Question 1725: Can a person donate all their possessions during their lifetime to one or more individuals?

1⃣عَنْ سَمَاعَةَ قَالَ: قُلْتُ لِأَبِی عَبْداللَّهِ الرَّجُلُ یَکُونُ لَهُ الْوَلَدُ أَ یَسَعُهُ أَنْ یَجْعَلَ مَالَهُ لِقَرَابَتِهِ قَالَ هُوَ مَالُهُ یَصْنَعُ مَا شَاءَ بِهِ إِلَی أَنْ یَأْتِیَهُ الْمَوْتُ.
Al-Kafi, Vol. 7, p. 8
Sama'ah said: I asked Imam Sadiq (peace be upon him): If a man has children, can he leave his wealth for his relatives? The Imam said: That wealth is his! He can do whatever he wants with it until his death!
2⃣عَنْ عَمَّارِ بْنِ مُوسَی أَنَّهُ سَمِعَ أَبَا عَبْدِاللَّه یَقُولُ صَاحِبُ الْمَالِ أَحَقُّ بِمَالِهِ مَا دَامَ فِیهِ شَیْءٌ مِنَ الرُّوحِ یَضَعُهُ حَیْثُ شَاءَ.

Ammar ibn Musa heard that Imam Sadiq (peace be upon him) said: The owner of wealth, as long as there is life in him, has the most right to his wealth. He can do with it whatever he wishes!
3⃣عَنْ مُرَازِمٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِی عَبْداللَّه فِی الرَّجُلِ یُعْطِی الشَّیْءَ مِنْ مَالِهِ فِی مَرَضِهِ فَقَالَ إِذَا أَبَانَ بِهِ فَهُوَ جَائِزٌ وَ إِنْ أَوْصَی بِهِ فَهُوَ مِنَ الثُّلُثِ.

Imam Sadiq (peace be upon him) said about a person who gives away some of his wealth during his illness: If he separates it, it is permissible, but if he bequeaths it, it will be counted from the one-third of his estate!
4⃣عَنْ مَسْعَدَةَ بْنِ صَدَقَةَ الرَّبَعِیِّ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِیهِ علیه السلام أَنَّ رَجُلًا مِنَ الْأَنْصَارِ تُوُفِّیَ وَ لَهُ صِبْیَةٌ صِغَارٌ وَ لَهُ سِتَّةٌ مِنَ الرَّقِیقِ فَأَعْتَقَهُمْ عِنْدَ مَوْتِهِ وَ لَیْسَ لَهُ مَالٌ غَیْرُهُمْ فَأُتِیَ النَّبِیُّ صلی الله علیه و آله و سلّم فَأُخْبِرَ فَقَالَ مَا صَنَعْتُمْ بِصَاحِبِکُمْ قَالُوا دَفَنَّاهُ قَالَ لَوْ عَلِمْتُ مَا دَفَنَّاهُ مَعَ أَهْلِ الْإِسْلَامِ تَرَکَ وُلْدَهُ یَتَکَفَّفُونَ النَّاسَ

Imam Sadiq (peace be upon him) narrated from his father that he said: A man from the Ansar passed away, leaving behind young children and six slaves whom he had freed at the time of his death, and he had no other property!
So they came to the Messenger of Allah (peace be upon him and his family) and told him this news. The Prophet said: What did you do with your companion? They said: We buried him! He said: If I had known, I would not have buried him with the Muslims! (Because) he left his children to beg from people!
5⃣عَنْ أَبِی بَصِیرٍ عَنْ أَبِی عَبْداللَّه قَالَ: قُلْتُ لَهُ الرَّجُلُ لَهُ الْوَلَدُ أَ یَسَعُهُ أَنْ یَجْعَلَ مَالَهُ لِقَرَابَتِهِ فَقَالَ هُوَ مَالُهُ یَصْنَعُ بِهِ مَا شَاءَ إِلَی أَنْ یَأْتِیَهُ الْمَوْتُ إِنَّ لِصَاحِبِ الْمَالِ أَنْ یَعْمَلَ بِمَالِهِ مَا شَاءَ مَا دَامَ حَیّاً إِنْ شَاءَ وَهَبَهُ وَ إِنْ شَاءَ تَصَدَّقَ بِهِ وَ إِنْ شَاءَ تَرَکَهُ إِلَی أَنْ یَأْتِیَهُ الْمَوْتُ فَإِنْ أَوْصَی بِهِ فَلَیْسَ لَهُ إِلَّا الثُّلُثُ إِلَّا أَنَّ الْفَضْلَ فِی أَنْ لَا یُضَیِّعَ مَنْ یَعُولُهُ وَ لَا یُضِرَّ بِوَرَثَتِهِ
وَ قَدْ رُوِیَ أَنَّ النَّبِیَّ قَالَ لِرَجُلٍ مِنَ الْأَنْصَارِ أَعْتَقَ مَمَالِیکَ لَهُ لَمْ یَکُنْ لَهُ غَیْرُهُمْ فَعَابَهُ النَّبِیُّ وَ قَالَ تَرَکَ صِبْیَةً صِغَاراً یَتَکَفَّفُونَ النَّاسَ

Abu Basir said: I asked Imam Sadiq (peace be upon him): If a man has children, is he allowed to leave his wealth for his relatives? The Imam said: That wealth is his, he can do whatever he wants with it until his death. Indeed, the owner of wealth can do whatever he wants with his wealth as long as he is alive, whether he wants to give it as a gift, or give it in charity, or leave it until his death, but if he bequeaths it, it will not be more than one-third for him, except that it is virtuous not to neglect his family and to harm his heirs!
And it has been narrated that the Messenger of Allah (peace be upon him and his family) blamed a man from the Ansar who freed his slaves when he had nothing else and said: He left young children to beg from people!
✅ Based on the above narrations and others, as long as a person is alive, he can separate all his wealth and donate it to others or give it in charity, but if this action causes harm or need to his family or heirs, it is blameworthy and reprehensible.
