourth is for the wife, and (the rest) one share is for the sister and two shares are for the grandfather!
✅Based on the above narrations and others, if a man passes away and has no children, and his wife remains, she inherits one-fourth from him.
Also, according to the above narrations and others, sisters inherit as heirs of the second class if there is no father, mother, or children, even if a grandfather or grandmother exists. But according to narration 2, the deceased's nephew inherits in the absence of a brother, only if there is no closer heir who would prevent him from inheriting, and in our case, since the deceased's sister is present, there is no share for the nephews and they are prevented from inheriting by the sister.
✅Therefore, in our question, after giving one-fourth to the wife, the remaining property is divided among the deceased's sisters.
✅ It is worth mentioning that a wife with no children does not inherit from some of her husband's property, which will be discussed in a separate section. If Allah wills.
