Question 780: If a woman becomes pure from menstruation on a night in the month of Ramadan but does not perform ghusl until after dawn, what is her ruling?

1 عَنْ عَلِيِّ بْنِ الْحَسَنِ عَنْ عَلِيِّ بْنِ أَسْبَاطٍ عَنْ عَمِّهِ يَعْقُوبَ بْنِ سَالِمٍ الْأَحْمَرِ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ: إِنْ طَهُرَتْ بِلَيْلٍ مِنْ حَيْضَتِهَا ثُمَّ تَوَانَتْ أَنْ تَغْتَسِلَ فِي رَمَضَانَ حَتَّى أَصْبَحَتْ عَلَيْهَا قَضَاءُ ذَلِكَ الْيَوْمِ.

Imam Sadiq (peace be upon him) said: 'If a woman becomes pure from her menstruation on a night in the month of Ramadan and is lazy in performing ghusl until morning comes (i.e., dawn breaks), it is her responsibility to make up that day!'

✅ It is clear from the concept of the above narration that if a woman becomes pure from menstruation on a night in the month of Ramadan, she is obligated to perform her ghusl of menstruation before dawn and the legal adhan.

However, if she is lazy in this duty, she must make up that day's fast after the month of Ramadan.

There is no doubt that she must also fast that day according to her general duty.

In the case of laziness in performing ghusl until dawn, in the texts of the Ahl al-Bayt (peace be upon them), no other duty has been placed on the woman except making up the fast. And those who believe in the necessity of kaffarah (expiation) have no evidence from the texts and, by analogy with the rulings of a person who deliberately wakes up in a state of janabah in the month of Ramadan, they also believe in kaffarah. But we see that in this case, the Ahl al-Bayt (peace be upon them) have not specified anything other than making up the fast, and in the jurisprudence of the narrators, analogy has no way or place in the rulings of religion:

2 عَنِ الْقَاسِمِ بْنِ يَحْيَى عَنْ جَدِّهِ الْحَسَنِ بْنِ رَاشِدٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي عَبْدِ اللَّهِ قَالَ فِي كِتَابِ أَدَب أَمِيرِ الْمُؤْمِنِينَ لَا تَقِيسُوا الدِّينَ فَإِنَّ أَمْرَ اللَّهِ لَا يُقَاسُ وَ سَيَأْتِي قَوْمٌ يَقِيسُونَ وَ هُمْ أَعْدَاءُ الدِّينِ.

Imam Sadiq (peace be upon him) said: 'It is written in the book of manners of Amir al-Mu'minin (peace be upon him): 'Do not make an analogy in religion, for indeed the command of Allah is not analogized, and soon there will come people who will make analogies, and they are the enemies of religion!''
