Answer

✅Answer: Please pay attention to the following narrations:

📚 Al-Kafi, vol. 5, p. 455

Imam Sadiq (prayers of God be upon him) said: 'There is no mut'ah except with two matters: a specified and defined term and a specified and defined payment!'

📚 Tahdhib, vol. 7, p. 262

Ismail said: I asked Imam Sadiq (prayers of God be upon him) about mut'ah (temporary marriage); a known and specified dowry for a known and specified term!

📚 Tahdhib, vol. 7, p. 263

Ahwal said: I asked Imam Sadiq (prayers of God be upon him) about the least amount with which a person can enter into a temporary marriage. The Imam said: 'A handful (or two handfuls) of wheat!'

The man says to the woman:

📚 Al-Kafi, vol. 5, p. 455

Aban said: I said to Imam Sadiq (prayers of God be upon him): '(For a temporary contract) what should I say to her when I am alone with her?' He said: 'You say:'

Meaning: 'I take you in temporary marriage according to the Book of God and the Sunnah of His Prophet, on the condition that you do not inherit from me and I do not inherit from you, for such and such a number of days, and if you wish, you say such and such a number of years, for such and such an amount of dirhams (money).'

And you name the amount of payment that you have agreed upon, whether it is little or much.

So when the woman says: 'na'am,' meaning yes, she has indeed consented, and she is considered your wife, and you are the most deserving person to her!

✅ Numerous narrations have been received regarding the conditions, customs, and formulas of temporary marriage contracts, including the emphasis in the narrations on specifying the term and the amount of the payment or mut'ah dowry. Of course, the woman must have the necessary conditions for a temporary marriage, meaning she should not be married, in a waiting period, or pregnant, and must have other necessary conditions as well.

And according to the above narrations and others, the mentioned conditions are stated by the man to the woman in the form of the temporary marriage contract formula, and with the woman saying 'na'am' or yes, the temporary contract takes place.

Therefore, if the necessary conditions and customs mentioned in the narrations are observed and implemented, there will be no other problem, and since this statement is also said to the woman over the phone, and she hears it and says 'na'am' or yes, the general limits mentioned in the narrations are observed. In the specific and general hadiths on this subject, nothing explicitly indicates the necessity of being in person. Therefore, if all conditions are met, the formula and conditions of the temporary marriage can be said to the woman over the phone, and her 'na'am' can be received.

✅ Of course, some, because such a matter has not been specifically stated in the narrations, are of the opinion of precaution and try to have the offer and acceptance of the temporary contract done in person, and of course, it is very appropriate to do it in person whenever possible.

✅ It is clear that by writing the offer and acceptance of the mut'ah, the verbal declaration mentioned in the narrations is not achieved, and a written contract on paper or a Telegram message does not have the necessary conditions; it must be done by speaking and verbalizing it.
