Question 1660: Can a man who has a Sayyida wife give her Zakat al-Fitr to the Sayyids?

1⃣جعفر بن إبراهيم الهاشمي عن أَبِي عبداللَّه قال: قُلْتُ لَهُ أَ تَحِلُّ الصَّدَقَةُ لِبَنِي هَاشِمٍ فَقَالَ إِنَّمَا تِلْكَ الصَّدَقَةُ الْوَاجِبَةُ عَلَى النَّاسِ لَا تَحِلُّ لَنَا فَأَمَّا غَيْرُ ذَلِكَ فَلَيْسَ بِهِ بَأْسٌ

Ja'far bin Ibrahim says: I asked Imam Sadiq (a.s.): Is charity for the Banu Hashim permissible? The Imam replied: The obligatory charity is not permissible for us, but other charity is not an issue.
2⃣أَحمد بن مُحَمَّد عن بعض أَصْحَابِنَا رَفَعَ الْحَدِيثَ قال: فَالنِّصْفُ لَهُ خَاصَّةً وَ النِّصْفُ لِلْيَتَامَى وَ الْمَسَاكِينِ وَ أَبْنَاءِ السَّبِيلِ مِنْ آلِ مُحَمَّدٍ الَّذِينَ لَا تَحِلُّ لَهُمُ الصَّدَقَةُ وَ لَا الزَّكَاةُ عَوَّضَهُمُ اللَّهُ مَكَانَ ذَلِكَ بِالْخُمُسِ

One of the companions of Hadith was raised to Imam regarding the division of Khums and he said: Half of the Khums belongs to him (i.e., Imam), and the other half is for the orphans, the poor, and travelers from the family of Muhammad (peace be upon him and his family), for whom obligatory charity (Zakat) is not permissible, and in compensation for this (i.e., Zakat and obligatory charity), Allah has made Khums obligatory for them!
3⃣عن زيد الشَّحَّام عن أَبي عبداللَّه قال: سَأَلْتُهُ عَنِ الصَّدَقَةِ الَّتِي حُرِّمَتْ عَلَيْهِمْ فَقَالَ هِيَ الزَّكَاةُ الْمَفْرُوضَةُ وَ لَمْ تحَرَم عَلَيْنَا صَدَقَةُ بَعْضِنَا عَلَى بَعْضٍ

Zayd al-Shaham says: I asked Imam Sadiq (a.s.) about the charity that is prohibited for them; the Imam replied: The obligatory Zakat is prohibited, but charity among us (the Ahl al-Bayt) is not prohibited for one another.
4⃣عن زرارة عن أَبي عبداللَّه قال: قُلْتُ لَهُ صَدَقَاتُ بَنِي هَاشِمٍ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ فَقَالَ نَعَمْ صَدَقَةُ الرَّسُولِ تَحِلُّ لِجَمِيعِ النَّاسِ مِنْ بَنِي هَاشِمٍ وَ غَيْرِهِمْ وَ صَدَقَاتُ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ وَ لَا تَحِلُّ لَهُمْ صَدَقَاتُ إِنْسَانٍ غَرِيبٍ

Zurarah says: I asked Imam Sadiq (a.s.): Is charity among the Banu Hashim permissible for each other? He replied: The charity of the Messenger (peace be upon him) is permissible for all people, both from Banu Hashim and others, and charity among the Banu Hashim is also permissible for one another, but charity from a stranger (i.e., non-Sayyids) is not permissible for them!
5⃣عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ قَالَ: سَأَلْتُهُ عَمَّا يَجِبُ عَلَى الرَّجُلِ فِي أَهْلِهِ مِنْ صَدَقَةِ الْفِطْرَةِ قَالَ تَصَدَّقْ عَنْ جَمِيعِ مَنْ تَعُولُ الْحَدِيثَ.

Muhammad bin Muslim says: I asked Imam Baqir (a.s.) about what Zakat al-Fitr is obligatory for a man concerning his family; the Imam replied: Give charity on behalf of all those whose sustenance you provide!
6⃣قَالَ أَمِيرُ الْمُؤْمِنِينَ فِي خُطْبَةِ الْعِيدِ يَوْمَ الْفِطْرِ أَدُّوا فِطْرَتَكُمْ فَإِنَّهَا سُنَّةُ نَبِيِّكُمْ وَ فَرِيضَةٌ وَاجِبَةٌ مِنْ رَبِّكُمْ فَلْيُؤَدِّهَا كُلُّ امْرِئٍ مِنْكُمْ عَنْ عِيَالِهِ كُلِّهِمْ ذَكَرِهِمْ وَ أُنْثَاهُمْ وَ صَغِيرِهِمْ وَ كَبِيرِهِمْ وَ حُرِّهِمْ وَ مَمْلُوكِهِمْ عَنْ كُلِّ إِنْسَانٍ مِنْهُمْ صَاعاً مِنْ تَمْرٍ أَوْ صَاعاً مِنْ بُرٍّ أَوْ صَاعاً مِنْ شَعِيرٍ.

Amir al-Mu'minin (a.s.) said in his sermon on Eid al-Fitr: Pay your Fitr because it is the tradition of your Prophet and an obligatory duty from your Lord, so each of you should give one sa' of dates, one sa' of wheat, or one sa' of barley on behalf of every member of your family, male and female, young and old, free and slave, from each one of them!
✅ Considering the above narrations and others, although Sayyids can give their obligatory Zakat and charity to other Sayyids, in this specific case, it should be noted that even though this man is paying Zakat al-Fitr for his Sayyida wife, the one who is responsible for paying the Zakat al-Fitr is the husband, and since the husband is not from the Sayyids, he cannot give the Zakat al-Fitr that is obligatory upon him to the Sayyids. The key criterion is the person giving and receiving the Zakat.
