Question 1810: I have leased my land to someone for farming, but he has taken a usurious loan to cover the cultivation expenses. Is my share of this farming permissible?

✅ Answer: Pay attention to the following verses and narrations:

قال اللَّه تعالي : یَا أَیُّهَا الَّذِینَ آمَنُوا اتَّقُوا اللَّهَ وَذَرُوا مَا بَقِیَ مِنَ الرِّبَا إِن کُنتُم مُّؤْمِنِینَ(۲۷۸)

فَإِن لَّمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍ مِّنَ اللَّهِ وَرَسُولِهِ ۖ وَإِن تُبْتُمْ فَلَکُمْ رُءُوسُ أَمْوَالِکُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ(۲۷۹)

O you who have believed, fear Allah and give up what remains [due to you] of interest, if you should be believers.

And if you do not, then be informed of a war [against you] from Allah and His Messenger. But if you repent, you may have your principal - [thus] you do no wrong, nor are you wronged.

📖 Surah Al-Baqarah, Verses 278-279

1⃣عن أبی عفر قال قال أمیرالمؤمنین آکِلُ الرِّبَا و مُؤْکِلُهُ و کَاتِبُهُ و شَاهِداهُ فیهِ سَوَاءٌ

📚Al-Kafi, Vol. 5, Page 144

Imam Baqir (peace be upon him) said: 'Ali (peace be upon him) said: The consumer of usury, the giver of usury, the writer of the contract, and the two witnesses of it are all equal in the sin of usury.'

2⃣عن أبی بصیر عن أبی عبدالله قال: دِرْهَمٌ رِبًا أَشَدُّ مِنْ ثَلَاثِینَ زَنْیَةً کُلُّهَا بِذَاتِ مَحْرَمٍ مِثْلِ عَمَّةٍ و خَالَة

Imam Sadiq (peace be upon him) said: 'One Dirham of usury is worse than thirty adulteries, all of which are committed with relatives such as aunts and nieces.'

3⃣ عن سعد بن طریف عن أبی جعفر قال: أَخْبَثُ الْمَکَاسِبِ کَسْبُ الرِّبا

📚Al-Kafi, Vol. 5, Page 147

Imam Baqir (peace be upon him) said: 'The filthiest of earnings is the earnings of usury.'

4⃣عن حماد بن عمرو و أنس بن محمد عن أبیه عن جعفر بن محمد عن آبائه عن النبی فی وصیته لعلی قال: یا عَلِیُّ الرِّبَا سَبْعُونَ جُزْءاً فَأَیْسَرُهَا مِثْلُ أَنْ یَنْکِحَ الرَّجُلُ أُمَّهُ فی بَیْتِ اللَّهِ الحرام یا عَلِیُّ دِرْهَمٌ رِبًا أَعْظَمُ عِنْداللَّهِ مِنْ سَبْعِینَ زَنْیَةً کُلُّهَا بِذَاتِ مَحْرَمٍ فی بَیْتِ اللَّهِ الحرام

📚Al-Faqih, Vol. 4, Page 367

The Messenger of Allah (peace be upon him and his family) said in his will to Imam Ali (peace be upon him): 'O Ali! Usury has seventy parts, the least of which is like a man committing adultery with his mother inside the Kaaba!'

O Ali! One Dirham of usury, in the sight of Allah, is greater than seventy adulteries committed inside the Kaaba with relatives.'

5⃣عن الحلبي قال: قال أبوعبدالله في حديث.. لَوْ أَنَّ رَجُلًا وَرِثَ مِنْ أَبیهِ مالًا و قد عَرَفَ أَنَّ فِی ذلک الْمَالِ رِبًا و لَکِنْ قَدِ اخْتَلَطَ فِی التِّجَارَةِ بِغَیْرِهِ حَلَالٌ کَانَ حلالًا طَیِّباً فَلْیَأْکُلْهُ و إِنْ عَرَفَ مِنْهُ شَیْئاً أَنَّهُ رِبًا فَلْیَأْخُذْ رَأْسَ مَالِهِ و لْیَرُدَّ الرِّبَا

📚Al-Kafi, Vol. 5, Page 145

Imam Sadiq (peace be upon him) said in a narration: 'If a person inherits money from his father and knows that there is usury in this money, but it has been mixed with lawful money in trading with other lawful funds, it is halal and pure. So, he can consume it. But if he knows of any portion of the money that is usury, he should take the principal amount and return the usury!'

✅ Usury is one of the greatest major sins that has been severely prohibited and condemned in the Quran and narrations.

✅ Usury has seventy parts, and the giver of usury, the consumer of usury, the witness to the transaction or the usurious loan, and the one who writes it, all share in the sin. Based on this, engaging in usurious transactions or loans is a major sin for both parties involved, and writing and testifying to it are also major sins.

However, although engaging in usurious transactions or loans and giving or taking usury have been prohibited, the way to repent from it is for the usury consumer to abandon their portion of the usury, taking only the principal amount, and if they have already taken usury, to return the principal amount and the usury to its rightful owner.

But there is no evidence for the prohibition of the original loan and capital, and if someone leases their land for farming to someone and they cultivate it with a usurious loan, the owner's share of the farming is not prohibited. The prohibitions that have occurred are giving usury by the borrower and taking usury by the lender, and the borrower not returning the principal loan and the lender not returning the principal loan is a great sin.

So, if someone, may Allah forbid, has already taken a usurious loan and invested their capital or built a house or bought something with it, their income, the house they have built, and the goods they have purchased are not forbidden, but they and the usury taker have committed such a sin that it is considered equivalent to the sin of committing adultery with one's mother inside the Kaaba!

اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ و آلِ مُحَمَّدٍ و عَجِّلْ لِوَلِیِّکَ الْفَرَجَ و الْعَافِیَةَ و النَّصْر
