Question 1882: Does a will have to be made at the end of one's life?

1⃣زيد الشحام قال: سَأَلْتُ أَبَاعَبْداللَّهِ عَنِ الْوَصِيَّةِ فَقَالَ هِيَ حَقٌّ عَلَى كُلِّ مُسْلِم

📚 Tahdheeb, Vol. 9, p. 172

Zayd Shiham said: 'I asked Imam Sadiq (peace be upon him) about the will; he said: 'It is a right upon every Muslim.'

2⃣قَالَ ما يَنْبَغِي لِامْرِئٍ مُسْلِمٍ أَنْ

يَبِيتَ لَيْلَةً إِلَّا و وَصِيَّتُهُ تَحْتَ رَأْسهِ

📚 Mughni'a, p. 101

The Messenger of Allah (peace be upon him) said: 'It is not appropriate for a Muslim to pass a single night without having his will beside his head!'

3⃣ Imam Sadiq (peace be upon him) said: 'The Messenger of Allah (peace be upon him) said: 'Anyone who does not make a good will at the time of his death has a deficiency in his nobility and intellect.' It was said: 'O Messenger of Allah, how can a dead person make a will?' He said: 'When death approaches and people gather around him, he should say:

اللَّهُمَّ فَاطِرَ السَّمَاوَاتِ و الْأَرْضِ عَالِمَ الْغَيْبِ و الشَّهَادَةِ الرَّحْمَنَ الرَّحِيمَ اللَّهُمَّ إِنِّي أَعْهَدُ إِلَيْكَ فِي دَارِ الدُّنْيَا.... تا آخر دعا....

Then he makes a will regarding the things he needs!'

📚 Al-Kafi, Vol. 7, p. 2

4⃣قال أبوعبداللَّهِ ما مِنْ ميِّتٍ تَحضرُهُ الْوَفَاةُ إِلَّا رَدَّ اللَّهُ عَلَيْه مِن بَصرِهِ و سَمْعِهِ و عَقْلِهِ لِلْوَصِيَّةِ آخِذٍ لِلْوصِيَّةِ أَوْ تَارِكٍ و هي الرَّاحَةُ الَّتِي يُقَالُ لها رَاحَةُ الْمَوْتِ فَهِيَ حَقٌّ عَلى كُلِّ مُسْلم

Imam Sadiq (peace be upon him) said: 'There is no dead person whose death approaches except that Allah restores part of their sight, hearing, and intellect to them to enable them to make a will or to leave it. This is the 'rest' that is referred to as 'Rest of Death' (راحة الموت), so making a will is a right for every Muslim!'

5⃣عن أَبِی عبداللَّه قال: مَنْ رَکِبَ رَاحِلَةً فَلْیُوصِ.

📚 Al-Kafi, Vol. 4, p. 542

Imam Sadiq (peace be upon him) said: 'Anyone who rides a mount (for travel) must make a will!'

6⃣ From Asbagh ibn Nabatah, he said: Amir al-Mu'minin Ali (peace be upon him) said: 'A time will come upon the people when immorality and vanity will be widespread, the sanctity of family relations will be violated, adultery will become public, the wealth of orphans will be deemed permissible, usury will be consumed, fraudulent weighing and measuring will occur, alcohol will be legalized in the name of Nabidh, bribes will be taken in the name of gifts, betrayal will be called trustworthiness, men will resemble women and women will resemble men, the prayer obligations will be trivialized, and Hajj will be performed for other than Allah... So beware at that time of being caught off guard by Allah, for behind these actions lies a swift death that will seize people rapidly, to the point where a person may wake up healthy in the morning and be buried by night, or be alive in the evening and dead by morning!

So when that time arrives, it becomes necessary to hasten in making a will before the calamity strikes, and to perform prayers at their earliest time out of fear that they may be missed in the last moments. Anyone among you who reaches that time should not sleep except in a state of purity (ablution), and if it is possible to remain in a state of purity at all times, let him do so, for he is in fear and does not know when the Messenger of Allah will come to take his soul...

📚 Fadail Ashhur al-Thalathah, p. 91

Amir al-Mu'minin (peace be upon him) said: 'A time will come upon the people when immorality and vanity will be widespread, the sanctity of family relations will be violated, adultery will become public, the wealth of orphans will be deemed permissible, usury will be consumed, fraudulent weighing and measuring will occur, alcohol will be legalized in the name of Nabidh, bribes will be taken in the name of gifts, betrayal will be called trustworthiness, men will resemble women and women will resemble men, the prayer obligations will be trivialized, and Hajj will be performed for other than Allah... so beware at that time of being caught off guard by Allah, for behind these actions lies a swift death that will seize people rapidly. A person may be alive in the morning and buried by night, or alive at night and dead by morning!'

So when that time arrives, it becomes necessary to hasten in making a will before the calamity strikes, and to perform prayers at their earliest time out of fear that they may be missed in the last moments!

Therefore, anyone who reaches that time should not sleep except in a state of purity (ablution), and if it is possible to remain in a state of purity at all times, let him do so, for he is in fear and does not know when the divine messenger will come to take his soul....!

✅ Based on the above and other narrations, although it is recommended to make a will at the time of death, it is also recommended that no person sleep for even a single night without having made a will.

It is also recommended to make a will before going on a journey.

Additionally, based on narration 6⃣, due to the increase in sudden deaths in these times, it is recommended to make a will in advance.

Therefore, making a will is not exclusive to the time of death, and as instructed by Amir al-Mu'minin (peace be upon him), it is obligatory to hasten in making a will, especially in these times!
