Question 1975: Is qadhf (false accusation) and insult considered a violation of people's rights or the rights of Allah?

✅ Answer: Refer to the following narrations:

1⃣عن عبدالرحمن بن الحجاج عن أبی الْحَسَنِ مُوسَی فی رَجُلَیْنِ یَتَسَابَّانِ قَالَ الْبَادِی مِنْهُمَا أَظْلَمُ وَ وِزْرُهُ وَ وِزْرُ صَاحِبِهِ عَلَیْهِ مَا لَمْ یَعْتَذِرْ إِلَی الْمَظْلُوم

📚 Al-Kafi, Vol. 2, p. 360

Imam Kazim (peace be upon him) said regarding two people who insult each other: The one who starts is more unjust, and their sin and the sin of the other person are on their shoulders until they apologize to the oppressed person.

2⃣عن غیاث بن إبراهیم عن جعفر عن أبیه قال: جَاءَتِ امْرَأَةٌ إِلَی رَسُولِ اللَّهِ فَقَالَتْ یا رَسُولَ اللَّهِ إِنِّی قُلْتُ لِأَمَتِی یَا زَانِیَةُ فَقَالَ هَلْ رَأَیْتِ عَلَیْهَا زِنًا فَقَالَتْ لَا فَقَالَ أَمَا إِنَّهَا سَیُقَادُ لَهَا مِنْکِ یَوْمَ الْقِیَامَةِ فَرَجَعَتْ إِلَی أَمَتِهَا فَأَعْطَتْهَا سَوْطاً ثُمَّ قَالَتِ اجْلِدِینِی فَأَبَتِ الْأَمَةُ فَأَعْتَقَتْهَا ثُمَّ أَتَتْ إِلَی النَّبِیِّ فَأَخْبَرَتْهُ فَقَالَ عَسَی أَنْ یَکُونَ بِهِ.

📚 Tahdhib, Vol. 10, p. 80

Imam Baqir (peace be upon him) said: A woman came to the Messenger of Allah (peace and blessings be upon him and his family) and said: I called my servant, 'O adulteress!' The Prophet asked: 'Have you seen any adultery from her?' She said: 'No!' The Prophet said: 'Know that on the Day of Judgment, she will take retribution from you!'

The woman returned to her servant, gave her a whip, and said: 'Whip me!' But the servant refused, so the woman freed her and informed the Prophet. The Prophet said: 'Hopefully, this action will atone for your qadhf!'

3⃣عن أبی بکرالحضرمی قال: سَأَلْتُ أَبَاعَبْداللَّه عن عَبْدٍ مَمْلُوکٍ قَذَفَ حُرّاً قَالَ یُجْلَدُ ثَمَانِینَ هَذَا مِنْ حُقُوقِ النَّاسِ فَأَمَّا مَا کَانَ مِنْ حُقُوقِ اللَّهِ عَزَّوَجَلَّ فَإِنَّهُ یُضْرَبُ نِصْفَ الْحَدِّ قُلْتُ الَّذِی مِنْ حُقُوقِ اللَّهِ عَزَّوَجَلَّ مَا هُوَ قَالَ إِذَا زَنَی أَوْ شَرِبَ خَمْراً فَهَذَا مِنَ الْحُقُوقِ الَّتِی یُضْرَبُ فِیهَا نِصْفَ الْحَدِّ.

📚 Al-Kafi, Vol. 7, p. 237

Abu Bakr Hazrami said: I asked Imam Sadiq (peace be upon him) about a slave who accuses a free person of adultery. The Imam said: 'This is among the rights of people, and 80 lashes are given. However, for matters that are the rights of Allah, the punishment for a slave is half.' I asked: 'What is considered the rights of Allah?' He said: 'When a slave commits adultery or drinks alcohol, the punishment is half.'

4⃣ From Halabi, Abu Abdullah (Imam Sadiq) said:

قَذَفَ الْعَبْدُ الْحُرَّ جُلِدَ ثَمَانِینَ و قَالَ هَذَا مِنْ حُقُوقِ النَّاسِ.

📚 Al-Kafi, Vol. 7, p. 234

Imam Sadiq (peace be upon him) said: 'When a slave accuses a free person, 80 lashes are given.' He added: 'This is among the rights of people.'

5⃣عن عمار الساباطی عن أَبِی عَبْداللَّه فِی رَجُلٍ قَالَ لِرَجُلٍ یَا ابْنَ الْفَاعِلَةِ یَعْنِی الزِّنَا فَقَالَ إِنْ کَانَتْ أُمُّهُ حَیَّةً شَاهِدَةً ثُمَّ جَاءَتْ تَطْلُبُ حَقَّهَا ضُرِبَ ثَمَانِینَ جَلْدَةً وَ إِنْ کَانَتْ غَائِبَةً انْتُظِرَ بِهَا حَتَّی تَقْدَمَ ثُمَّ تَطْلُبَ حَقَّهَا و إِنْ کَانَتْ قَدْ مَاتَتْ وَ لَمْ یُعْلَمْ مِنْهَا إِلَّا خَیْرٌ ضُرِبَ الْمُفْتَرِی عَلَیْهَا الْحَدَّ ثَمَانِینَ جَلْدَةً.

📚 Al-Kafi, Vol. 7, p. 205

Imam Sadiq (peace be upon him) said about a person who says to a man, 'O son of an adulteress,' intending to accuse the mother: 'If the mother is alive and present to claim her right, 80 lashes are given to the accuser. If she is absent, the matter is postponed until she comes to claim her right. If she is deceased and known only for her righteousness, 80 lashes are given to the accuser.'

6⃣عن ضُرَیْسٍ الْکُنَاسِیِّ عن أَبِی جَعْفَرٍ قال: لَا یُعْفَی عَنِ الْحُدُودِ الَّتِی لِلَّهِ دُونَ الْإِمَامِ فَأَمَّا مَا کَانَ مِنْ حُقُوقِ النَّاسِ فِی حَدٍّ فَلَا بَأْسَ بِأَنْ یُعْفَی عَنْهُ دُونَ الْإِمَامِ.

📚 Al-Kafi, Vol. 7, p. 252

Imam Baqir (peace be upon him) said: 'Punishments that are the rights of Allah cannot be forgiven before referring to the Imam. However, if it is a matter of people's rights, it is permissible to forgive it before referring to the Imam.'

✅ From the above narrations and others, it is clear that insults and accusations of adultery or sodomy are among the rights of people. The person falsely accused has the right to forgive the accuser. If they do not forgive, the worldly punishment is 80 lashes. If this punishment is not carried out, retribution will be taken on the Day of Judgment.

اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ وَ آلِ مُحَمَّدٍ وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْر
