Question 1732: Can one perform Umrah al-Mufrida during the months of Hajj and leave for their hometown or another city like Imam Hussein (peace be upon him) did on the day of Tarwiyah or before?

1⃣عن عبدالله بن سنان عن أبی عبدالله قال: لَا بَأْسَ بِالْعُمْرَةِ الْمُفْرَدَةِ فِی أَشْهُرِ الْحَجِّ ثُمَّ یَرْجِعُ إِلَی أَهْلِه
Al-Kafi, Vol. 4, p. 534
Imam Sadiq (peace be upon him) said: There is no problem with performing Umrah al-Mufrida during the months of Hajj, and then returning to one's family!
2⃣عَنْ مُعَاوِیَةَ بْنِ عَمَّار قال: قُلْتُ لِأَبِی عَبْداللَّه مِنْ أَیْنَ افْتَرَقَ الْمُتَمَتِّعُ وَ الْمُعْتَمِرُ فَقَالَ إِنَّ الْمُتَمَتِّعَ مُرْتَبِطٌ بِالْحَجِّ وَ الْمُعْتَمِرَ إِذَا فَرَغَ مِنْهَا ذَهَبَ حَیْثُ شَاءَ و قَدِ اعْتَمَرَ الْحُسَیْنُ فی ذِی الْحِجَّةِ ثُمَّ رَاحَ یَوْمَ التَّرْوِیَةِ إِلَی الْعِرَاقِ و النَّاسُ یَرُوحُونَ إِلَی مِنًی و لَا بَأْسَ بِالْعُمْرَةِ فی ذِی الْحِجَّةِ لِمَنْ لَا یُرِیدُ الْحَجَّ

Muawiyah ibn Ammar said: I asked Imam Sadiq (peace be upon him): How can one distinguish between a Mut'ammir (one who performs both Umrah and Hajj) and one who performs Umrah al-Mufrida? The Imam said: Indeed, the Mut'ammir is connected to Hajj, while the one who performs Umrah al-Mufrida can go wherever he wants after finishing it. And indeed, Imam Hussein (peace be upon him) performed Umrah during the month of Dhul Hijjah and then traveled to Iraq on the day of Tarwiyah, while people were going towards Mina. And for someone who does not intend to perform Hajj, there is no problem with performing Umrah in the month of Dhul Hijjah!
3⃣عن عمر بن یزید عن أَبِی عَبْداللَّه قَالَ: مَنْ دَخَلَ مَکَّةَ مُعْتَمِراً مُفْرِداً لِلْعُمْرَةِ فَقَضَی عُمْرَتَهُ ثُمَّ خَرَجَ کَانَ ذَلِکَ لَهُ وَ إِنْ أَقَامَ إِلَی أَنْ یُدْرِکَ الْحَجَّ کَانَتْ عُمْرَتُهُ مُتْعَةً وَ قَالَ لَیْسَ تَکُونُ مُتْعَةٌ إِلَّا فِی أَشْهُرِ الْحَجِّ

Imam Sadiq (peace be upon him) said: Whoever enters Mecca for Umrah al-Mufrida, performs his Umrah, and then leaves Mecca, this is permissible for him. And if he stays until he performs Hajj, his Umrah will become Tamattu'. And he said: Tamattu' is only in the months of Hajj!
4⃣عن إبراهیم بْنِ عُمَرَ الْیَمَانِیِّ عَنْ أَبِی عَبْداللَّه أَنَّهُ سُئِلَ عَنْ رَجُلٍ خَرَجَ فِی أَشْهُرِ الْحَجِّ مُعْتَمِراً ثُمَّ رَجَعَ إِلَی بِلَادِهِ قَالَ لَا بَأْسَ وَ إِنْ حَجَّ فِی عَامِهِ ذَلِکَ وَ أَفْرَدَ الْحَجَّ فَلَیْسَ عَلَیْهِ دَمٌ فَإِنَّ الْحُسَیْنَ بْنَ عَلِیٍّ خَرَجَ قَبْلَ التَّرْوِیَةِ بِیَوْمٍ إِلَی الْعِرَاقِ و قَدْ کَانَ دَخَلَ مُعْتَمِراً

Imam Sadiq (peace be upon him) was asked about a person who leaves for Umrah during the months of Hajj and then returns to his homeland. The Imam said: There is no problem, and if he performs Hajj al-Mufrid in the same year, no sacrifice is obligatory upon him. Indeed, Imam Hussein ibn Ali (peace be upon him) left for Iraq one day before Tarwiyah, and certainly, he had entered Mecca for Umrah (al-Mufrida)!
5⃣ روی سماعة بن مهران عن أبی عبدالله علیه السلام أنه قال من حج معتمرا فی شوال و من نیته أن یعتمر و یرجع إلی بلاده فلا بأس بذلک و إن هو أقام إلی الحج فهو متمتع لأن أشهر الحج شوال و ذو القعدة و ذو الحجة فمن اعتمر فیهن و أقام إلی الحج فهی متعة و من رجع إلی بلاده و لم یقم إلی الحج فهی عمرة...
Al-Fakihah, Vol. 2, p. 448
Imam Sadiq (peace be upon him) said: Whoever performs Umrah in the month of Shawwal and intends to perform Umrah and return to his city, there is no problem with that. And if he stays until the time of Hajj, he is considered a Mut'ammir, because the months of Hajj are Shawwal, Dhul Qa'dah, and Dhul Hijjah. So whoever performs Umrah in these months and stays until the time of Hajj, his Umrah is Tamattu', and whoever returns to his homeland and does not stay until Hajj, then that is Umrah...
✅ Based on the above narrations and others, one who enters Mecca with the intention of performing Umrah al-Mufrida during the months of Hajj, which are Shawwal, Dhul Qa'dah, and Dhul Hijjah, is permitted to leave for his city or wherever he wishes after completing Umrah, even if it is one day before Tarwiyah. However, one who performs Umrah al-Tamattu' during the months of Hajj should not leave Mecca until he has performed Hajj. And our master, Imam Hussein (peace be upon him), with the intention of performing Umrah al-Mufrida, entered Mecca due to the fear of being killed in the Haram and the invitation of the people of Iraq, and after completing Umrah al-Mufrida on the seventh or eighth day of Dhul Hijjah, he left for Iraq. And what is popular among the common people that the Imam changed his Hajj to Umrah is not correct, and from the beginning, our revered Imam intended Umrah al-Mufrida.
