1 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ قَالَ: قَالَ جَابِرُ بْنُ عَبْدِ اللَّهِ عَنْ رَسُولِ اللَّهِ إِنَّهُمْ غَزَوْا مَعَهُ فَأَحَلَّ لَهُمُ الْمُتْعَةَ وَ لَمْ يُحَرِّمْهَا وَ كَانَ عَلِيٌّ يَقُولُ لَوْ لَا مَا سَبَقَنِي بِهِ ابْنُ الْخَطَّابِ- يَعْنِي عُمَرَ مَا زَنَى إِلَّا شَقِيٌّ وَ كَانَ ابْنُ عَبَّاسٍ يَقْرَأُ فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ إِلَى أَجَلٍ مُسَمًّى فَآتُوهُنَّ أُجُورَهُنَّ فَرِيضَةً [۵] وَ هَؤُلَاءِ يَكْفُرُونَ بِهَا وَ رَسُولُ اللَّهِ أَحَلَّهَا وَ لَمْ يُحَرِّمْهَا.

📚 Tafsir al-Ayyashi, Vol. 1, p. 233

Imam Baqir (peace be upon him) said: Jabir ibn Abdullah al-Ansari narrated that they went on a military expedition with the Messenger of Allah (peace be upon him and his family), so the Prophet made mut'ah lawful for them and did not make it unlawful.

And Imam Ali (peace be upon him) used to say: If it were not for what the son of Khattab, meaning Umar (may what is upon him be upon him), preceded me on, no one would have committed adultery except a wretched person!

And Ibn Abbas used to recite verse 24 of Surah An-Nisa (for temporary marriage) where Allah, the Exalted, says: 'So for what you have enjoyed from them in mut'ah, give them their rewards as an obligation,' while these (i.e., the 'Umaris) are disbelievers in it, and the Messenger of Allah (peace be upon him and his family) made it lawful and did not make it unlawful!

2 قَالَ وَ قَالَ الرِّضَا الْمُتْعَةُ لَا تَحِلُّ إِلَّا لِمَنْ عَرَفَهَا وَ هِيَ حَرَامٌ عَلَى مَنْ جَهِلَهَا.

Imam Reza (peace be upon him) said: Mut'ah is not lawful except for one who knows it (i.e., accepts and believes in it) and it is unlawful for one who does not know it (i.e., does not accept and believe in it)!

3 عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ الْبَرْقِیِّ عَنْ دَاوُدَ بْنِ إِسْحَاقَ الْحَذَّاءِ عَنْ مُحَمَّدِ بْنِ الْفَیْضِ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنِ الْمُتْعَةِ فَقَالَ نَعَمْ إِذَا کَانَتْ عَارِفَةً قُلْنَا جُعِلْنَا فِدَاکَ فَإِنْ لَمْ تَکُنْ عَارِفَةً قَالَ فَاعْرِضْ عَلَیْهَا وَ قُلْ لَهَا فَإِنْ قَبِلَتْ فَتَزَوَّجْهَا وَ إِنْ أَبَتْ أَنْ تَرْضَی بِقَوْلِکَ فَدَعْهَا

Muhammad ibn Fayd said: I asked Imam Sadiq (peace be upon him) about mut'ah; the Imam said: Yes! Provided that the woman is a person of knowledge and understanding.

We said: May Allah make us your ransom, what if the woman is not a person of knowledge and understanding?! He said: Offer it to her and tell her, so if she accepts, marry her, and if she refuses to be satisfied with your belief and your words, leave her!

4 عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنِ الرِّضَا فِي حَدِيثٍ أَنَّهُ سُئِلَ عَنِ الْمُتْعَةِ فَقَالَ لَا يَنْبَغِي لَكَ أَنْ تَتَزَوَّجَ إِلَّا بِمُؤْمِنَةٍ أَوْ مُسْلِمَةٍ.

Imam Reza (peace be upon him) was asked about mut'ah; the Imam said: It is not proper for you to marry except a believing woman or a Muslim woman!

✅ Based on the above narrations and others, temporary marriage or mut'ah has been made lawful in the Quran and the tradition of the Messenger of Allah (peace be upon him and his family) and the statements of the infallible Imams (peace be upon them), but Umar (may what is upon him be upon him) made it unlawful after acknowledging its lawfulness during the time of the Messenger of Allah (peace be upon him and his family), and he established punishment for the one who performs it. Therefore, the followers and adherents of this usurper consider it unlawful and do not believe in it, and for this reason, according to narration 2, temporary marriage is unlawful for them. And if someone wants to enter into a temporary marriage with such a woman, according to narration 3, he must first offer her the belief in the lawfulness of mut'ah or the true belief of Shi'ism, and if she truly believes in the divine lawfulness of mut'ah or the truthfulness of Shi'ism and accepts it, he can enter into a temporary marriage with her, and if not, he should leave her.
