Answer
✅ Answer: Pay close attention to the following narration:
📚 Kafi Vol. 6, p. 82
✅ Translation: Imam Baqir (peace be upon him) said: When a woman is divorced while she is pregnant, her waiting period is until she gives birth to her child, even if she gives birth at that very hour.
✅ Many narrations, like the one above, show that the waiting period for a divorced pregnant woman is from the time of the divorce until she gives birth to her child, which can be less than a day or close to 9 months, and during this period, she does not have the right to marry anyone else, whether in a permanent or temporary marriage (mut'ah).
✅ Also, pay close attention to the following narration:
📚 Kafi Vol. 6, p. 82
Translation: Abd al-Rahman said: I asked Imam Kazim (peace be upon him) about a pregnant woman whose husband divorces her and her baby is aborted, whether completely or incompletely. (How is her waiting period?) The Imam said: Anything that is clear and evident to be a fetus, whether it is complete and full or not yet complete and full (and is aborted), indeed the waiting period of that woman has ended (and she can remarry), even if what was aborted was a 'muddghah'.
✅ 'Muddghah' means 'a piece of red flesh in which there are network-like blue veins,' which is the state the embryo reaches after being a 'alaqah' (clot) in the womb.
✅ According to the above narration, a pregnant woman who has been divorced, even if her child is aborted incomplete or in any other way, her waiting period ends, and she can remarry after her child is aborted or is born alive, but she has no right to marry before that.
✅ Also, reflect on the fourth verse of Surah Al-Talaq regarding this matter.
