1 عَنْ إِسْمَاعِیلَ بْنِ سَعْدٍ الْأَشْعَرِیِّ قَالَ: سَأَلْتُ الرِّضَا عَنِ الْمُسْتَرَابَةِ مِنَ الْمَحِیضِ کَیْفَ تُطَلَّقُ قَالَ تُطَلَّقُ بِالشُّهُورِ.

Isma'il ibn Sa'd said: 'I asked Imam Reza (peace be upon him) about a woman who is of menstruating age but does not menstruate, how is she to be divorced?' He said: 'According to the passing of months!'

2 عَنْ دَاوُدَ بْنِ أَبِی یَزِیدَ الْعَطَّارِ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنِ الْمَرْأَةِ یُسْتَرَابُ بِهَا وَ مِثْلُهَا تَحْمِلُ وَ مِثْلُهَا لَا تَحْمِلُ وَ لَا تَحِیضُ وَ قَدْ وَاقَعَهَا زَوْجُهَا کَیْفَ یُطَلِّقُهَا إِذَا أَرَادَ طَلَاقَهَا قَالَ لِیُمْسِکْ عَنْهَا ثَلَاثَةَ أَشْهُرٍ ثُمَّ یُطَلِّقُهَا.

One of the companions said: 'I asked Imam Sadiq (peace be upon him) about a woman who is in a state of doubt (due to the cessation of her menstruation) and a woman like her gets pregnant, and she is a woman who does not get pregnant or menstruate, and her husband has had intercourse with her. When her husband wants to divorce her, how should he divorce her?' The Imam said: 'Her husband should refrain from her for three months (and not have intercourse with her) and then divorce her!'

3 عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَ إِنِ ارْتَبْتُمْ فَقَالَ مَا جَازَ الشَّهْرَ فَهُوَ رِیبَةٌ

Halabi said: 'I asked Imam Sadiq (peace be upon him) about the saying of Allah, the Mighty and Glorious (in Surah Al-Ma'idah, verse 106) where He says: '...women you have doubted (about the reason for their menstruation stopping)...'' The Imam said: 'Anything that exceeds one month is doubt and uncertainty!'

4 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ أَنَّهُ سَأَلَ أَبَا جَعْفَرٍ عَنْ رَجُلٍ قَالَ لِامْرَأَتِهِ أَنْتِ عَلَيَّ حَرَامٌ أَوْ بَائِنَةٌ أَوْ بَتَّةٌ أَوْ بَرِيَّةٌ أَوْ خَلِيَّةٌ قَالَ هَذَا كُلُّهُ لَيْسَ بِشَيْ ءٍ إِنَّمَا الطَّلَاقُ أَنْ يَقُولَ لَهَا فِي قُبُلِ الْعِدَّةِ بَعْدَ مَا تَطْهُرُ مِنْ مَحِيضِهَا قَبْلَ أَنْ يُجَامِعَهَا أَنْتِ طَالِقٌ أَوِ اعْتَدِّي يُرِيدُ بِذَلِكَ الطَّلَاقَ وَ يُشْهِدَ عَلَى ذَلِكَ رَجُلَيْنِ عَدْلَيْنِ.

Muhammad ibn Muslim asked Imam Baqir (peace be upon him) about a man who says to his wife:

أَنْتِ عَلَیَّ حَرَامٌ : یعنی : تو بر من حرام هستی

Or says: '(Anti) ba'inah' which means: 'You are separated and distant from me'

Or says: '(Anti) battah' which means: 'You are cut off!'

Or says: '(Anti) bariyyah' which means: 'You are separated'

Or says: '(Anti) khaliyyah' which means: 'You are free.' The Imam said: 'All of these are nothing (they have no validity for a divorce) and a divorce is for the man to say to her at the beginning of her waiting period, after she has become pure from her menstruation, before he has had intercourse with her: 'Anti taliq,' which means 'You are divorced,' or to say to her with the intention of divorce: 'Observe the waiting period,' and to have two just men as witnesses to it!'

✅ Based on the above narrations and others, one of the conditions for the validity of a divorce is that the woman must be in a state of purity where no intercourse has taken place during that purity.

However, some women, even though they are not menopausal or young and are of menstruating age, their menstruation may have stopped for various reasons. If this cessation of menstruation exceeds one month, such a woman is called 'mustarabah' (one in a state of doubt), because her menstruation has been cut off for more than one month, despite being of menstruating age.

To divorce such women who are of menstruating age but do not menstruate, three months must pass from the last intercourse, and after the three months have passed, her husband can divorce her.
