Answer
✅ Answer: First, it is necessary to mention that marriage loans are given by banks to those who have recently gotten married, and a 4% profit is stipulated as a commission!
✅ One of the recommended actions in the verses and narrations is giving an interest-free loan (qard al-hasana) and loans to people in need: Imam Sadiq (peace be upon him) said: There is no believer who lends to a believer seeking the pleasure and reward of Allah, except that Allah calculates his reward as a charity until his wealth is returned to him. 📚 Faqih Vol. 2, p. 32
And the Messenger of Allah (peace be upon him and his family) said in the hadith of prohibitions: Anyone whose Muslim brother needs a loan while he is able to give him a loan but does not lend to him, Allah forbids the scent of Paradise for him.
📚 Man La Yahduruhu al-Faqih Vol. 4, p. 9
✅ Of course, this important act of lending has conditions, and exceeding them causes it to become the major sin of usury (riba). Pay attention to the following narrations:
📚 Tahdhib Vol. 6, p. 203
Translation: Imam Baqir (peace be upon him) said: A person who lends money to another person should not stipulate anything more than its like, but if the other person returns more (without a condition), he should accept it (and there is no problem). And none of you should stipulate even riding on a mount or borrowing an item in return for lending his money to another person.
✅ From the above narration, it is clear that when lending to others, no condition for an amount greater than the amount paid should be made with the borrower, and you cannot even stipulate to him: 'I will lend you this money on the condition that you give me your mount to ride or lend me such-and-such an item.' Rather, you can only stipulate to him that he return the exact amount paid by a certain date, and this is the qard al-hasana (interest-free loan) that is praised in the Qur'an and narrations.
الصادق فی حدیث قَالَ جَاءَ الرِّبَا مِنْ قِبَلِ الشُّرُوطِ إِنَّمَا یُفْسِدُهُ الشُّرُوطُ
📚 Kafi Vol. 5, p. 244
Translation: Imam Sadiq (peace be upon him) said in a hadith: Usury is created through conditions; indeed, it is only conditions that cause it to be corrupt.
📚 Masa'il Ali ibn Ja'far p. 125
Translation: Ali ibn Ja'far said: I asked Musa ibn Ja'far (peace be upon him): A man gives another person one hundred dirhams to work with it on the condition that he pays him five dirhams or less or more, is this permissible? The Imam said: No, this is pure usury.
✅ From the two above narrations, it is also clear that a condition in a loan causes it to be corrupt and to become usury.
Today, when giving a marriage loan or other loans, they add 4% or more to the loan amount with a prior condition and call it a 'commission'! Of course, this change of name does not change its ruling of being usury, and there is no religious justification for it in the narrations. And because of the gravity of the sin of usury, it is proper for the pious to completely avoid these loans.
Imam Sadiq (peace be upon him) said in a hadith: 'As for the forbidden usury, it is when a person lends a loan and stipulates that he return more than what he took, so this is forbidden.'
✅ Imam Sadiq (peace be upon him) said in a hadith: A single dirham of usury is greater and more serious in the sight of Allah than seventy acts of adultery with one's mahrams at the Ka'ba.
📚 Al-Burhan Vol. 1, p. 557
✅ The Commander of the Faithful (peace be upon him) said: The Messenger of Allah (peace be upon him and his family) cursed five people regarding usury: the one who consumes usury, the one who receives it, its two witnesses, and its scribe.
📚 Wasa'il al-Shi'a Vol. 18, p. 127
✅ Ali (peace be upon him) said: When Allah intends the destruction of a city, usury becomes manifest among them.
📚 Majma' al-Bayan Vol. 1, p. 390
✅ The existence of a 4% extra condition in the marriage loan and others, according to the above narrations, causes it to be corrupt and to become a usurious loan, whether they call it 'facilities' or 'commission' or anything else.
✅ Insha'Allah, in addition to ourselves refraining from conditional loans, we should also, based on our duty, prevent others from this act.
✅ According to the narrations of the Ahl al-Bayt (peace be upon them), usury has seventy parts, and this is just one of them. To be saved from the different types of usury, it is necessary to learn the jurisprudence of the Ahl al-Bayt (peace be upon them) and act upon it.
