Question 1182: Is the Zakat al-Fitr of a wife who has been given a mubarat divorce in the month of Ramadan obligatory upon the husband?

✅ Answer: Please pay attention to the following narrations:
1 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ قَالَ: سَأَلْتُهُ عَمَّا يَجِبُ عَلَى الرَّجُلِ فِي أَهْلِهِ مِنْ صَدَقَةِ الْفِطْرَةِ قَالَ تَصَدَّقْ عَنْ جَمِيعِ مَنْ تَعُولُ الْحَدِيثَ.

Muhammad ibn Muslim said: I asked Imam Baqir (peace be upon him) about what is obligatory upon a man from Zakat al-Fitr regarding his family. The Imam said: 'Give charity on behalf of all those whom you provide for and whose maintenance you bear!'
2 قَالَ أَمِيرُ الْمُؤْمِنِينَ فِي خُطْبَةِ الْعِيدِ يَوْمَ الْفِطْرِ أَدُّوا فِطْرَتَكُمْ فَإِنَّهَا سُنَّةُ نَبِيِّكُمْ وَ فَرِيضَةٌ وَاجِبَةٌ مِنْ رَبِّكُمْ فَلْيُؤَدِّهَا كُلُّ امْرِئٍ مِنْكُمْ عَنْ عِيَالِهِ كُلِّهِمْ ذَكَرِهِمْ وَ أُنْثَاهُمْ وَ صَغِيرِهِمْ وَ كَبِيرِهِمْ وَ حُرِّهِمْ وَ مَمْلُوكِهِمْ عَنْ كُلِّ إِنْسَانٍ مِنْهُمْ صَاعاً مِنْ تَمْرٍ أَوْ صَاعاً مِنْ بُرٍّ أَوْ صَاعاً مِنْ شَعِيرٍ.

Amir al-Mu'minin (peace be upon him) said in a sermon on Eid al-Fitr: 'Pay your fitra, for it is the tradition of your Prophet and an obligatory duty from your Lord. So let each of you give one sa' of dates or one sa' of wheat or one sa' of barley on behalf of all his dependents, their women and men, their young and old, their free and slaves, on behalf of every person among them!'
3 عَنْ إِسْمَاعِيلَ الْجُعْفِيِّ عَنْ أَحَدِهِمَا قَالَ: الْمُبَارَأَةُ تَطْلِيقَةٌ بَائِنٌ وَ لَيْسَ فِيهَا رَجْعَةٌ

Imam Baqir or Imam Sadiq (peace be upon them) said: 'Mubarat is a final divorce (talaq ba'in), and there is no right of return in it!'
4 عَنْ سَعْدِ بْنِ أَبِي خَلَفٍ قَالَ: سَأَلْتُ أَبَا الْحَسَنِ مُوسَى عَنْ شَيْءٍ مِنَ الطَّلَاقِ فَقَالَ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ طَلَاقاً لَا يَمْلِكُ فِيهِ الرَّجْعَةَ فَقَدْ بَانَتْ مِنْهُ سَاعَةَ طَلَّقَهَا وَ مَلَكَتْ نَفْسَهَا وَ لَا سَبِيلَ لَهُ عَلَيْهَا وَ تَعْتَدُّ حَيْثُ شَاءَتْ وَ لَا نَفَقَةَ لَهَا

Sa'd said: I asked Imam Kadhim (peace be upon him) about something concerning divorce. The Imam said: 'If a man gives his wife a divorce in which he does not have the right of return, then at the very hour he divorced her, that woman has become final (ba'in) from him, and the woman becomes her own master. There is no way for that man over the woman, and that woman completes her 'iddah wherever she wishes, and there is no maintenance for her!'
✅ Based on the above narrations and others, a mubarat and khul' divorce is a final divorce (talaq ba'in), and during the 'iddah period, there is no maintenance for that woman upon the man. That woman is not considered part of the man's dependents or those he provides for. Therefore, her Zakat al-Fitr is not the responsibility of that man, even if the woman is in her 'iddah period.

وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْرَ
✅ One of the best and most comprehensive prayers for bidding farewell to the month of Ramadan is Dua 45 of Sahifa Sajjadiyya, which is highly recommended for all believers to recite on the nights of the 29th and 30th of Ramadan.
