Question 1980: Is the dowry (mahr) in temporary marriage (Mut'ah) waivable?

1⃣عن زرارة عن أَبِی عَبْداللَّه فِی حَدِیثٍ قَالَ و لَا یَرْجِعُ الرَّجُلُ فِیمَا یَهَبُ لِامْرَأَتِهِ وَ لَا الْمَرْأَةُ فِیمَا تَهَبُ لِزَوْجِهَا حِیزَ أَوْ لَمْ یُحَزْ ألیس الله تبارک و تَعَالَی یَقُولُ و لا یَحِلُّ لَکُمْ أَنْ تَأْخُذُوا مِمَّا آتَیْتُمُوهُنَّ شَیْئاً و قَالَ فَإِنْ طِبْنَ لَکُمْ عَنْ شَیْءٍ مِنْهُ نَفْساً فَکُلُوهُ هَنِیئاً مَرِیئاً و هَذَا یَدْخُلُ فِی الصَّدَاقِ و الْهِبَة

📚 Al-Kafi, Vol. 7, p. 30

Imam al-Sadiq (peace be upon him) said in a hadith: A man cannot take back what he has gifted to his wife, and similarly, a woman cannot take back what she has gifted or forgiven her husband—whether or not what was gifted has come into his possession and control. Has Allah not said (Surah Al-Baqarah, 2:229):

‘It is not lawful for you to take back anything you have given to your wives.’

And Allah has also said (Surah An-Nisa, 4:4):

‘But if they, of their own accord, remit any part of it to you, then enjoy it with pleasure and satisfaction.’ This applies to dowry, gifts, and waivers!

2⃣عن السکونی عن أبی عبداللَّه قال: قال النَّبِیُّ أَیُّمَا امْرَأَةٍ تَصَدَّقَتْ عَلَی زَوْجِهَا بِمَهْرِهَا قَبْلَ أَنْ یَدْخُلَ بِها إِلَّا کَتَبَ اللَّهُ لَها بِکُلِّ دِینَارٍ عِتْقَ رَقَبَةٍ قِیلَ یا رَسُولَ اللَّهِ فَکَیْفَ بِالْهِبَةِ بَعْدَ الدُّخُولِ قال إِنَّمَا ذَلِکَ مِنَ الْمَوَدَّةِ و الْأُلْفَة

📚 Al-Kafi, Vol. 5, p. 382

Imam al-Sadiq (peace be upon him) said: The Messenger of Allah (peace and blessings be upon him and his family) said: If a woman donates her dowry to her husband before consummation, Allah will record for her the reward of freeing a slave for every dinar!

Someone asked: O Messenger of Allah! What about waiving the dowry after consummation? He replied: That is an act of love and affection!

📚 Tafsir Al-Ayyashi, Vol. 1, p. 219

Imam al-Sadiq (peace be upon him) said: A man complained (about an illness) to Amir al-Mu’minin (peace be upon him), and he advised him: Ask your wife for one dirham from her dowry, buy honey with it, and drink it mixed with rainwater. The man followed this advice and was cured. He then asked Amir al-Mu’minin whether this was something he had heard from the Prophet (peace and blessings be upon him and his family). He replied: No! But I heard Allah say in the Quran (Surah An-Nisa, 4:4): ‘If they, of their own accord, remit any part of it to you, then enjoy it with pleasure and satisfaction,’ and (Surah An-Nahl, 16:69) regarding bees: ‘From their bellies comes a drink of varying colors, in which there is healing for people,’ and (Surah Qaf, 50:9) regarding rain: ‘And We send down blessed water from the sky.’ Thus, in this remedy, there was enjoyment, healing, and blessing, and I hoped for a cure from it!

4⃣عن إسماعيل بن الفضل الهاشمي قال: سَأَلْتُ أَباعبداللَّه عَنِ الْمُتْعَةِ فَقَالَ مَهْرٌ مَعْلُومٌ إِلَى أَجَلٍ مَعْلُومٍ.

Isma'il bin Fadl al-Hashimi said: I asked Imam al-Sadiq (peace be upon him) about Mut'ah marriage. He replied: A specified dowry for a specified duration!

4⃣عن زرارة عن أَبِي جَعْفَرٍ في الْمُتْعَةِ قَالَ لَا بُدَّ مِنْ أَنْ يُصْدِقَهَا شَيْئاً قَلَّ أَوْ كَثُرَ و الصَّدَاقُ كُلُّ شَيْءٍ تَرَاضَيَا عَلَيْهِ في تَمَتُّعٍ أَوْ تَزْوِيجٍ بِغَيْرِ مُتْعَة

Imam al-Baqir (peace be upon him) said regarding Mut'ah: It is necessary to set a dowry, whether small or large, and the dowry is whatever is agreed upon in both temporary and permanent marriage!

✅ Based on the above and other narrations, the dowry in both permanent and temporary marriage can be waived by the wife, and this waiver is irrevocable. It also has special rewards, and according to the Quran, it is permissible and enjoyable. If the dowry is used to buy honey and mixed with rainwater, it can serve as a cure for illnesses!
