Answer

✅ Answer: Pay attention to the following narrations:

📚 Al-Kafi, Vol. 4, p. 59

Ja’far ibn Ibrahim said: I said to Imam Sadiq (peace be upon him): Is charity permissible for the Bani Hashim? The Imam said: The obligatory charity is not permissible for us, but other than that, there is no issue.

📚 Al-Tahdhib, Vol. 4, p. 126

One of the companions narrated a hadith to the Imam regarding the division of khums. He said: Half of the khums belongs to him (i.e., the Imam, peace be upon him), and the other half is for the orphans, the needy, and the wayfarers from the family of Muhammad (peace be upon him and his family, i.e., the Sayyids), for whom obligatory charity and zakat are not permissible. Allah has designated khums for them in place of (obligatory zakat and charity)!

📚 Al-Tahdhib, Vol. 4, p. 59

Zayd Shuhham said: I asked Imam Sadiq (peace be upon him) about the charity that is forbidden for them. The Imam said: That is the obligatory zakat, and charity from some of us to others is not forbidden!

📚 Al-Tahdhib, Vol. 4, p. 59

Imam Sadiq (peace be upon him) said in a hadith: Indeed, if justice were established, no Hashimi or Muttalibi would need charity. Allah has provided for them sufficiently in His Book (through khums)! Then the Imam said: Indeed, when a person finds nothing, carrion and charity become permissible for them, but (obligatory zakat) is not permissible for any of the Sayyids unless they find nothing and are among those for whom carrion is permissible!

📚 Al-Khisal, p. 62, Hadith 88

Imam Sadiq (peace be upon him) narrated from his father that he said: Obligatory charity is not permissible for the Bani Hashim (Sayyids) except in two cases: if they are thirsty and receive water (from charity) and drink it, and charity given by some of them to others (charity from Sayyids to Sayyids).

📚 Al-Tahdhib, Vol. 3, p. 177

Imam Sadiq (peace be upon him) said in a hadith: There is nothing that Allah has forbidden except that He has made it permissible for someone in dire necessity!

✅ Based on the above narrations and others, Allah has designated khums in the Quran to suffice for the Sayyids, and paying or receiving obligatory zakat and charity by Sayyids is forbidden unless the giver of the obligatory zakat or charity is a Sayyid themselves.

✅ However, since justice is not currently established, and the obligatory rights of the Sayyids are withheld or given to non-Sayyids, the needs of the Sayyids are not met, and they sometimes face urgent necessity. According to the above narrations, if they are in a state of dire necessity where they find nothing, giving them obligatory zakat and their receiving of such charity becomes permissible. Thus, in cases of necessity, obligatory zakat can be paid to them.

✅ To alleviate this hardship for the Sayyids, frequently say:
