Question 741: Can one make the intention to fast a make-up fast during the day?

1 عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ عَنْ أَبِي الْحَسَن فِي الرَّجُلِ يَبْدُو لَهُ بَعْدَ مَا يُصْبِحُ وَ يَرْتَفِعُ النَّهَارُ فِي صَوْمِ ذَلِكَ الْيَوْمِ لِيَقْضِيَهُ مِنْ شَهْرِ رَمَضَانَ وَ لَمْ يَكُنْ نَوَى ذَلِكَ مِنَ اللَّيْلِ قَالَ نَعَمْ لِيَصُمْهُ وَ لْيَعْتَدَّ بِهِ إِذَا لَمْ يَكُنْ أَحْدَثَ شَيْئاً.

Imam Kadhim (peace be upon him) was asked about a person who starts the morning and as the day progresses, decides to fast that day to make up for a missed Ramadan fast, having not made the intention from the night before. He said: 'Yes, he may fast it and count it, on the condition that he has not done anything (that invalidates the fast)!'

2 عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ قَالَ: سَأَلْتُ أَبَا الْحَسَنِ مُوسَى عَنِ الرَّجُلِ يُصْبِحُ وَ لَمْ يَطْعَمْ وَ لَمْ يَشْرَبْ وَ لَمْ يَنْوِ صَوْماً وَ كَانَ عَلَيْهِ يَوْمٌ مِنْ شَهْرِ رَمَضَانَ- أَ لَهُ أَنْ يَصُومَ ذَلِكَ الْيَوْمَ وَ قَدْ ذَهَبَ عَامَّةُ النَّهَارِ فَقَالَ نَعَمْ لَهُ أَنْ يَصُومَهُ وَ يَعْتَدَّ بِهِ مِنْ شَهْرِ رَمَضَانَ.

Abdul Rahman ibn Hajjaj said: 'I asked Imam Kadhim (peace be upon him) about a person who starts the morning, has not eaten or drunk anything, has not made an intention to fast, and has a make-up fast for Ramadan to perform. Can he fast that day even though a large part of the day has passed?' He said: 'Yes, he can fast and count it as a make-up for Ramadan!'

3 عَنْ عَمَّارٍ السَّابَاطِيِّ عَنْ أَبِي عَبْدِ اللَّهِ عَنِ الرَّجُلِ يَكُونُ عَلَيْهِ أَيَّامٌ مِنْ شَهْرِ رَمَضَانَ وَ يُرِيدُ أَنْ يَقْضِيَهَا مَتَى يُرِيدُ أَنْ يَنْوِيَ الصِّيَامَ قَالَ هُوَ بِالْخِيَارِ إِلَى أَنْ تَزُولَ الشَّمْسُ فَإِذَا زَالَتِ الشَّمْسُ فَإِنْ كَانَ نَوَى الصَّوْمَ فَلْيَصُمْ وَ إِنْ كَانَ يَنْوِي الْإِفْطَارَ فَلْيُفْطِرْ سُئِلَ فَإِنْ كَانَ نَوَى الْإِفْطَارَ يَسْتَقِيمُ أَنْ يَنْوِيَ الصَّوْمَ بَعْدَ مَا زَالَتِ الشَّمْسُ قَالَ لَا الْحَدِيثَ.

Ammar said: 'I asked Imam Sadiq (peace be upon him) about a person who has make-up fasts from Ramadan and intends to perform them. When should he make the intention to fast?' The Imam said: 'He has the choice until the sun passes the meridian (i.e., until noon). So when noon arrives, if he has intended to fast, then he should fast, and if he has intended to break the fast, then he should break the fast.'

He was asked: 'If he intends to break the fast, is it permissible for him to make the intention to fast after noon?' He said: 'No!'

✅ It is clear from the sum of the above narrations and others that if a person has not committed any of the things that invalidate a fast and makes the intention for a make-up fast before noon, he can fast that day as a make-up for Ramadan.
