Question 1747: What is the duty of someone who finds a treasure in their personal property or land without a known owner?
✅ Answer: A "Kanz" or treasure refers to buried wealth that an individual or group discovers beneath the ground.
✅ If the owner or owners of the treasure are identifiable or can be found, their duty is clear. However, in the absence of a known owner, one must consider the following narrations for permission to take ownership:
1⃣عَنِ ابْنِ أَبِی عُمَیْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِیِّ فِی حَدِیثٍ قَالَ: سَأَلْتُ أَبَا عَبْدِاللَّهِ عَنِ الْکَنْزِ کَمْ فِیهِ قَالَ الْخُمُسُ

In a narration, Halabi reported: I asked Imam Sadiq (peace be upon him) about a treasure and how much is in it. The Imam said: One-fifth (Khums)!
2⃣عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِی نَصْرٍ عَنْ أَبِی الْحَسَنِ الرِّضَا قَالَ: سَأَلْتُهُ عَمَّا یَجِبُ فِیهِ الْخُمُسُ مِنَ الْکَنْزِ فَقَالَ مَا یَجِبُ الزَّکَاةُ فِی مِثْلِهِ فَفِیهِ الْخُمُسُ.

Ahmad ibn Muhammad reported: I asked Imam Ridha (peace be upon him) about the obligatory amount from a discovered treasure for which Khums is necessary. The Imam said: The amount for which Zakat is obligatory is also subject to Khums.
3⃣عَنْ حَمَّادِ بْنِ عَمْرٍو وَ أَنَسِ بْنِ مُحَمَّدٍ عَنْ أَبِیهِ جَمِیعاً عَنِ الصَّادِقِ عَنْ آبَائِهِ فِی وَصِیَّةِ النَّبِیِّ لِعَلِیٍّ قَالَ : یَا عَلِیُّ إِنَّ عَبْدَ الْمُطَّلِبِ سَنَّ فِی الْجَاهِلِیَّةِ خَمْسَ سُنَنٍ أَجْرَاهَا اللَّهُ لَهُ فِی الْإِسْلَامِ إِلَی أَنْ قَالَ وَ وَجَدَ کَنْزاً فَأَخْرَجَ مِنْهُ الْخُمُسَ وَ تَصَدَّقَ بِهِ فَأَنْزَلَ اللَّهُ وَ اعْلَمُوا أَنَّما غَنِمْتُمْ مِنْ شَیْءٍ فَأَنَّ لِلَّهِ خُمُسَهُ الْآیَةَ.

Imam Sadiq (peace be upon him) narrated from his ancestors that the Prophet Muhammad (peace be upon him and his family) advised Ali (peace be upon him): O Ali! Indeed, Abdul Muttalib established five traditions during the period of ignorance (pre-Islamic era), and Allah continued them in Islam. To the extent that he found a treasure, he took one-fifth of it out and gave it in charity. Therefore, Allah revealed the verse (Quran 8:41): 'And know that anything you obtain of war booty - then indeed, for Allah is one-fifth of it....'
4⃣عَنْ حَمَّادٍ عَنِ الْحَلَبِیِّ قَالَ: سُئِلَ أَبُو عَبْدِ اللَّهِ عَنِ الذَّهَبِ وَ الْفِضَّةِ مَا أَقَلُّ مَا تَکُونُ فِیهِ الزَّکَاةُ قَالَ مِائَتَا دِرْهَمٍ وَ عِدْلُهَا مِنَ الذَّهَبِ.

Halabi reported: I asked Imam Sadiq (peace be upon him) about the minimum amount of gold and silver that requires Zakat. The Imam said: 200 dirhams and the equivalent in gold!
✅ According to the above narrations and others, if someone finds a treasure on their personal property or land without a known owner, and it is valued at 200 dirhams of silver or more, they are obliged to pay one-fifth (Khums) to the rightful owners, and the remainder can be retained.
