1⃣عَنِ ابْنِ أَبِي نَصْرٍ قَالَ: كَتَبْتُ إِلَى أَبِي جَعْفَرٍ الْخُمُسُ أُخْرِجُهُ قَبْلَ الْمَئُونَةِ أَوْ بَعْدَ الْمَئُونَةِ فَكَتَبَ بَعْدَ الْمَئُونَةِ.

📚 Al-Kafi Vol. 1, p. 545

Ibn Abi Nasr said: I wrote to Abu Ja'far (peace be upon him), asking if Khums should be taken out before or after living expenses?

The Imam replied: After living expenses (meaning after the usual household expenses).

2⃣عَنْ سَعْدِ بْنِ عَبْداللَّهِ عَنْ أَبِی جَعْفَرٍ عَنْ عَلِیِّ بْنِ مَهْزِیَارَ عَنْ مُحَمَّدِ بْنِ الْحَسَنِ الْأَشْعَرِیِّ قَالَ کَتَبَ بَعْضُ أَصْحَابِنَا إِلَی أَبِی جَعْفَرٍ الثَّانِی أَخْبِرْنِی عَنِ الْخُمُسِ أَ عَلَی جَمِیعِ مَا یَسْتَفِیدُ الرَّجُلُ مِنْ قَلِیلٍ وَ کَثِیرٍ مِنْ جَمِیعِ الضُّرُوبِ وَ عَلَی الصُّنَّاعِ وَ کَیْفَ ذَلِکَ فَکَتَبَ بِخَطِّهِ الْخُمُسُ بَعْدَ الْمَئُونَةِ.

Muhammad ibn Hasan said: One of the companions wrote to Imam al-Jawad (peace be upon him) asking about Khums: Is it applicable to everything, both small and large, from all types of income and trades? The Imam replied in his own handwriting: Khums is after living expenses!

3⃣عَنِ النَّضْرِ بْنِ سُوَیْدٍ عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: لَا تُبَاعُ الدَّارُ وَ لَا الْجَارِیَةُ فِی الدَّیْنِ وَ ذَلِکَ أَنَّهُ لَا بُدَّ لِلرَّجُلِ مِنْ ظِلٍّ یَسْکُنُهُ وَ خَادِمٍ یَخْدُمُهُ.

📚 Al-Kafi Vol. 5, p. 96

Imam al-Sadiq (peace be upon him) said: A house and a servant are not sold to pay off debt because a man must have a place to live and a servant to help him!

4⃣عَلِیُّ بْنُ جَعْفَرٍ فِی کِتَابِهِ عَنْ أَخِیهِ مُوسَی بْنِ جَعْفَرٍ قَالَ: سَأَلْتُهُ عَنِ الزَّکَاةِ أَ یُعْطَاهَا مَنْ لَهُ الدَّابَّةُ قَالَ نَعَمْ وَ مَنْ لَهُ الدَّارُ وَ الْعَبْدُ فَإِنَّ الدَّارَ لَیْسَ نَعُدُّهَا مَالًا.

📚 Masa'il of Ali ibn Ja'far, p. 142

Ali ibn Ja'far said: I asked Imam al-Kazim (peace be upon him) about giving Zakat to someone who has livestock (for riding or carrying loads). The Imam said: Yes! And also to someone who has a house and servant, because we do not consider a house as wealth!

5⃣عَنْ عَلِیِّ بْنِ إِبْرَاهِیمَ عَنْ أَبِیهِ عَنِ ابْنِ أَبِی عُمَیْرٍ عَنِ ابْنِ أُذَیْنَةَ عَنْ غَیْرِ وَاحِدٍ عَنْ أَبِی جَعْفَرٍ وَ أَبِی عَبْدِ اللَّهِ أَنَّهُمَا سُئِلَا عَنِ الرَّجُلِ لَهُ دَارٌ وَ خَادِمٌ أَوْ عَبْدٌ أَ یَقْبَلُ الزَّکَاةَ قَالا نَعَمْ إِنَّ الدَّارَ وَ الْخَادِمَ لَیْسَا بِمَالٍ.

📚 Al-Kafi Vol. 3, p. 561

It was asked of Imam al-Baqir and Imam al-Sadiq (peace be upon them) about a man who owns a house and a servant or slave, if he could accept Zakat in case of poverty. They said: Yes! Verily, a house and a servant are not considered wealth!

6⃣عَنِ ابْنِ أَبِی عُمَیْرٍ عَنْ رَجُلٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: مَنْ بَنَی فَوْقَ مَا یَسْکُنُهُ کُلِّفَ حَمْلَهُ یَوْمَ الْقِیَامَةِ.

📚 Al-Mahasin, p. 608

Imam al-Sadiq (peace be upon him) said: Whoever builds more buildings than he needs for residence will be burdened with carrying them on the Day of Judgment!

7⃣عَنْ حُمَیْدٍ الصَّیْرَفِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: کُلُّ بِنَاءٍ لَیْسَ بِکَفَافٍ فَهُوَ وَبَالٌ عَلَی صَاحِبِهِ یَوْمَ الْقِیَامَةِ.

📚 Al-Kafi Vol. 6, p. 531

Imam al-Sadiq (peace be upon him) said: Any building beyond what is necessary for sustenance will be a burden on its owner on the Day of Judgment!

✅ Based on various narrations, some of which are mentioned here, having shelter and a home is essential for a man. This clearly indicates that a house within the limits of necessity is considered part of living expenses (mu'unah).

On the other hand, as per the principles outlined in narrations 1⃣ and 2⃣, Khums is calculated after living expenses, and Khums is not applicable to living expenses.

Therefore, the cost spent on purchasing or building a house within the limits of necessity and sufficiency is exempt from Khums.

✅ However, a house that exceeds the needs and requirements of the individual and his family is not part of living expenses, and thus Khums is applicable to it.
