Question 439: Does a woman who is able to perform Hajj need her husband's permission or not?

Answer
✅ Answer: Regarding Hajj al-Islam, which is the obligatory Hajj, please pay attention to the following narrations:
📚 Al-Tahdhib, Vol. 5, p. 400
Muhammad ibn Muslim said: 'I asked Imam Baqir (peace be upon him): 'A woman who has not yet performed Hajj (she is a 'soroorah') and has a husband, and her husband refuses to give her permission for Hajj, and her husband is absent, can she go on Hajj?' The Imam said: 'In the case of Hajj al-Islam, there is no obedience to the husband upon the wife!'
📚 Al-Faqih, Vol. 2, p. 437
Zurarah said: 'I asked Imam Baqir (peace be upon him) about a woman who is married and is a 'soroorah' (she has not yet performed Hajj) and her husband does not give her permission for Hajj.' The Imam said: 'She should perform Hajj even if he does not give her permission.'
📚 Al-Kafi, Vol. 4, p. 282
It was asked of Imam Sadiq (peace be upon him) about a woman who intends to perform Hajj and there is no mahram with her: 'Is it appropriate for her to go on Hajj?' He said: 'Yes, if she is trustworthy.'
📚 Al-Faqih, Vol. 2, p. 438
Mu'awiyah ibn 'Ammar said: 'I asked Imam Sadiq (peace be upon him) about a woman who leaves for Hajj without a guardian.' The Imam said: 'There is no problem; she can go with a trustworthy and reliable group.'
📚 Al-Tahdhib, Vol. 5, p. 401
Abi Basir said: 'I asked Imam Sadiq (peace be upon him) about a woman who performs Hajj without her guardian.' He said: 'If a woman is trustworthy, she can go on Hajj with her Muslim brother.'
📚 Qur'b al-Isnad, p. 52
Ali (peace be upon him) used to say: 'There is no problem for a 'soroorah' woman who has not yet performed Hajj, if she does not have a mahram or a husband, to perform Hajj with a righteous group.'
✅ It is observed that in the case of Hajj al-Islam, meaning the obligatory Hajj and the first Hajj, the husband's permission is not a condition. If a woman does not have a husband, guardian, or mahram with her, as long as she is trustworthy, she can go on Hajj with a righteous and reliable group, even if her husband is not pleased.
✅ But regarding supererogatory Hajj, meaning the second Hajj and onwards, please pay attention to the following narration:
📚 Al-Tahdhib, Vol. 5, p. 400
Ishaq ibn 'Ammar said: 'I asked Imam Kadhim (peace be upon him): 'A wealthy woman who has performed her Hajj al-Islam says to her husband: 'Send me on Hajj with my own money.' Can her husband prevent her from going on Hajj?' The Imam said: 'Yes,' and he would say to his wife: 'My right upon you is greater than your right upon me in this matter!'
✅ Based on the above narration, a woman who has performed her Hajj al-Islam and her obligatory Hajj, in addition to the need for other necessary conditions to be met, also needs her husband's permission for a subsequent Hajj, even if it is with her own money.
Husband's permission for wife's Hajj
Husband's permission for second Hajj
