Question 1814: Who is responsible for the maintenance of a pregnant woman whose husband divorces her? Also, where should the maintenance for her child be sourced from once the child is born?

✅ Answer: Refer to the following narrations:

1⃣عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِیرَةِ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِی عَبْدِ اللَّهِ فِی الرَّجُلِ یُطَلِّقُ امْرَأَتَهُ وَ هِیَ حُبْلَی قَالَ أَجَلُهَا أَنْ تَضَعَ حَمْلَهَا وَ عَلَیْهِ نَفَقَتُهَا حَتَّی تَضَعَ حَمْلَهَا.

📚 Al-Kafi, Vol. 6, p. 103

Imam Sadiq (peace be upon him) said regarding a man who divorces his pregnant wife: Her waiting period ('iddah) lasts until she gives birth, and until she gives birth, her maintenance (nafaqah) is the responsibility of that man.

2⃣عَنْ مُحَمَّدِ بْنِ یَحْیَی عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِیلَ عَنْ مُحَمَّدِ بْنِ الْفُضَیْلِ عَنْ أَبِی الصَّبَّاحِ الْکِنَانِیِّ عَنْ أَبِی عَبْدِ اللَّهِ إِذَا طَلَّقَ الرَّجُلُ الْمَرْأَةَ وَ هِیَ حُبْلَی أَنْفَقَ عَلَیْهَا حَتَّی تَضَعَ حَمْلَهَا وَ إِذَا وَضَعَتْهُ أَعْطَاهَا أَجْرَهَا وَ لَا یُضَارَّهَا إِلَّا أَنْ یَجِدَ مَنْ هُوَ أَرْخَصُ أَجْراً مِنْهَا فَإِنْ هِیَ رَضِیَتْ بِذَلِکَ الْأَجْرِ فَهِیَ أَحَقُّ بِابْنِهَا حَتَّی تَفْطِمَهُ.

Imam Sadiq (peace be upon him) said: When a man divorces his pregnant wife, he provides her maintenance until she gives birth. When the woman gives birth, he pays her for breastfeeding (ujrat) and does not cause her harm, unless the man finds another woman who charges less for breastfeeding. If the mother agrees to the same payment, she is more deserving of her child until weaning.

3⃣ عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِیرَةِ عَنْ حَرِیزٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: قُلْتُ لَهُ مَنِ الَّذِی أُجْبَرُ عَلَیْهِ وَ تَلْزَمُنِی نَفَقَتُهُ قَالَ الْوَالِدَانِ وَ الْوَلَدُ وَ الزَّوْجَةُ.

Hariz said: I asked Imam Sadiq (peace be upon him): Who am I obliged to support, and who is it mandatory for me to provide maintenance for? He replied: Your father, mother, children, and wife.

✅ Based on the above narrations and others, if a pregnant woman is divorced, her maintenance is the responsibility of her husband until she gives birth. The narrations do not differentiate between types of divorce (revocable or irrevocable) in this regard. The waiting period ('iddah) for a pregnant woman lasts until she gives birth, and thus, once she gives birth, her waiting period ends, and her maintenance is no longer the husband's responsibility.

✅ However, the maintenance of the child once born is the responsibility of the father, and the mother's divorce does not affect the child's right to maintenance. This obligation remains regardless of whether the child is in the mother's custody, as the child's right to maintenance is not conditional on the continuation of the parents' marriage.

✅ A divorced pregnant woman can charge a fee for breastfeeding the child, and the father must pay this fee unless he finds a wet nurse who charges less. If the mother agrees to the same fee, she is more deserving of breastfeeding her child until weaning.
