Question 1587: Can a woman be an agent for the divorce of someone other than herself?

هَلْ تَجُوزُ وَکَالَةُ الْمَرْأَةِ فِی طَلَاقِ غَیْرِهَا؟
✅ Answer: Please pay attention to the following narrations:
1 عَنْ أَبِی هِلَالٍ الرَّازِیِّ قَالَ: قُلْتُ لِأَبِی عَبْدِ اللَّهِ رَجُلٌ وَکَّلَ رَجُلًا بِطَلَاقِ امْرَأَتِهِ إِذَا حَاضَتْ وَ طَهُرَتْ وَ خَرَجَ الرَّجُلُ فَبَدَا لَهُ فَأَشْهَدَ أَنَّهُ قَدْ أَبْطَلَ مَا کَانَ أَمَرَهُ بِهِ وَ أَنَّهُ قَدْ بَدَا لَهُ فِی ذَلِکَ قَالَ فَلْیُعْلِمْ أَهْلَهُ وَ لْیُعْلِمِ الْوَکِیلَ.

Abu Hilal al-Razi said: I said to Imam Sadiq (peace be upon him): A man authorizes someone to divorce his wife when she is menstruating and has become pure from menstruation, and he himself goes on a journey. Then something comes to his mind (and he changes his mind) and he takes witnesses that he has invalidated what he had commanded and that a change has occurred to him in this matter and his opinion has changed. The Imam said: Then he must inform his wife and also inform and notify the agent!
2 عَنْ سَعِیدٍ الْأَعْرَجِ عَنْ أَبِی عَبْدِ اللَّهِ فِی رَجُلٍ یَجْعَلُ أَمْرَ امْرَأَتِهِ إِلَی رَجُلٍ فَقَالَ اشْهَدُوا أَنِّی قَدْ جَعَلْتُ أَمْرَ فُلَانَةَ إِلَی فُلَانٍ فَیُطَلِّقُهَا أَ یَجُوزُ ذَلِکَ لِلرَّجُلِ قَالَ نَعَمْ.

Sa'id al-A'raj asked Imam Sadiq (peace be upon him) about a man who places the matter (of divorce) of his wife in the hands of a person and says: 'Be witnesses that I have placed the matter of this woman in the hands of this person,' and that person divorces that woman. Is this matter permissible for the man? The Imam said: Yes!
3 مُحَمَّدُ بْنُ أَحْمَدَ بْنِ يَحْيَى عَنْ مُحَمَّدِ بْنِ عِيسَى اَلْيَقْطِينِيِّ قَالَ: بَعَثَ إِلَيَّ أَبُو اَلْحَسَنِ اَلرِّضَا عَلَيْهِ اَلسَّلاَمُ رِزَمَ ثِيَابٍ وَ غِلْمَاناً... إلی أَنْ قَالَ وَ أَمَرَ بِدَفْعِ ثَلاَثِمِائَةِ دِينَارٍ إِلَى رُحْمَ اِمْرَأَةٍ كَانَتْ لَهُ وَ أَمَرَنِي أَنْ أُطَلِّقَهَا عَنْهُ وَ أُمَتِّعَهَا بِهَذَا اَلْمَالِ وَ أَمَرَنِي أَنْ أُشْهِدَ عَلَى طَلاَقِهَا صَفْوَانَ بْنَ يَحْيَى وَ آخَرَ نَسِيَ مُحَمَّدُ بْنُ عِيسَى إِسْمَهُ

Muhammad ibn Isa al-Yaqtini said: Imam Abu al-Hasan al-Rida (peace be upon him) sent a package of clothes and servants for me... until he said: The Imam ordered me to give three hundred dinars to one of his wives whose name was Ruhm, and he ordered me to divorce that woman on his behalf (as an agent) and to give that woman these three hundred dinars as a gift and benefit, and he commanded me to take Safwan ibn Yahya and another person whose name Muhammad ibn Isa had forgotten as witnesses to her divorce!
4 عَنِ السَّکُونِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ قَالَ أَمِیرُ الْمُؤْمِنِینَ فِی رَجُلٍ جَعَلَ طَلَاقَ امْرَأَتِهِ بِیَدِ رَجُلَیْنِ فَطَلَّقَ أَحَدُهُمَا وَ أَبَی الْآخَرُ فَأَبَی أَمِیرُ الْمُؤْمِنِینَ أَنْ یُجِیزَ ذَلِکَ حَتَّی یَجْتَمِعَا جَمِیعاً عَلَی طَلَاقٍ.

Imam Sadiq (peace be upon him) said: A man placed the divorce of his wife in the hands of two men, and one of them divorced her, but the other refused to divorce her. So the Commander of the Faithful refused to confirm this divorce until both of them agreed to the divorce!
✅ Based on the above narrations and others, it is permissible for a man to appoint another person as an agent to divorce his wife, and this matter is called agency in divorce.
After the permissibility of agency in divorce is made clear from the above narrations and others, it is necessary to pay attention to this point that no limitation has been narrated in the narrations regarding the gender and whether the agent is a man or a woman, and the man's being a male agent has not been made a condition for the validity of the divorce, and no prohibition has been narrated regarding a woman being an agent for the divorce of someone other than herself. Therefore, a woman can also be an agent on behalf of a man to divorce his wife.
