Question 2177: If a married woman commits adultery, must her husband divorce her or can he keep her?

✅ Answer: Pay attention to the following ahadith:
1 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: قَالَ رَسُولُ اللَّهِ أَوْصَانِی جَبْرَئِیلُ بِالْمَرْأَةِ حَتَّی ظَنَنْتُ أَنَّهُ لَا یَنْبَغِی طَلَاقُهَا إِلَّا مِنْ فَاحِشَةٍ مُبَیِّنَةٍ.
📚 Al-Kafi, Vol. 5, p. 512
Imam Sadiq (peace be upon him) said: The Messenger of Allah (peace and blessings of Allah be upon him and his family) said: Gabriel advised me concerning the woman so much that I thought divorcing her is not proper except in the case of clear immorality!
2 عَنْ عَبَّادِ بْنِ صُهَیْبٍ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ قَالَ: لَا بَأْسَ أَنْ یُمْسِکَ الرَّجُلُ امْرَأَتَهُ إِنْ رَآهَا تَزْنِی إِذَا کَانَتْ تَزْنِی وَ إِنْ لَمْ یُقَمْ عَلَیْهَا الْحَدُّ فَلَیْسَ عَلَیْهِ مِنْ إِثْمِهَا شَیْءٌ.

Imam Sadiq (peace be upon him) said: If a man sees his wife committing adultery, there is no harm if he keeps her; even if the prescribed punishment (Hadd) is not carried out on her, none of her sin falls upon the man!
3 عَنْ زُرَارَةَ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: جَاءَ رَجُلٌ إِلَی النَّبِیِّ فَقَالَ یَا رَسُولَ اللَّهِ إِنَّ امْرَأَتِی لَا تَدْفَعُ یَدَ لَامِسٍ قَالَ فَطَلِّقْهَا فَقَالَ یَا رَسُولَ اللَّهِ إِنِّی أُحِبُّهَا قَالَ فَأَمْسِکْهَا.

Imam Sadiq (peace be upon him) said: A man came to the Messenger of Allah (peace and blessings of Allah be upon him and his family) and said: Indeed, my wife does not refuse the hand of any toucher! So the Prophet said: Divorce her! He said: O Messenger of Allah! I love her! The Prophet said: Then keep her!

4 عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنْ رَجُلٍ رَأَی امْرَأَتَهُ تَزْنِی أَ یَصْلُحُ لَهُ أَنْ یُمْسِکَهَا فَقَالَ نَعَمْ إِنْ شَاءَ.
Abdullah ibn Sinan said: I asked Imam Sadiq (peace be upon him) about a man who sees his wife committing adultery, whether it is appropriate for him to keep her? The Imam said: Yes, if he wishes!

5 عَنْ جَمِیلٍ عَنْ زُرَارَةَ قَالَ: سَأَلَهُ عَمَّارٌ وَ أَنَا حَاضِرٌ عَنِ الرَّجُلِ یَتَزَوَّجُ الْفَاجِرَةَ مُتْعَةً قَالَ لَا بَأْسَ وَ إِنْ کَانَ التَّزْوِیجُ الْآخَرُ فَلْیُحْصِنْ بَابَهُ.
Zurarah said: In my presence, 'Ammar asked the Imam (peace be upon him) about a man who contracts temporary marriage with an immoral woman; the Imam said: There is no harm! And if it were a permanent marriage, he must secure and guard the door of his house!
✅ Based on the above ahadith and others, one of the matters that makes divorcing a wife permissible, and rather recommended and fitting, is that—we seek refuge in Allah—the wife commits adultery and shows no restraint in this regard.
Of course, divorcing such a woman is not obligatory, and especially if the man loves her, he can keep her if he wishes. However, it is recommended that he strictly guard and confine her so that the way to adultery is not open to her and she does not commit immorality.
