Question 430: What is the duty of a person who owes a fasting expiation (kaffarah) but is unable to perform it?

1 عَنْ أَبِي عَبْدِ اللَّهِ فِي رَجُلٍ أَفْطَرَ مِنْ شَهْرِ رَمَضَانَ- مُتَعَمِّداً يَوْماً وَاحِداً مِنْ غَيْرِ عُذْرٍ قَالَ يُعْتِقُ نَسَمَةً أَوْ يَصُومُ شَهْرَيْنِ مُتَتَابِعَيْنِ أَوْ يُطْعِمُ سِتِّينَ مِسْكِيناً فَإِنْ لَمْ يَقْدِرْ تَصَدَّقَ بِمَا يُطِيق

Imam Sadiq, peace be upon him, said about a person who deliberately breaks his fast for one day in the month of Ramadan: He either frees a slave, or fasts for two consecutive months, or feeds sixty needy people. So if he is not able to do these things, he gives charity as much as he can.

Imam Sadiq, peace be upon him, said about a person who has intercourse with his wife in the month of Ramadan but does not find anything to give as charity to 60 needy people (for expiation): He gives charity as much as he is able and capable.
3 عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ كَانَ عَلَيْهِ صِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ فَلَمْ يَقْدِرْ عَلَى الصِّيَامِ وَ لَمْ يَقْدِرْ عَلَى الْعِتْقِ وَ لَمْ يَقْدِرْ عَلَى الصَّدَقَةِ قَالَ فَلْيَصُمْ ثَمَانِيَةَ عَشَرَ يَوْماً عَنْ كُلِّ عَشَرَةِ مَسَاكِينَ [أَیَّامَ] ثَلَاثَةَ أَيَّامٍ

Abu Basir said: I asked Imam Sadiq, peace be upon him, about a person who is obligated to fast for two consecutive months, but he is not able to fast, nor is he able to free a slave, nor is he able to give charity (to 60 poor people); The Imam said: He must fast for 18 days, three days for every 10 needy people (or for every 10 days).
✅According to the first narration and other narrations, if a person deliberately breaks his fast in the month of Ramadan, for expiation he must do one of these three things: either free a slave, or fast for two consecutive months, or feed 60 needy people.
Nowadays, due to the non-existence of slaves, it is not possible to free a slave for expiation, and the other two expiations remain. If a person is unable to perform both of them and cannot do either, the Ahl al-Bayt, peace be upon them, have provided two ways for him. According to the first and second narrations, he gives charity as much as he can, or according to the third narration, instead of fasting for 60 days, he fasts for 18 days. And if he is not able to do these two things either, he acts according to the two following narrations: 👇
4 عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: كُلُّ مَنْ عَجَزَ عَنِ الْكَفَّارَةِ الَّتِي تَجِبُ عَلَيْهِ مِنْ صَوْمٍ أَوْ عِتْقٍ أَوْ صَدَقَةٍ فِي يَمِينٍ أَوْ نَذْرٍ أَوْ قَتْلٍ أَوْ غَيْرِ ذَلِكَ مِمَّا يَجِبُ عَلَى صَاحِبِهِ فِيهِ الْكَفَّارَةُ فَالاسْتِغْفَارُ لَهُ كَفَّارَةٌ مَا خَلَا يَمِينَ الظِّهَارِ......

Imam Sadiq, peace be upon him, said: Whoever is unable and incapable of the expiation that is obligatory upon him, from fasting, freeing a slave, and charity in the expiation of an oath, a vow, and unintentional killing, or other things where expiation is obligatory upon its owner, then seeking forgiveness (istighfar) is expiation for him, except for the expiation of 'zihar' oath...
5 عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ دَاوُدَ بْنِ فَرْقَدٍ عَنْ أَبِي عَبْدِ اللَّهِ فِي حَدِيثٍ قَالَ: إِنَّ الِاسْتِغْفَارَ تَوْبَةٌ وَ كَفَّارَةٌ لِكُلِّ مَنْ لَمْ يَجِدِ السَّبِيلَ إِلَى شَيْ ءٍ مِنَ الْكَفَّارَةِ.

Imam Sadiq, peace be upon him, said in a narration: Indeed, seeking forgiveness is repentance and expiation for a person who has no way to any of the expiations.
✅It is clear from the two narrations above that if a person is not able to perform any of the three types of expiation for breaking the fast of the month of Ramadan and is also unable to perform its reduced form in case of inability, which is fasting for 18 days instead of 60 consecutive days or giving charity as much as he can, his expiation and repentance is to seek forgiveness.
✅Traditions 3 and 4 are two general principles that if a person cannot perform any of the types of expiations in various matters and is not capable of any of them, his duty is to seek forgiveness, which is considered his repentance and expiation.
✅As stated in the third narration, in the case of a person unable to perform the expiation of 'zihar', there are special rulings, and it is not included in this general principle, and its narrations are recorded in Shia hadith collections.
