Question 250: Is the ruling for someone who forgot to pray the 'Isha prayer the same as for someone who deliberately did not pray it and goes to sleep intending to wake up and pray it, but does not wake up until morning or midnight, and are both required to fast?

✅Answer: Sleeping before performing the 'Isha prayer has been condemned in some narrations, including:

قَالَ أَبُو جَعْفَرٍ مَلَكٌ مُوَكَّلٌ يَقُولُ مَنْ بَاتَ عَنِ الْعِشَاءِ الْآخِرَةِ إِلَى نِصْفِ اللَّيْلِ فَلَا أَنَامَ اللَّهُ عَيْنَهُ

📚 Faqih, vol. 1, p. 221

Translation: Imam Baqir (peace and blessings of Allah be upon him) said: 'An angel has been assigned to say: 'Whoever sleeps from the 'Isha prayer until midnight, may Allah not let his eye sleep.''

✅ Two situations are imaginable for this matter. One is when a person **knowingly** sleeps without performing the 'Isha prayer, with the intention of waking up a little later to pray it. The condemnation of this act is clear in the above narration and a few others. And if he does not wake up until midnight and his prayer is missed, its ruling is clear in the following narrations:

عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِيرَةِ عَمَّنْ حَدَّثَهُ عَنْ أَبِي عَبْدِ اللَّهِ فِي رَجُلٍ نَامَ عَنِ الْعَتَمَةِ فَلَمْ يَقُمْ إِلَى‏ انْتِصَافِ اللَّيْلِ قَالَ يُصَلِّيهَا وَ يُصْبِحُ صَائِماً

Translation: Imam Sadiq (peace and blessings of Allah be upon him), regarding a person who sleeps through the 'Isha prayer and does not get up until midnight, said: 'He should perform his prayer and start his morning while fasting (meaning he must fast on that day).'

✅وَ رُوِيَ فِي مَنْ نَامَ عَنِ الْعِشَاءِ الْآخِرَةِ إِلَى نِصْفِ اللَّيْلِ أَنَّهُ يَقْضِي وَ يُصْبِحُ صَائِماً عُقُوبَةً وَ إِنَّمَا وَجَبَ ذَلِكَ عَلَيْهِ لِنَوْمِهِ عَنْهَا إِلَى نِصْفِ اللَّيْلِ

Translation: Shaykh Saduq said:

And it has been narrated that whoever sleeps from the 'Isha prayer until midnight must make it up and, as a punishment, must start his morning fasting on that day. And indeed, this is obligatory upon him because of his sleeping from the 'Isha prayer until midnight.

✅ In the two above narrations and some other narrations, the phrase 'nama 'anhu' is used, and its meaning is neglecting, being lazy, not paying attention, and knowingly sleeping through the 'Isha prayer. In this case, where the person knows he has not prayed the 'Isha prayer and goes to sleep before performing it and does not wake up before midnight, in addition to making up his prayer, he must, according to the narration in 📚 Al-Tahdhib, vol. 2, p. 276, ask for forgiveness. And according to the above narrations, due to the intentional sleeping through the 'Isha prayer, he must start his morning while fasting and fast on that day.

✅ However, in the case of **forgetfulness**, pay attention to the following two narrations:

عَنْ حَرِيزِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: قَالَ رَسُولُ اللَّهِ رُفِعَ عَنْ أُمَّتِي تِسْعَةُ أَشْيَاءَ الْخَطَأُ وَ النِّسْيَانُ...

Translation: Imam Sadiq (peace and blessings of Allah be upon him) said: 'The Messenger of Allah (peace and blessings of Allah be upon him) said: 'Nine things have been lifted from my nation: error, forgetfulness, and obliviousness...''

✅عن الصادق فی حدیث قال :فَإِنْ كُنْتَ قَدْ نَسِيتَ الْعِشَاءَ الْآخِرَةَ حَتَّى صَلَّيْتَ الْفَجْرَ فَصَلِّ الْعِشَاءَ الْآخِرَةَ وَ إِنْ كُنْتَ ذَكَرْتَهَا وَ أَنْتَ فِي الرَّكْعَةِ الْأُولَى أَوْ فِي الثَّانِيَةِ مِنَ الْغَدَاةِ فَانْوِهَا الْعِشَاءَ ثُمَّ قُمْ فَصَلِّ الْغَدَاةَ وَ أَذِّنْ وَ أَقِمْ...

📚 Al-Kafi, vol. 3, p. 291

Translation: Imam Sadiq (peace and blessings of Allah be upon him) said in a hadith:

If you forgot the 'Isha prayer until you had prayed the morning prayer, then pray the 'Isha prayer (after it). And if you remembered it when you were in the first or second rak'ah of the morning prayer, intend it as the 'Isha prayer and then get up and pray the morning prayer and say the adhan and iqamah...'

✅ It is clear that in the case of forgetfulness, which is one of the matters that Allah has lifted from the nation, only making up the prayer is obligatory upon the person. This is not considered intentional sleeping through the 'Isha prayer, which would require the person to fast on that day as a punishment.

✅ Some severe narrations condemning sleeping before performing the 'Isha prayer have been reported in Shi'a hadith collections, and it is necessary for us to have a strong commitment to performing the 'Isha prayer before sleeping. Insha'Allah.
