Question 1968: In proxy Hajj, is the choice between shaving the head (Halq) or trimming the hair (Taqsir) based on the conditions of the deputy (Na'ib) or the one on whose behalf Hajj is performed (Manub 'Anhu)?

✅ Answer: Consider the following narrations:

1⃣عَنْ أَبِی بَصِیرٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: عَلَی الصَّرُورَةِ أَنْ یَحْلِقَ رَأْسَهُ وَ لَا یُقَصِّرَ وَ إِنَّمَا التَّقْصِیرُ لِمَنْ حَجَّ حَجَّةَ الْإِسْلَامِ.

Imam Sadiq (peace be upon him) said: A person who has never performed Hajj before must shave his head. The option to only trim the hair is for those who have already performed their obligatory Hajj (Hajjat al-Islam).

2⃣عَنْ بَکْرِ بْنِ خَالِدٍ عَنْ أَبِی عَبْدِ اللَّه قَالَ: لَیْسَ لِلصَّرُورَةِ أَنْ یُقَصِّرَ وَ عَلَیْهِ أَنْ یَحْلِقَ.

Imam Sadiq (peace be upon him) said: A person performing Hajj for the first time cannot trim his hair; he must shave his head.

3⃣عَنْ عَلِیِّ بْنِ أَبِی حَمْزَةَ عَنْ أَحَدِهِمَا فِی حَدِیثٍ قَالَ: وَ تُقَصِّرُ الْمَرْأَةُ وَ یَحْلِقُ الرَّجُلُ وَ إِنْ شَاءَ قَصَّرَ إِنْ کَانَ قَدْ حَجَّ قَبْلَ ذَلِکَ.

Imam Baqir or Imam Sadiq (peace be upon them) said in a hadith: A woman (in Hajj and Umrah) trims her hair, while a man shaves his head. However, if he has previously performed Hajj, he may choose to trim instead.

4⃣عَنْ مُعَاوِیَةَ بْنِ عَمَّارٍ قَالَ: قُلْتُ لِأَبِی عَبْدِ اللَّهِ الرَّجُلُ یَحُجُّ عَنِ الْمَرْأَةِ وَ الْمَرْأَةُ تَحُجُّ عَنِ الرَّجُلِ قَالَ لَا بَأْسَ.

Mu'awiyah ibn Ammar said: I asked Imam Sadiq (peace be upon him): Can a man perform Hajj on behalf of a woman and a woman on behalf of a man? The Imam replied: There is no issue with that!

5⃣عَنْ حَکَمِ بْنِ حُکَیْمٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: یَحُجُّ الرَّجُلُ عَنِ الْمَرْأَةِ وَ الْمَرْأَةُ عَنِ الرَّجُلِ وَ الْمَرْأَةُ عَنِ الْمَرْأَةِ.

Imam Sadiq (peace be upon him) said: A man can perform Hajj on behalf of a woman, a woman on behalf of a man, and a woman on behalf of another woman.

6⃣عَنْ مُصَادِفٍ عَنْ أَبِی عَبْدِ اللَّهِ فِی الْمَرْأَةِ تَحُجُّ عَنِ الرَّجُلِ الصَّرُورَةِ فَقَالَ إِنْ کَانَتْ قَدْ حَجَّتْ وَ کَانَتْ مُسْلِمَةً فَقِیهَةً فَرُبَّ امْرَأَةٍ أَفْقَهُ مِنْ رَجُلٍ.

Imam Sadiq (peace be upon him) said regarding a woman performing Hajj on behalf of a man who has never performed Hajj: If the woman has already performed Hajj and is a knowledgeable Muslim, then there is no issue. Sometimes, a woman may be more knowledgeable than a man!

7⃣عَنْ أَبِی سَعْدٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: یَجِبُ الْحَلْقُ عَلَی ثَلَاثَةِ نَفَرٍ رَجُلٍ لَبَّدَ وَ رَجُلٍ حَجَّ بَدْءاً لَمْ یَحُجَّ قَبْلَهَا وَ رَجُلٍ عَقَصَ رَأْسَهُ.

Imam Sadiq (peace be upon him) said: Shaving the head (in Hajj) is obligatory for three types of people:

1. A man who has applied a sticky substance to his head, causing his hair to become matted like felt.

2. A man performing Hajj for the first time who has never performed it before.

3. A man who has braided or gathered his hair on top of his head.

✅ Based on the above narrations and others, under certain conditions, a man may act as a deputy for both men and women, and a woman may act as a deputy for both men and women in both obligatory and voluntary Hajj. However, there are specific conditions and restrictions mentioned elsewhere.

✅ On the other hand, as stated in narration 7⃣, a man is obligated to shave his head in some cases, while in others he may choose between shaving and trimming. A woman, in all types of Hajj and Umrah, is only required to trim her hair and is not obligated to shave her head.

It is important to note that although the deputy (Na'ib) performs Hajj on behalf of another person, making the Hajj valid for that person, the actual performer of Hajj is the deputy. Therefore, they perform Hajj according to their own duties and obligations, not according to the conditions of the person on whose behalf it is performed.

For example, if a woman acts as a deputy for a man, she must follow her own obligation, which is trimming (Taqsir), rather than following the obligation of the man, for whom shaving (Halq) may be mandatory in some cases and preferred in others.

✅ Thus, the deputy performs Hajj based on their own religious duties while offering the Hajj for the intended individual. The shaving or trimming is done according to the deputy’s obligation, not based on the obligation of the one on whose behalf Hajj is performed.
