Question 456: Is it permissible to give recommended charity to the Sayyids?

1 عَنْ جَعْفَرِ بْنِ إِبْرَاهِيمَ الْهَاشِمِيِّ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: قُلْتُ لَهُ أَ تَحِلُّ الصَّدَقَةُ لِبَنِي هَاشِمٍ- فَقَالَ إِنَّمَا تِلْكَ الصَّدَقَةُ الْوَاجِبَةُ عَلَى النَّاسِ لَا تَحِلُّ لَنَا فَأَمَّا غَيْرُ ذَلِكَ فَلَيْسَ بَأْسٌ وَ لَوْ كَانَ كَذَلِكَ مَا اسْتَطَاعُوا أَنْ يَخْرُجُوا إِلَى مَكَّةَ- هَذِهِ الْمِيَاهُ عَامَّتُهَا صَدَقَةٌ

Ja'far ibn Ibrahim al-Hashimi said: 'I said to Imam Sadiq (peace be upon him): Is charity permissible for the Banu Hashim?'
The Imam said: 'It is the obligatory charity on the people which is not permissible for us, but other than that (i.e., non-obligatory charities) is fine. If it were otherwise, the Banu Hashim would not be able to travel to Mecca, because most of these waters (which are on the way between Medina and Mecca) are a charity (non-obligatory, like a waqf).'
2 عَنْ أَبِي أُسَامَةَ زَيْدٍ الشَّحَّامِ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنِ الصَّدَقَةِ الَّتِي حُرِّمَتْ عَلَيْهِمْ فَقَالَ هِيَ الزَّكَاةُ الْمَفْرُوضَةُ وَ لَمْ تُحَرَّمْ عَلَيْنَا صَدَقَةُ بَعْضِنَا عَلَى بَعْضٍ.

Zayd al-Shahham said: 'I asked Imam Sadiq (peace be upon him) about the charity that is forbidden to them.' The Imam said: 'It is the obligatory zakat, and the (obligatory) charity of some of us (Banu Hashim) on others is not forbidden.'
3 عَنْ عَبْدِ اللَّهِ بْنِ شَيْبَانَ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: إِنَّمَا حُرِّمَ عَلَى بَنِي هَاشِمٍ مِنَ الصَّدَقَةِ الزَّكَاةُ الْمَفْرُوضَةُ عَلَى النَّاسِ ثُمَّ قَالَ لَوْ لَا أَنَّ هَذَا لَحُرِّمَتْ عَلَيْنَا هَذِهِ الْمِيَاهُ الَّتِي فِيمَا بَيْنَ [فیها] مَكَّةَ وَ الْمَدِينَةِ

Imam Sadiq (peace be upon him) said: 'Indeed, from the charities, only the obligatory zakat (which is obligatory on the people) is forbidden to the Banu Hashim.' Then he said: 'If this were not the case, these waters between Mecca and Medina would have been forbidden to us.'
✅ Charity is a general term that includes both obligatory and compulsory zakat as well as recommended and supererogatory charities, such as daily charities, endowments, etc. According to Shi'a narrations, only obligatory and compulsory charities such as zakat on wealth and zakat al-fitr and others are forbidden to the Banu Hashim and the Sayyids. However, according to narration 2 and other narrations, the obligatory and compulsory zakat of the Banu Hashim is not forbidden for themselves, meaning that the Sayyids can give obligatory and compulsory zakat to each other, but non-Sayyids cannot give zakat and obligatory and compulsory charity to the Sayyids. According to the above narrations, non-Sayyids can give their non-obligatory charities to the Sayyids because non-obligatory charities are not forbidden to the Sayyids and the Banu Hashim.
