Question 532: A person, despite having the means, has not performed Hajj and did not intend to do so. Is the wealth he leaves as inheritance forbidden for the heirs?

1 عَنْ مُوسَى بْنِ الْقَاسِمِ عَنْ صَفْوَانَ عَنْ مُعَاوِيَةَ بْنِ عَمَّارٍ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّه عَنِ الرَّجُلِ يَمُوتُ وَ لَمْ يَحُجَّ حَجَّةَ الْإِسْلَامِ وَ يَتْرُكُ مَالًا قَالَ عَلَيْهِ أَنْ يُحِجَّ عنه مِنْ مَالِهِ رَجُلًا صَرُورَةً لَا مَالَ لَهُ.

Mu'awiya ibn Ammar said: I asked Imam al-Sadiq, peace be upon him, about a person who dies and has not performed his obligatory Hajj and has left wealth; the Imam said: It is obligatory upon him that a man who has not performed Hajj and has no wealth performs Hajj on his behalf from his wealth.

2 عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَنْ رَجُلٍ مَاتَ وَ لَمْ يَحُجَّ حَجَّةَ الْإِسْلَامِ يُحَجُّ عَنْهُ قَالَ نَعَمْ.

Muhammad ibn Muslim said: I asked Imam al-Baqir, peace be upon him, about a person who dies and has not performed his obligatory Hajj. Can Hajj be performed on his behalf? He said: Yes.

3 عَنْ عُثْمَانَ بْنِ عِيسَى وَ زُرْعَةَ بْنِ مُحَمَّدٍ جَمِيعاً عَنْ سَمَاعَةَ بْنِ مِهْرَانَ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّه عَنِ الرَّجُلِ يَمُوتُ وَ لَمْ يَحُجَّ حَجَّةَ الْإِسْلَامِ وَ لَمْ يُوصِ بِهَا وَ هُوَ مُوسِرٌ فَقَالَ يُحَجُّ عَنْهُ مِنْ صُلْبِ مَالِهِ لَا يَجُوزُ غَيْرُ ذَلِكَ.

Sama'a said: I asked Imam al-Sadiq, peace be upon him, about a person who dies while he has not performed his obligatory Hajj, and he has not made a will for it, and he is wealthy and well-off; he said: Hajj must be performed on his behalf from the principal of his wealth, and nothing else is permissible!

✅There is no narration that states that the wealth of a person who has not performed the obligatory Hajj is forbidden for the heirs, but according to many narrations, three of which were mentioned, it is necessary to perform Hajj on his behalf from the principal of his wealth, because this person had the means, and Hajj is a debt upon him, and Hajj must be performed for him from the principal of his wealth.
