Question 507: A person intends to build a house, and a fruit tree is in the way. Is it permissible to cut this fruit tree?

✅Answer: Please pay attention to the following narrations:

1 عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنِ الْحُسَيْنِ بْنِ بِشْیرٍ عَنِ ابْنِ مُضَارِبٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: لَا تُقَطِّعُوا الثِّمَارَ فَيَصُبَّ اللَّهُ عَلَيْكُمُ الْعَذَابَ صَبّاً.

Imam Sadiq (peace be upon him) said: 'Do not cut down fruit trees, lest Allah pour a punishment upon you!'

2 عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ: سَأَلْتُ أَبَا الْحَسَنِ عَنْ قَطْعِ السِّدْرِ فَقَالَ سَأَلَنِي رَجُلٌ مِنْ أَصْحَابِكَ عَنْهُ فَكَتَبْتُ إِلَيْهِ قَدْ قَطَعَ أَبُو الْحَسَنِ سِدْراً وَ غَرَسَ مَكَانَهُ عِنَباً.

Ahmad ibn Muhammad said: 'I asked Imam Reza (peace be upon him) about cutting down a cedar tree.' The Imam said: 'A man from your companions asked me about this, and I wrote to him: 'Indeed, Abul Hasan, Imam Kazim (peace be upon him), cut down a cedar tree and planted a grapevine in its place!'

3 عَنْهُ عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ أَحْمَدَ بْنِ الْحَسَنِ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَمَّارِ بْنِ مُوسَى عَنْ أَبِي عَبْدِ اللَّهِ أَنَّهُ قَالَ: مَكْرُوهٌ قَطْعُ النَّخْلِ وَ سُئِلَ عَنْ قَطْعِ الشَّجَرَةِ قَالَ لَا بَأْسَ بِهِ قُلْتُ فَالسِّدْرُ قَالَ لَا بَأْسَ بِهِ إِنَّمَا يُكْرَهُ قَطْعُ السِّدْرِ بِالْبَادِيَةِ لِأَنَّهُ بِهَا قَلِيلٌ فَأَمَّا هَاهُنَا فَلَا يُكْرَهُ.

Imam Sadiq (peace be upon him) said: 'Cutting down a palm tree is disliked.' And the Imam was asked about cutting down a tree. He said: 'There is no problem.' I said: 'What about cutting down a cedar tree?' He said: 'Indeed, cutting down a cedar tree in the desert is disliked because it is scarce there, but it is not disliked here!'

4 عَنْ صَفْوَانَ عَنْ مَنْصُورِ بْنِ حَازِمٍ قَالَ قَالَ أَبُو عَبْدِ اللَّهِ علیه السلام النَّاسُ مَأْمُورُونَ وَ مَنْهِیُّونَ وَ مَنْ کَانَ لَهُ عُذْرٌ عَذَرَهُ اللَّهُ

📚Mahasin, Vol. 1, p. 229

Imam Sadiq (peace be upon him) said: 'People are commanded (to do some things) and forbidden (from doing some things), and whoever has an excuse (in a matter), Allah accepts his excuse!'

✅In the first narration, there is a strong condemnation of cutting down fruit trees, and in the second and third narrations, some cases are exempted, which are to be taken. However, given the condemnation in the first narration for cutting down fruit trees, it is necessary to act upon this narration and avoid cutting down fruit trees, except for cases that are exempted in the second and third narrations or cases where, according to the fourth narration, we have a valid excuse for cutting it down.

✅In the case of the question, a fruit tree is in the way of building a house, and this is an excuse, for which, according to the fourth narration which is a general principle, we are excused in cutting it down, and insha'Allah, Allah will accept our excuse. But to respect the first narration, it is necessary to avoid cutting down fruit trees without a reason or a valid excuse.

✅Of course, the prohibitions and permissions mentioned above are related to fruit trees, and there is no specific prohibition for non-fruit trees.
