📚Al-Kafi, Vol. 7, p. 348

Imam Sadiq (peace be upon him) said: 'Cutting off the head of the deceased is more severe than cutting off the head of a living person!'

2 مُحَمَّدِ بْنِ سِنَانٍ عَمَّنْ أَخْبَرَهُ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: قُلْتُ لَهُ رَجُلٌ قَطَعَ رَأْسَ مَيِّتٍ قَالَ حُرْمَةُ الْمَيِّتِ كَحُرْمَةِ الْحَيِّ.

A person said: 'I said to Imam Sadiq (peace be upon him): 'A person cuts off the head of a dead person!' He said: 'The sanctity and respect of a dead person is like the sanctity and respect of a living person!'

3 مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ فِي حَدِيثِ وَفَاةِ الْحَسَنِ وَ دَفْنِهِ قَالَ: إِنَّ اللَّهَ حَرَّمَ مِنَ الْمُؤْمِنِينَ أَمْوَاتاً مَا حَرَّمَ مِنْهُمْ أَحْيَاءً.

Imam Baqir (peace be upon him), in a hadith about the death of Imam Hasan al-Mujtaba (peace be upon him) and the story of his burial, said: 'Indeed, what God has forbidden to a believer during their life, He has also forbidden to them in death!'

4 عَنْ صَفْوَان قَالَ: قَالَ أَبُو عَبْدِ اللَّه أَبَى اللَّهُ أَنْ يُظَنَّ بِالْمُؤْمِنِ إِلَّا خَيْراً وَ كَسْرُكَ عِظَامَهُ حَيّاً وَ مَيِّتاً سَوَاءٌ

Imam Sadiq (peace be upon him) said: 'God has refused that anything but good be thought of a believer, and breaking the bone of their dead body is equal to that of their living body!'

5 مِسْمَعٍ كِرْدِينٍ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنْ رَجُلٍ كَسَرَ عَظْمَ مَيِّتٍ فَقَالَ حُرْمَتُهُ مَيِّتاً أَعْظَمُ مِنْ حُرْمَتِهِ وَ هُوَ حَيٌّ

Musma' said: 'I asked Imam Sadiq (peace be upon him) about a person who breaks the bone of a deceased person.' The Imam said: 'The sanctity and respect of their dead body is greater than their sanctity and respect while they were alive!'

7 الحسين بن خالدقال: سُئِلَ أَبُو عَبْد اللَّه عَنْ رَجُلٍ قَطَعَ رَأْسَ مَيِّتٍ فَقَال إِنَّ اللَّهَ حَرَّمَ مِنْهُ مَيِّتاً كَمَا حَرَّمَ مِنْهُ حَيّاً فَمَنْ فَعَلَ بِمَيِّتٍ فِعْلًا يَكُونُ في مِثْلِه اجْتِيَاحُ نَفْس الْحَيِّ فَعَلَيْه الدِّيَةُ فَسَأَلْتُ عن ذلک أَبا الحسن فَقَال صَدَق أبو عبداللَّه هکذا قال رَسُولُ اللَّه قُلْتُ فَمَنْ قَطَعَ رَأْس مَیِّتٍ أَوْ شَقَّ بَطْنَهُ أَوْ فَعَل بِه ما یَکُونُ فیه اجْتِیَاحُ نَفْس الْحَیِّ فَعَلَیْه دِیَةُ النَّفْسِ کَامِلَةً فقال لا و لَکِنْ دِیَتُهُ دِیَةُ الْجَنِین فی بَطْنِ أُمِّهِ قَبْلَ أَنْ تُنْشَأَ فِیه الرُّوحُ و ذَلِک مِائَةُ دینار

Imam Sadiq (peace be upon him) was asked about a person who cuts off the head of a dead person; the Imam said: 'Just as God has forbidden this from him while he is alive, He has also forbidden it from him in death. So whoever does something to the deceased that would destroy and uproot a living person, then blood money (diya) is on him. I asked Imam Kadhim (peace be upon him) about this, and the Imam said: 'Abu Abdillah (peace be upon him) has spoken the truth, and the Messenger of Allah (peace be upon him and his family) said this.' I said: 'So, is a person who cuts off the head of a dead person, or tears open their stomach, or does something to them that is like what would destroy and uproot a living person, obligated to pay full blood money?' He said: 'No, but his blood money is the blood money of a fetus in the womb before a soul is breathed into it, and that is one hundred dinars.'

✅The above narrations clearly indicate that the same respect a living Muslim has, their dead body also has, and tearing and cutting the limbs of the deceased for medical research, student education, and other purposes that are common today is forbidden.

✅The above narrations are one of the most important sources of creating severe doubt regarding the cutting of the organs of a brain-dead person and transplanting them to the bodies of others.

Of course, there are other multiple severe doubts in this matter, including the lack of proof that these individuals are considered 'deceased.'

✅It is interesting that those who claim the permissibility of cutting the organs of a brain-dead person for transplanting to those in need, although they are few and have given an opinion contrary to the popular Shi'a view, none of them consider the rulings of the deceased, such as the maturity of debts and credits, the beginning of the waiting period ('idda), ghusl and shrouding, the division of inheritance, and so on, to apply in the state of brain death!!!
