1 عن عبداللَّهِ بْنِ سِنَانٍ عَنْ أَبِی عَبْداللَّه قَالَ: سَأَلَهُ أَبِی و أَنَا حَاضِرٌ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَأُدْخِلَتْ عَلَیْهِ فَلَمْ یَمَسَّهَا وَ لَمْ یَصِلْ إِلَیْهَا حَتَّی طَلَّقَهَا هَلْ عَلَیْهَا عِدَّةٌ مِنْهُ فَقَالَ إِنَّمَا الْعِدَّةُ مِنَ الْمَاءِ قِیلَ لَهُ فَإِنْ کَانَ وَاقَعَهَا فِی الْفَرْجِ و لَمْ یُنْزِلْ فَقَالَ إِذَا أَدْخَلَهُ وَجَبَ الْغُسْلُ وَ الْمَهْرُ وَ الْعِدَّة

Abdullah ibn Sinan said: My father, in my presence, asked Imam Sadiq (peace be upon him) about a man who marries a woman and she is brought to him but he does not touch her or go to her until he divorces her. Is the waiting period (iddah) obligatory for the woman because of this man? The Imam said: Indeed, the waiting period is from the water! It was said to the Imam: What if he has intercourse with her in the vagina but does not ejaculate? He said: If he penetrates her, ghusl, (full) dowry, and the waiting period are obligatory upon her!

2 عن دَاوُدَ بْنِ سِرْحَانَ عَنْ أَبِی عبداللَّه قال: إِذَا أَوْلَجَهُ فَقَدْ وَجَبَ الْغُسْلُ و الْجَلْدُ و الرَّجْمُ وَ وَجَبَ الْمَهْر

Imam Sadiq (peace be upon him) said: If a man penetrates her (inserts his penis into her vagina), ghusl and (in case of fornication) flogging and stoning are obligatory, and the dowry is also obligatory!

3 عن محمد بن إسماعیل یعنی ابن بزیع قال: سَأَلْتُ الرِّضَا عَنِ الرَّجُلِ یُجَامِعُ الْمَرْأَةَ قَرِیباً مِنَ الْفَرْجِ فَلَا یُنْزِلَانِ مَتَی یَجِبُ الْغُسْلُ فَقَالَ إِذَا الْتَقَی الْخِتَانَانِ فَقَدْ وَجَبَ الْغُسْلُ فَقُلْتُ الْتِقَاءُ الْخِتَانَیْنِ هُوَ غَیْبُوبَةُ الْحَشَفَةِ قَالَ نَعَمْ

Ibn Bazi' said: I asked Imam Reza (peace be upon him) about a man who has intercourse with a woman near the vagina and neither of them ejaculates, when does ghusl become obligatory? The Imam said: If the two circumcised parts meet, ghusl has certainly become obligatory! I said: Is the meeting of the two circumcised parts the same as the hiding of the head of the penis (in the vagina)? He said: Yes.

Imam Sadiq (peace be upon him) said about a man who penetrates a woman: If the two circumcised parts meet, the (full) dowry and the waiting period are obligatory!

5 عن شعيب الحداد قال أَبوعبداللَّه فی حدیث :هُوَ الْفَرْجُ و أَمْرُ الْفَرْجِ شَدِيدٌ و مِنْهُ يَكُونُ الْوَلَدُ و نَحْنُ نَحْتَاطُ

Imam Sadiq (peace be upon him) said in a hadith: It is the vagina, and the matter of the vagina is serious! And the child is also from this matter!

And we are cautious...

6 الْعَلَاء بن سيابة عن أَبی عَبْداللَّه فی حدیث قال إِنَّ النِّكَاحَ أَحْرَى و أَحْرَى أَنْ يُحْتَاطَ فِيهِ و هُوَ فَرْجٌ وَ مِنْهُ يَكُونُ الْوَلَد

Ala' ibn Siyabah said: Imam Sadiq (peace be upon him) said in a hadith: Indeed, marriage is the most deserving and most deserving thing to be cautious about!!

And it is a matter of the vagina, and a child is also from it!!

✅ Based on the above narrations and others, it is clear that matters such as the waiting period, ghusl, and so on become obligatory upon penetration and intromission, even if neither party ejaculates.

The limit of penetration is also specified in the narrations as the meeting and contact of the two circumcised parts, which is more clearly defined as the hiding of the head of the penis in the vagina, even if no ejaculation of semen or anything else occurs.

Penetration with a condom includes the meaning of penetration, intromission, and the hiding of the head of the penis in the vagina, and the fact that some brave people in giving fatwas, inspired by the people of Saturday! have considered penetration with a condom to nullify the waiting period based on the phrase 'Indeed, the waiting period is from the water,' have severely nullified the explanatory and clear narrations and other reasons for the necessity of the waiting period and have issued this dangerous opinion with a speculative and Ijtihadi (independent reasoning) interpretation of one of the obscure reasons for the necessity of the waiting period.

✅ If we add the narrations that emphasize caution in the matter of marriage to these points, the boldness of the fatwa and the baseless and opinion-based nature of the fatwa that the waiting period is nullified in case of intercourse with a condom becomes even clearer.

✅ Therefore, even with a condom, as soon as the head of the penis is hidden in the vagina, the waiting period becomes necessary, and the presence of a condom with the penis does not change the divine rulings!
