Question 2104: Can Radd al-Madhalim (compensation for injustices) be given to poor Sayyids (descendants of the Prophet)?

✅ Answer: Please pay attention to the following narrations:

1 جعفر بن إبراهيم الهاشمي عن أَبِي عبداللَّه قال: قُلْتُ لَهُ أَ تَحِلُّ الصَّدَقَةُ لِبَنِي هَاشِمٍ فَقَالَ إِنَّمَا تِلْكَ الصَّدَقَةُ الْوَاجِبَةُ عَلَى النَّاسِ لَا تَحِلُّ لَنَا فَأَمَّا غَيْرُ ذَلِكَ فَلَيْسَ بِهِ بَأْسٌ

📚 Kafi, Vol. 4, p. 59

Ja'far ibn Ibrahim said: I said to Imam Sadiq (peace be upon him): Is Sadaqah (charity) lawful for Bani Hashim? The Imam said: It is the obligatory Sadaqah (Zakat) that is not lawful for us, but other than that, there is no problem!

2 أَحمد بن مُحَمَّد عن بعض أَصْحَابِنَا رَفَعَ الْحَدِيثَ قال: فَالنِّصْفُ لَهُ خَاصَّةً وَ النِّصْفُ لِلْيَتَامَى وَ الْمَسَاكِينِ و أَبْنَاءِ السَّبِيلِ مِنْ آلِ مُحَمَّدٍ الَّذِينَ لَا تَحِلُّ لَهُمُ الصَّدَقَةُ وَ لَا الزَّكَاةُ عَوَّضَهُمُ اللَّهُ مَكَانَ ذَلِكَ بِالْخُمُسِ

One of the companions narrated a tradition raised to the Imam regarding the distribution of Khums (one-fifth tax), where he said: Then half of the Khums is his (meaning the Imam, peace be upon him) and the other half is for the orphans, the needy, and the wayfarers from the family of Muhammad (peace and blessings be upon him and his family) (meaning Sayyids) for whom Sadaqah (obligatory charity) and Zakat are not lawful, and Allah has made the Khums for them instead of that (meaning Zakat and obligatory Sadaqah)!

3 بعض أَصْحَابِنَا عن الْعَبْدالصَّالِح في حَدِيث طويل قال: و إِنَّمَا جَعَلَ اللَّهُ هَذَا الْخُمُسَ خَاصَّةً لَهُمْ يَعْنِي بَنِي الْمُطَّلِبِ عِوَضاً لَهُمْ مِنْ صَدَقَاتِ النَّاسِ تَنْزِيهاً مِنَ اللَّهِ لَهُمْ و لَا بَأْسَ بِصَدَقَاتِ بَعْضِهِمْ عَلَى بَعْضٍ

Imam Kadhim (peace be upon him) said: Indeed, Allah has specifically decreed the Khums for the children of Abdul Muttalib (meaning Sayyids) as a means of purification from His side, in lieu of the people's Sadaqat (charities), but there is no problem with the Sadaqat of some Sayyids being given to others!

4 زيد الشَّحَّام عن أَبي عبداللَّه قال: سَأَلْتُهُ عَنِ الصَّدَقَةِ الَّتِي حُرِّمَتْ عَلَيْهِمْ فَقَالَ هِيَ الزَّكَاةُ الْمَفْرُوضَةُ و لَمْ تحَرَم عَلَيْنَا صَدَقَةُ بَعْضِنَا عَلَى بَعْضٍ

Zayd al-Shahham said: I asked Imam Sadiq (peace be upon him) about the Sadaqah that is forbidden to them (Bani Hashim); the Imam said: It is the obligatory Zakat, and the Sadaqah of some of us upon others is not forbidden!

5 إِسماعيل بن الْفَضْل الْهَاشِمِي قال: سَأَلْتُ أَبَا عبداللَّه عَنِ الصَّدَقَةِ الَّتِي حُرِّمَتْ عَلَى بَنِي هَاشِمٍ مَا هِيَ فَقَالَ هِيَ الزَّكَاةُ قُلْتُ فَتَحِلُّ صَدَقَةُ بَعْضِهِمْ عَلَى بَعْضٍ قَالَ نَعَمْ

Abdullah ibn Fadl al-Hashimi said: I asked Imam Sadiq (peace be upon him) about the Sadaqah that is forbidden to Bani Hashim, what is it? He said: It is the Zakat. I said: Is the Sadaqah of some of them upon others lawful? He said: Yes.

6 زرارة عن أَبي عبداللَّه قال: قُلْتُ لَهُ صَدَقَاتُ بَني هَاشِمٍ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ فَقَالَ نَعَمْ صَدَقَةُ الرَّسُولِ تَحِلُّ لِجَمِيعِ النَّاسِ مِنْ بَنِي هَاشِمٍ و غَيْرِهِمْ وَ صَدَقَاتُ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ و لَا تَحِلُّ لَهُمْ صَدَقَاتُ إِنْسَانٍ غَرِيبٍ

Zurarah said: I said to Imam Sadiq (peace be upon him): Is the Sadaqah of Bani Hashim lawful for each other? He said: The Sadaqah of the Messenger (peace and blessings be upon him and his family) is lawful for all people, both Bani Hashim and others, and the Sadaqat of Bani Hashim are also lawful for each other, but the Sadaqat of a stranger (meaning non-Sayyids) are not lawful for them!

7 عَنْ عَبْدالرَّحْمَنِ بْنِ الْحَجَّاجِ عَنْ أَبِی عَبْداللَّه أَنَّهُ قَالَ: لَوْ حَرُمَتْ عَلَیْنَا الصَّدَقَةُ لَمْ یَحِلَّ لَنَا أَنْ نَخْرُجَ إِلَی مَکَّةَ لِأَنَّ کُلَّ مَاءٍ بَیْنَ مَکَّةَ وَ الْمَدِینَةِ فَهُوَ صَدَقَةٌ.

Imam Sadiq (peace be upon him) said: If Sadaqah were forbidden to us, it would not be lawful for us to go to Mecca! Because every water source between Mecca and Medina is Sadaqah!

✅ From the above and other narrations, it is clear that obligatory Zakat (Zakat al-Faridah) and Zakat al-Fitrah (Fitr Zakat) are forbidden for Sayyids, unless the payer is also a Sayyid.

✅ Also, what is forbidden for Sayyids is the obligatory Zakat and obligatory Sadaqah (charity), and giving non-obligatory Sadaqat to Sayyids is permitted.

✅ The charity paid as Radd al-Madhalim (compensation for injustices), although it is our duty, its origin is not one of the types of obligatory Zakat that cannot be paid to Sayyids, and there is no clear prohibition against giving it to Sayyids, unless someone exercises precaution.

وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْرَ
