Question 836: If a person in debt does not pay his debt despite being able to, what is the way to collect the debt from him?

✅Answer: Pay attention to the following two narrations:
1 عَنْ محمد بن یحیی رَفَعَهُ إِلَى أَبِي عَبْدِ اللَّهِ قَالَ: قَالَ لَهُ رَجُلٌ إِنَّ لِي عَلَى بَعْضِ الْحَسَنِيِّينَ مَالًا وَ قَدْ أَعْيَانِي أَخْذُهُ وَ قَدْ جَرَى بَيْنِي وَ بَيْنَهُ كَلَامٌ وَ لَا آمَنُ أَنْ يَجْرِيَ بَيْنِي وَ بَيْنَهُ فِي ذَلِكَ مَا أَغْتَمُّ لَهُ فَقَالَ أَبُو عَبْدِ اللَّهِ لَيْسَ هَذَا طَرِيقَ التَّقَاضِي وَ لَكِنْ إِذَا أَتَيْتَهُ أَطِلِ الْجُلُوسَ وَ الْزَمِ السُّكُوتَ قَالَ الرَّجُلُ فَمَا فَعَلْتُ ذَلِكَ إِلَّا يَسِيراً حَتَّى أَخَذْتُ مَالِي.

A man said to Imam Sadiq (peace and blessings of Allah be upon him): 'I am owed money by one of the children of al-Hasan, and collecting it has caused me hardship and weakness, and words have passed between me and him to the extent that I am not safe from things happening between me and him that would cause me distress!'
So Imam Sadiq (peace and blessings of Allah be upon him) said: 'This is not the way to receive and demand it. But when you go to him, prolong your sitting and remain silent!'
The man said: 'I did not do this except for a little while until I got my money!'
2️⃣ Walid ibn Sabih said: I complained to Imam Sadiq (peace and blessings of Allah be upon him) about a debt that people owe me. The Imam said: 'Say:'
اللَّهُمَّ لَحْظَةً مِنْ لَحَظَاتِکَ تَیَسَّرْ عَلَی غُرَمَائِی بِهَا الْقَضَاءَ وَ تَیَسَّرْ لِی بِهَا الِاقْتِضَاءَ إِنَّکَ عَلی کُلِّ شَیْ ءٍ قَدِیرٌ
Translation of the supplication: 'O Allah! With one of Your glances, make it easy and possible for my debtors to pay their debt, and make it easy and possible for me to receive and demand the debt, for You are capable of all things!'

✅ But debtors who, despite being able to pay their debt, are lazy in paying it and postpone it should know that:
3 الحسین بن زید عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ آبَائِهِ عَنِ النَّبِيِّ فِي حَدِيثِ الْمَنَاهِي أَنَّهُ قَالَ: وَ مَنْ مَطَلَ عَلَى ذِي حَقٍّ حَقَّهُ وَ هُوَ يَقْدِرُ عَلَى أَدَاءِ حَقِّهِ فَعَلَيْهِ كُلَّ يَوْمٍ خَطِيئَةُ عَشَّارٍ.
📚 Al-Faqih, vol. 4, p. 16
Imam Sadiq (peace be upon him) narrated from his forefathers that the Messenger of Allah (peace and blessings of Allah be upon him) said: 'Whoever postpones paying the right of a rightful person, despite being able to pay his right, on every day, the sin of a tax collector will be on him!'
4 عَنْ عَبْدِ اللَّهِ بْنِ سنان عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: قَالَ النَّبِيُّ... كَمَا لَا يَحِلُّ لِغَرِيمِكَ أَنْ يَمْطُلَكَ وَ هُوَ مُوسِرٌ فَكَذَلِكَ لَا يَحِلُّ لَكَ أَنْ تُعْسِرَهُ إِذَا عَلِمْتَ أَنَّهُ مُعْسِرٌ.

Imam Sadiq (peace and blessings of Allah be upon him) said: 'The Messenger of Allah (peace and blessings of Allah be upon him) said: 'Just as it is not permissible for your debtor to postpone paying your debt despite being able to, it is also not permissible for you to put pressure and hardship on him if you know that he is in a difficult and hard situation!''
5 عَنْ يُونُسَ بْنِ ظَبْيَانَ عَنْ أَبِي عَبْدِ اللَّهِ فِي حَدِيثٍ قَالَ: إِنَّ مَنْ حَبَسَ حَقَّ الْمُؤْمِنِ أَقَامَهُ اللَّهُ خَمْسَمِائَةِ عَامٍ عَلَى رِجْلَيْهِ حَتَّى يَسِيلَ مِنْ عَرَقِهِ أَوْدِيَةٌ ثُمَّ يُنَادِي مُنَادٍ مِنْ عِنْدِ اللَّهِ جَلَّ جَلَالُهُ هَذَا الظَّالِمُ الَّذِي حَبَسَ عَنِ اللَّهِ حَقَّهُ قَالَ فَيُوَبَّخُ أَرْبَعِينَ عَاماً ثُمَّ يُؤْمَرُ بِهِ إِلَى نَارِ جَهَنَّمَ.
📚 Al-Khisal, p. 328
Imam Sadiq (peace and blessings of Allah be upon him) said: 'Whoever withholds and holds back the right of a believer, Allah will make him stand on his two feet for 500 years until valleys flow from his sweat. Then a caller from Allah (glorified be His glory) will call out: 'This is an oppressor who has withheld the right of Allah!''
He said: 'Then he will be rebuked and reprimanded for 40 years, and then he will be commanded to be taken to the fire of hell!'
6 عَنِ الرِّضَا فِي كِتَابِهِ إِلَى الْمَأْمُونِ قَالَ: الْإِيمَانُ هُوَ أَدَاءُ الْأَمَانَةِ وَ اجْتِنَابُ جَمِيعِ الْكَبَائِرِ إِلَى أَنْ قَالَ وَ اجْتِنَابُ الْكَبَائِرِ وَ هِيَ...... حَبْسُ الْحُقُوقِ مِنْ غَيْرِ عُسْرٍ
📚 'Uyun Akhbar al-Reza (peace be upon him), vol. 2, p. 125
Imam Reza (peace and blessings of Allah be upon him) wrote in his letter to Ma'mun: 'Faith is the fulfillment of a trust and the avoidance of all major sins,' until he said: '...and the avoidance of major sins, which is... withholding the rights of others without being in a difficult and hard situation!'
✅ So debtors should not be negligent in paying their debts, for it is a very great sin and its punishment is severe!
