Question 2162: Is it permissible to purchase properties confiscated by the government, such as warehouses seized under the pretext of hoarding, or motorcycles impounded under the pretext of not having a driver's license, etc., which are then put up for sale?

✅ Answer: Please pay attention to the following hadiths:

1 عَنْ أَبِي عُبَيْدَةَ عَنْ أَبِي جَعْفَر قَالَ: سَأَلْتُهُ عَنِ الرَّجُلِ مِنَّا يَشْتَرِي مِنَ السُّلْطَانِ مِنْ إِبِلِ الصَّدَقَةِ وَ غَنَمِ الصَّدَقَةِ وَ هُوَ يَعْلَمُ أَنَّهُمْ يَأْخُذُونَ مِنْهُمْ أَكْثَرَ مِنَ الْحَقِّ الَّذِي يَجِبُ عَلَيْهِمْ قَالَ فَقَالَ مَا الْإِبِلُ وَ الْغَنَمُ إِلَّا مِثْلَ الْحِنْطَةِ وَ الشَّعِيرِ وَ غَيْرِ ذَلِکَ لَا بَأْسَ بِهِ حَتَّى تَعْرِفَ الْحَرَامَ بِعَيْنِهِ.

Abu Ubaydah said: I asked Imam al-Baqir (peace be upon him) about a man from among us (the Shiites) who buys camels and sheep of zakat from the ruler (sultan), while knowing that they have taken more than the obligatory right from the people. The Imam said: 'Camels and sheep are no different than wheat, barley, and other things; there is no harm in buying it unless you recognize the forbidden (haram) specifically in its essence (meaning, you know that this specific animal or property is usurped).'

2 عَنْ جَمِيلِ بْنِ صَالِحٍ قَالَ : أَرَادُوا بَيْعَ تَمْرِ عَيْنِ أَبِي زِيَادٍ فَأَرَدْتُ أَنْ أَشْتَرِيَهُ ثُمَّ قُلْتُ حَتَّى أَسْتَأْمِرَ أَبَا عَبْدِ اللَّهِ فَأَمَرْتُ مُعَاذاً فَسَأَلَهُ فَقَالَ قُلْ لَهُ يَشْتَرِيهِ فَإِنَّهُ إِنْ لَمْ يَشْتَرِهِ اشْتَرَاهُ غَيْرُهُ.

Jamil ibn Salih said: They wanted to sell the dates of the spring of Abu Ziyad (a government official), and I intended to buy them, but I said, let me seek permission from Imam al-Sadiq (peace be upon him). I sent Mu'adh, and he asked the Imam. The Imam said: 'Tell him to buy it, because if he does not buy it, someone else will!'

3 عَنْ مُعَاوِيَةَ بْنِ وَهْبٍ قَالَ: قُلْتُ لِأَبِي عَبْدِ اللَّهِ أَشْتَرِي مِنَ الْعَامِلِ الشَّيْءَ وَ أَنَا أَعْلَمُ أَنَّهُ يَظْلِمُ فَقَالَ اشْتَرِ مِنْهُ.

Mu'awiyah ibn Wahb said: I said to Imam al-Sadiq (peace be upon him): 'Should I buy something from a government official while I know (in general) that he acts oppressively (in taking properties from the people)?' The Imam said: 'Buy from him!'

4 عَنْ إِسْحَاقَ بْنِ عَمَّارٍ قَالَ: سَأَلْتُهُ عَنِ الرَّجُلِ یَشْتَرِی مِنَ الْعَامِلِ وَ هُوَ یَظْلِمُ قَالَ یَشْتَرِی مِنْهُ مَا لَمْ یَعْلَمْ أَنَّهُ ظَلَمَ فِیهِ أَحَداً.

Ishaq ibn Ammar said: I asked (Imam al-Sadiq,

peace be upon him) about a person who buys something from the agent of the ruler while that agent acts oppressively; the Imam said: 'As long as he does not gain knowledge that he has oppressed someone (specifically), he may buy from him!'

✅ According to the above hadiths and others, purchasing from the ruler and the agents of the ruler is permissible as long as the person does not have knowledge that the commodity itself was taken oppressively, even if we know in general that the oppressive taking of people's properties is part of their practice.

✅ Therefore, purchasing goods that have been confiscated under the pretext of hoarding, or vehicles that have been impounded under various pretexts and put up for sale, is not permissible.

Because according to the narrations, firstly, hoarding has its own specific criteria, and secondly, hoarded properties are not confiscated; rather, the owner is compelled to bring them to the market and sell them at the market rate. The hadiths regarding this are available at the following link:

Therefore, any property about which we have knowledge and certainty that it is exactly usurped cannot be purchased.

However, other goods about which we do not have knowledge of being usurped, and which the ruler puts up for sale, can be purchased.
