Question 1624: Is a marriage contract valid if it is performed with explicitly unlawful wealth?

1 عَنْ أَحْمَدَ بْنِ أَبِی عَبْدِ اللَّهِ عَنْ أَبِیهِ عَنْ أَبِی الْجَهْمِ عَنْ أَبِی خَدِیجَةَ قَالَ سَمِعْتُ أَبَا عَبْدِ اللَّهِ یَقُولُ لَا یَطِیبُ وَلَدُ الزِّنَا وَ لَا یَطِیبُ ثَمَنُهُ أَبَداً وَ الْمِمْرَازُ لَا یَطِیبُ إِلَی سَبْعَةِ آبَاءٍ وَ قِیلَ لَهُ وَ أَیُّ شَیْءٍ الْمِمْرَازُ فَقَالَ الرَّجُلُ یَکْتَسِبُ مَالًا مِنْ غَیْرِ حِلِّهِ فَیَتَزَوَّجُ بِهِ أَوْ یَتَسَرَّی بِهِ فَیُولَدُ لَهُ فَذَاکَ الْوَلَدُ هُوَ الْمِمْرَازُ.

Abu Khadija said: I heard Imam Sadiq (peace be upon him) say: The child of zina (illegitimate child) is not purified, and its price is never pure. And a 'mimraz' is not purified for seven generations! It was asked of the Imam: What is a mimraz?! He said: A man acquires wealth through unlawful means and marries with that wealth or buys a slave girl with it, and a child is born to him! That child is a mimraz!

2 عَنْ مُحَمَّدِ بْنِ یَحْیَی قَالَ: کَتَبَ مُحَمَّدُ بْنُ الْحَسَنِ إِلَی أَبِی مُحَمَّدٍ رَجُلٌ اشْتَرَی مِنْ رَجُلٍ ضَیْعَةً أَوْ خَادِماً بِمَالٍ أَخَذَهُ مِنْ قَطْعِ الطَّرِیقِ أَوْ مِنْ سَرِقَةٍ هَلْ یَحِلُّ لَهُ مَا یَدْخُلُ عَلَیْهِ مِنْ ثَمَرَةِ هَذِهِ الضَّیْعَةِ أَوْ یَحِلُّ لَهُ أَنْ یَطَأَ هَذَا الْفَرْجَ الَّذِی اشْتَرَاهُ مِنْ سَرِقَةٍ أَوْ مِنْ قَطْعِ طَرِیقٍ فَوَقَّعَ لَا خَیْرَ فِی شَیْءٍ أَصْلُهُ حَرَامٌ وَ لَا یَحِلُّ اسْتِعْمَالُهُ.

Muhammad ibn Yahya said: Muhammad ibn Hasan wrote to Imam Hasan Askari (peace be upon him): A man buys property or a slave girl with wealth obtained through robbery or theft. Is what comes from the proceeds of this property lawful for him? And is it lawful for him to have intercourse with the slave girl bought through robbery or theft? The Imam replied: There is no good in something whose origin is unlawful, and its use or benefit is not lawful!

3 عَنْ عَلِیِّ بْنِ عُقْبَةَ عَنِ الْحُسَیْنِ بْنِ مُوسَی الْحَنَّاطِ عَنْ أَبِیهِ عَنْ أَبِی جَعْفَرٍ قَالَ: إِنَّ الرَّجُلَ إِذَا أَصَابَ مَالًا مِنْ حَرَامٍ لَمْ یُقْبَلْ مِنْهُ حَجٌّ وَ لَا عُمْرَةٌ وَ لَا صِلَةُ رَحِمٍ حَتَّی أَنَّهُ یَفْسُدُ فِیهِ الْفَرْجُ.

Imam Baqir (peace be upon him) said: Indeed, when a man acquires unlawful wealth, no Hajj, Umrah, or maintaining family ties (with that wealth) is accepted from him, and he even corrupts the private parts (makes intercourse unlawful) with that wealth!

4 عَنْ عُبَیْدِ بْنِ زُرَارَةَ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: کَسْبُ الْحَرَامِ یَبِینُ فِی الذُّرِّیَّةِ.

Imam Sadiq (peace be upon him) said: Unlawful earnings manifest in the offspring!

✅ Based on the above narrations and others, if a permanent or temporary marriage or the purchase of a slave girl is performed with explicitly unlawful wealth, there is no good in it, and using that private part is not lawful. Wealth that is entirely and explicitly unlawful corrupts and renders the private part unlawful for the man. The child born from such a marriage is called 'mimraz' or, according to the version in Al-Tahdhib, 'mimriz,' which remains impure for seven generations. In general, unlawful earnings manifest in the offspring.

5 وَ رُوِیَ عَنْ أَبِی الْحَسَنِ مُوسَی بْنِ جَعْفَرٍ أَنَّهُ قَالَ: إِنَّا أَهْلُ بَیْتٍ حَجُّ صَرُورَتِنَا وَ مُهُورُ نِسَائِنَا وَ أَکْفَانُنَا مِنْ طَهُورِ أَمْوَالِنَا.

It is narrated from Imam Kazim (peace be upon him) that he said: We, the Ahl al-Bayt, perform our first Hajj, pay the dowry for our women, and provide our shrouds with our own pure and lawful wealth!
