Question 1861: Can a mosque that is deteriorating be converted into a Hussainiya?

✅ Answer: Please refer to the following narrations:

1⃣عَنْ عُبَیْدِ اللَّهِ بْنِ عَلِیٍّ الْحَلَبِیِّ أَنَّهُ سَأَلَ أَبَا عَبْدِ اللَّهِ عَنْ مَسْجِدٍ یَکُونُ فِی الدَّارِ فَیَبْدُو لِأَهْلِهِ أَنْ یَتَوَسَّعُوا بِطَائِفَةٍ مِنْهُ أَوْ یُحَوِّلُوهُ عَنْ مَکَانِهِ فَقَالَ لَا بَأْسَ بِذَلِکَ

📚 Al-Faqih, Vol. 1, Page 236

Halabi asked Imam Sadiq (peace be upon him) about a mosque that is inside a house, and its residents are considering expanding part of it or relocating it; the Imam said: There is no problem with it!

2⃣عَنْ هَارُونَ بْنِ مُسْلِمٍ عَنْ مَسْعَدَةَ بْنِ صَدَقَةَ قَالَ: سَمِعْتُ جَعْفَرَ بْنَ مُحَمَّدٍ وَ سُئِلَ عَنِ الدَّارِ وَ الْبَیْتِ قَدْ یَکُونُ فِیهِ مَسْجِدٌ فَیَبْدُو لِأَصْحَابِهِ أَنْ یَتَّسِعُوا بِطَائِفَةٍ مِنْهُ وَ یَبْنُوا مَکَانَهُ وَ یَهْدِمُوا الْبِنْیَةَ قَالَ لَا بَأْسَ بِذَلِکَ.

Mas'adah said: I heard from Imam Sadiq (peace be upon him) regarding a house or a room that contains a mosque, and the owners wish to expand it, build something in its place, or demolish the building; the Imam said: There is no problem!

3⃣عَنْ عَلِیِّ بْنِ جَعْفَرٍ عَنْ أَخِیهِ مُوسَی بْنِ جَعْفَرٍ قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ کَانَ لَهُ مَسْجِدٌ فِی بَعْضِ بُیُوتِهِ أَوْ دَارِهِ هَلْ یَصْلُحُ أَنْ یُجْعَلَ کَنِیفاً قَالَ لَا بَأْسَ.

Ali ibn Ja'far said: I asked Imam Kazim (peace be upon him) about a person who has a mosque in one of his rooms or house and whether it is permissible to convert it into a bathroom? The Imam said: There is no problem!

4⃣عَنْ عَلِیِّ بْنِ مُحَمَّدٍ عَنْ سَهْلِ بْنِ زِیَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِی نَصْرٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ أَبِی الْجَارُودِ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَنِ الْمَسْجِدِ یَکُونُ فِی الْبَیْتِ فَیُرِیدُ أَهْلُ الْبَیْتِ أَنْ یَتَوَسَّعُوا بِطَائِفَةٍ مِنْهُ أَوْ یُحَوِّلُوهُ إِلَی غَیْرِ مَکَانِهِ قَالَ لَا بَأْسَ بِذَلِکَ الْحَدِیثَ.

📚 Al-Kafi, Vol. 3, Page 368

Abu Jarud said: I asked Imam Baqir (peace be upon him) about a mosque that is inside a house, and the residents of that house wish to expand part of it or move it to another place; the Imam said: There is no problem with it!

5⃣عَنْ مُحَمَّدِ بْنِ الْحَسَنِ الصَّفَّارِ أَنَّهُ کَتَبَ إِلَی أَبِی مُحَمَّدٍ الْحَسَنِ بْنِ عَلِیٍّ فِی الْوَقْفِ وَ مَا رُوِیَ فِیهِ عَنْ آبَائِهِ فَوَقَّعَ الْوُقُوفُ تَکُونُ عَلَی حَسَبِ مَا یُوقِفُهَا أَهْلُهَا إِنْ شَاءَ اللَّهُ.

📚 Al-Faqih, Vol. 4, Page 237

Muhammad ibn Hasan Saffar wrote to Imam Hasan al-Askari (peace be upon him) regarding endowments and what has been narrated from his ancestors about them; the Imam replied: Endowments are according to what their owners have designated them for. Insha'Allah

✅ In the above narrations and others, changing the use of a mosque is only permitted for a mosque that, like a mosque inside a house or personal room, has a private owner. However, for other mosques, such as endowed mosques, there is no permission to convert them into something else.
