Question 1636: Can a person outside of Ramadan make the intention for fasting such that: If I have missed fasts (qada), let it be for qada, and if I don’t, let it be for a recommended (mustahabb) fast?

✅ Answer: Pay attention to the following narrations:
1 عَنْ أَمِيرالْمُؤْمِنِينَ قَالَ: قَالَ رَسُولُ اللَّهِ لَا قَوْلَ إِلَّا بِعَمَلٍ وَ لَا قَوْلَ وَ لا عَمَلَ إِلَّا بِنِيَّةٍ وَ لَا قَوْلَ وَ لا عَمَلَ وَ لا نِيَّةَ إِلَّا بِإِصَابَةِ السُّنَّة
📚 Al-Kafi, Vol. 1, p. 70
Amir al-Mu'minin (peace be upon him) said: The Messenger of Allah (peace and blessings be upon him and his family) said: There is no speech or belief without action, no speech or action without intention, and no speech, action, or intention without conforming to the Sunnah!
✅ Based on the above narration and others, every religious act a person intends to perform must be based on intention, and the intention must align with the Sunnah and the sayings of the divine proofs.
This type of intention for fasting is not mentioned in the relevant narrations, and it is necessary for the individual to have a single, specific intention based on the Sunnah for their fast.
✅ A person who makes such an intention does so because they are uncertain about whether they have missed fasts (qada), and two scenarios are possible:
1. They were certain they had no missed fasts but now have doubt. In such a case, they act according to the following narration:
2 عَنْ زرارة عن أبي جعفر قال: لَا يَنْقُضُ الْيَقِينَ أَبَداً بِالشَّكِّ و لَكِنْ يَنْقُضُهُ بِيَقِينٍ آخَرَ

Imam Baqir (peace be upon him) said: A person never breaks certainty with doubt, but only with another certainty!
✅ Based on narrations like this, if someone was certain they had no missed fasts and now doubts, their certainty is not broken by this doubt unless another certainty replaces the previous one. Thus, until their doubt turns into certainty, they do not need to intend qada fasting and should intend a recommended (nafilah) fast.
2. They were certain they had missed fasts and have not yet confirmed completing them.
In this case, in addition to the previous narration, they act according to narrations like the following:
3 عَنْ إسحاق بن عمار قال: قال لِي أَبُو الْحَسَنِ الْأَوَّلُ إِذَا شَكَكْتَ فَابْنِ عَلَى الْيَقِينِ قَالَ قُلْتُ: هَذَا أَصْلٌ قَالَ نَعَمْ

Ishaq ibn Ammar says: Imam Kazim (peace be upon him) said to me: When you are in doubt, base your action on certainty! I said: Is this a principle? He said: Yes!
✅ Based on the above narrations, in this case, until they are certain they have completed their missed fasts, they should fast with the intention of qada, and afterward, they can fast with the intention of nafilah.
✅ It should be known that every act a person performs in accordance with the Sunnah and their religious duty is encompassed by the rewards promised in the Quran and narrations. One should not think that if they fast for qada out of caution to ensure completion of missed fasts, while in divine knowledge they had no missed fasts, their fasts are wasted or unrewarded.
In general, any act or worship performed in accordance with the Sunnah is promised reward, and there is no concern about adhering to intentions not based on the Sunnah.
✅ Regarding prayer, pay attention to the following narration:
4 عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْدِ اللَّهِ أَنَّهُ قَالَ: إِذَا لَمْ تَدْرِ اثْنَتَیْنِ صَلَّیْتَ أَمْ أَرْبَعاً وَ لَمْ یَذْهَبْ وَهْمُکَ إِلَی شَیْءٍ فَتَشَهَّدْ وَ سَلِّمْ ثُمَّ صَلِّ رَکْعَتَیْنِ وَ أَرْبَعَ سَجَدَاتٍ تَقْرَأُ فِیهِمَا بِأُمِّ الْکِتَابِ ثُمَّ تَشَهَّدُ وَ تُسَلِّمُ فَإِنْ کُنْتَ إِنَّمَا صَلَّیْتَ رَکْعَتَیْنِ کَانَتَا هَاتَانِ تَمَامَ الْأَرْبَعِ وَ إِنْ کُنْتَ صَلَّیْتَ أَرْبَعاً کَانَتَا هَاتَانِ نَافِلَةً.

Imam Sadiq (peace be upon him) said: When you are unsure whether you prayed two or four rak'ahs, and your doubt leans neither way, recite tashahhud and give salam, then pray two rak'ahs with four prostrations in which you recite only Surah Al-Fatiha, then recite tashahhud and give salam. If you had prayed two rak'ahs, these two complete the four, and if you had prayed four, these two are considered nafilah!
✅ We see that if someone, in doubt between two and four rak'ahs, fulfills their duty by praying two precautionary rak'ahs, if their four rak'ahs were complete, these two are counted as nafilah!
✅ Therefore, always intend according to the Sunnah and know that the Lord states in Surah At-Tawbah, Verse 120: Indeed, Allah does not waste the reward of the doers of good!
إِنَّ اللَّهَ لَا يُضِيعُ أَجْرَ الْمُحْسِنِينَ

اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ وَ آلِ مُحَمَّدٍ
وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْرَ
