Question 1803: Can a girl whose virginity has been lost due to fornication, exercise, or illness, or who has been divorced before consummation, be married permanently without the permission of her father or paternal grandfather?

✅ Answer: Please pay attention to the following narrations:

1⃣عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْداللَّه أَنَّهُ قال فی الْمَرْأَةِ الثَّیِّبِ تَخْطُبُ إِلَی نَفْسِهَا قَالَ هِیَ أَمْلَکُ بِنَفْسِهَا تُوَلِّی أَمْرَهَا مَنْ شَاءَتْ إِذَا کَانَ کُفْواً بَعْدَ أَنْ تَکُونَ قَدْ نَکَحَتْ زَوْجاً قَبْلَهُ.

Imam Sadiq (peace be upon him) regarding a woman who proposes to someone said: She has the right to choose, she can entrust her matter to anyone she wishes, provided that he is eligible, after this woman has previously married someone else!

2⃣عن فضل بن عبدالملک عَنْ أَبِی عَبْداللَّه قَالَ: لَا تُسْتَأْمَرُ الْجَارِیَةُ الَّتِی بَیْنَ أَبَوَیْهَا إِذَا أَرَادَ أَبُوهَا أَنْ یُزَوِّجَهَا هُوَ أَنْظَرُ لَهَا و أَمَّا الثَّیِّبُ فَإِنَّهَا تُسْتَأْذَنُ و إِنْ کَانَتْ بَیْنَ أَبَوَیْهَا إِذَا أَرَادَا أَنْ یُزَوِّجَاهَا.

Imam Sadiq (peace be upon him) said: A girl who is with her father and mother, when her father wants to marry her off, her permission and consultation are not sought, as her father knows her better, but in the case of a non-virgin woman, when her parents want to marry her off, her permission is obtained, even though she is with her father and mother!

3⃣عن عبداللَّه بن الصلت قال: سَأَلْتُ أَبَااَلْحَسَنِ عليه السلام عَنِ اَلْجَارِيَةِ اَلصَّغِيرَةِ يُزَوِّجُهَا أَبُوهَا أَلَهَا أَمْرٌ إِذَا بَلَغَتْ قال لا وَ سَأَلْتُهُ عَنِ اَلْبِكْرِ إِذَا بَلَغَتْ مَبْلَغَ اَلنِّسَاءِ أَ لَهَا مَعَ أَبِيهَا أَمْرٌ فَقَالَ لَيْسَ لَهَا مَعَ أَبِيهَا أَمْرٌ مَا لَمْ تُثَيَّبْ

Abdullah ibn Salat said: I asked Imam Abu al-Hasan (peace be upon him) about a young girl whose father married her off, whether there is an order for her when she reaches puberty? He said: No.

And I asked him about a virgin girl, whether there is an order for her despite having a father? He said: No! Until she is no longer a virgin!

4⃣عن محمد بن القاسم بن الفضیلِ عن أَبِی الحسن فِی الرَّجُلِ یَتَزَوَّجُ الْمَرْأَةَ عَلَی أَنَّهَا بِکْرٌ فَیَجِدُهَا ثَیِّباً أَیَجُوزُ لَهُ أَنْ یُقِیمَ عَلَیْهَا قال فقال قَدْ تُفْتَقُ الْبِکْرُ مِنَ الْمَرْکَبِ و مِنَ النَّزْوَة

Muhammad ibn Qasim said: I asked Imam Abu al-Hasan (peace be upon him) about a man who marries a woman under the condition that she is a virgin but then finds out that she is not, is it permissible for him to keep her? He said: Sometimes virginity is lost due to horse riding and jumping!

5⃣عن محمد بن جزک قال : کَتَبْتُ إِلَی أَبی الْحَسَنِ أَسْأَلُهُ عن رَجُلٍ تَزَوَّجَ جَارِیَةً بِکْراً فَوَجَدَهَا ثَیِّباً هَلْ یَجِبُ لَهَا الصَّدَاقُ وَافِیاً أَمْ یَنْتَقِصُ قال یَنْتَقِصُ

Muhammad ibn Juzak said: I wrote a letter to Imam Abu al-Hasan (peace be upon him) asking him about a man who marries a virgin girl but then finds out that she is not, whether full dowry is required for her or if it is reduced? He said: It is reduced!

✅ In the Quran and narrations, a 'virgin' girl is distinguished from a 'non-virgin' one, and it is clear that loss of virginity can occur through lawful intercourse, as well as through sin and activities such as horse riding and jumping.

The terms 'virgin' and 'non-virgin' are relevant in matters and marriage conditions, and the issue of guardianship in marriage and others, each of which has its own specific narrations.

✅ According to narration 1⃣ and others, the ability for a woman to have control over her own affairs and be able to marry without a guardian is only applicable if her virginity is lost through lawful marriage, and none of the specific narrations recognize the loss of virginity through sin, jumping, and so on as a means of her becoming independent in marriage. Therefore, if virginity is lost through something other than lawful marriage, the guardianship of the girl remains with her father and paternal grandfather.

However, according to narration 5⃣ and others, if a man marries a girl under the condition of her virginity and then it is proven that she is not a virgin, the difference in dowry between a virgin and non-virgin is deducted from the woman's dowry.

✅ Based on the narrations and explanations above, a divorced girl without consummation still remains under the guardianship of her father or paternal grandfather, as her virginity has not been lost through lawful marriage and she is not a non-virgin.
