Question 1974: Is it permissible to engage in temporary marriage (Mut'ah) with an adulterous woman or a woman who does not observe the waiting period ('iddah)?

1⃣عَنْ مُحَمَّدِ بْنِ إِسْمَاعِیلَ قَالَ: سَأَلَ رَجُلٌ أَبَاالْحَسَنِ الرِّضَا وَ أَنَا أَسْمَعُ عَنْ رَجُلٍ یَتَزَوَّجُ امْرَأَةً مُتْعَةً وَ یَشْتَرِطُ عَلَیْهَا أَنْ لَا یَطْلُبَ وَلَدَهَا فَتَأْتِی بَعْدَ ذَلِکَ بِوَلَدٍ فَشَدَّدَ فِی إِنْکَارِ الْوَلَدِ وَ قَالَ أَ یَجْحَدُهُ إِعْظَاماً لِذَلِکَ فَقَالَ الرَّجُلُ فَإِنِ اتَّهَمَهَا فَقَالَ لَا یَنْبَغِی لَکَ أَنْ تَتَزَوَّجَ إِلَّا مُؤْمِنَةً أَوْ مُسْلِمَةً فَإِنَّ اللَّهَ عَزَّوَجَلَّ یَقُولُ الزَّانِی لا یَنْکِحُ إِلَّا زانِیَةً أَوْ مُشْرِکَةً وَ الزَّانِیَةُ لا یَنْکِحُها إِلَّا زانٍ أَوْ مُشْرِکٌ وَ حُرِّمَ ذلِکَ عَلَی الْمُؤْمِنِینَ.

Muhammad ibn Isma'il said: A man in my presence asked Imam Reza (peace be upon him) about a man who enters into a temporary marriage with a woman and conditions that she should not bear children, but later she gives birth. The Imam strongly condemned denying the child and said: 'Does he deny the child?!' The man asked: 'What if he suspects her of wrongdoing?' The Imam said: 'It is not appropriate for you to marry anyone but a believing or Muslim woman, as Allah Almighty says in Surah Al-Nur (24:3): 'An adulterer does not marry except an adulteress or a polytheist, and an adulteress is not married except by an adulterer or a polytheist. Such is forbidden to the believers.'
2⃣عن يونس عَنْ بَعْضِ رِجَالِهِ عَنْ أَبِی عَبْدِاللَّهِ قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ تَزَوَّجَ الْمَرْأَةَ مُتْعَةً أَیَّاماً مَعْلُومَةً فَتَجِیئُهُ فِی بَعْضِ أَیَّامِهَا فَتَقُولُ إِنِّی قَدْ بَغَیْتُ قَبْلَ مَجِیئِی إِلَیْکَ بِسَاعَةٍ أَوْ بِیَوْمٍ هَلْ لَهُ أَنْ یَطَأَهَا وَ قَدْ أَقَرَّتْ لَهُ بِبَغْیِهَا قَالَ لَا یَنْبَغِی لَهُ أَنْ یَطَأَهَا.

One of Yunus' men said: I asked (the Imam, peace be upon him) about a man who enters into a temporary marriage for a specified number of days with a woman who comes to him one day and says, 'An hour or a day before I came to you, I committed adultery!' Can the man have relations with her despite her confession? The Imam replied: 'It is not appropriate for him to have relations with her.'
3⃣عَنْ عَبْداللَّهِ بْنِ أَبِی یَعْفُورٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنِ الْمَرْأَةِ وَ لَا یُدْرَی مَا حَالُهَا أَ یَتَزَوَّجُهَا الرَّجُلُ مُتْعَةً قَالَ یَتَعَرَّضُ لَهَا فَإِنْ أَجَابَتْهُ إِلَی الْفُجُورِ فَلَا یَفْعَلُ.

Abdullah ibn Abi Ya'four said: I asked Imam Sadiq (peace be upon him) about a woman of uncertain character and whether a man could marry her in a temporary marriage. The Imam said: 'Ask her, and if she admits to adultery, then do not marry her.'
4⃣عَنْ مُحَمَّدِ بْنِ الْفَیْضِ قَالَ: سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنِ الْمُتْعَةِ قَالَ نَعَمْ إِذَا کَانَتْ عَارِفَةً إِلَی أَنْ قَالَ وَ إِیَّاکُمْ وَ الْکَوَاشِفَ وَ الدَّوَاعِیَ وَ الْبَغَایَا وَ ذَوَاتِ الْأَزْوَاجِ قُلْتُ مَا الْکَوَاشِفُ قَالَ اللَّوَاتِی یُکَاشِفْنَ وَ بُیُوتُهُنَّ مَعْلُومَةٌ وَ یُؤْتَیْنَ قُلْتُ فَالدَّوَاعِی قَالَ اللَّوَاتِی یَدْعُونَ إِلَی أَنْفُسِهِنَّ وَ قَدْ عُرِفْنَ بِالْفَسَادِ قُلْتُ فَالْبَغَایَا قَالَ الْمَعْرُوفَاتُ بِالزِّنَا قُلْتُ فَذَوَاتُ الْأَزْوَاجِ قَالَ الْمُطَلَّقَاتُ عَلَی غَیْرِ السُّنَّةِ.

Muhammad ibn Fayd said: I asked Imam Sadiq (peace be upon him) about Mut'ah. The Imam replied: 'Yes, provided she is a believer (arif).’ Then he added: 'Avoid those who are openly immoral (kawashif), those who invite corruption (dawa'i), prostitutes (baghaya), and those who are already married.'
I asked: 'What are kawashif?' He said: 'Women who openly display immoral behavior and whose places of corruption are well-known.'
I asked: 'What are dawa'i?' He said: 'Women who invite others to themselves and are known for corruption.'
اللَّهُمَّ صَلِّ عَلَی مُحَمَّدٍ وَ آلِ مُحَمَّدٍ وَ عَجِّلْ لِوَلِیِّکَ الْفَرَجَ وَ الْعَافِیَةَ وَ النَّصْر
I asked: 'What are baghaya?' He said: 'Women known for adultery.'
5⃣عَنْ مُحَمَّدِ بْنِ الْفُضَیْلِ قَالَ: سَأَلْتُ أَبَا الْحَسَنِ عَنِ الْمَرْأَةِ الْحَسْنَاءِ الْفَاجِرَةِ هَلْ يجوز لِلرَّجُلِ أَنْ یَتَمَتَّعَ مِنْهَا یَوْماً أَوْ أَکْثَرَ فَقَالَ إِذَا کَانَتْ مَشْهُورَةً بِالزِّنَا فَلَا یَتَمَتَّعْ مِنْهَا وَ لَا یَنْکِحْهَا.
I asked: 'Who are the married women?' He said: 'Those divorced in ways that are not according to Islamic law.'

6⃣عَنْ أَبِی سَارَةَ قَالَ: سَأَلْتُ أَبَاعَبْدِاللَّهِ عَنْهَا یَعْنِی الْمُتْعَةَ فَقَالَ لِی حَلَالٌ فَلَا تَزَوَّجْ إِلَّا عَفِیفَةً إِنَّ اللَّهَ عَزَّ وَ جَلَّ یَقُولُ وَ الَّذِینَ هُمْ لِفُرُوجِهِمْ حافِظُونَ فَلَا تَضَعْ فَرْجَکَ حَیْثُ لَا تَأْمَنُ عَلَی دِرْهَمِکَ.

Muhammad ibn Fadhl said: I asked Imam Kazim (peace be upon him) about a beautiful adulterous woman and whether it is permissible for a man to enter into Mut'ah with her for a day or more. The Imam replied: 'If she is known for adultery, do not marry her in Mut'ah or otherwise.'
7⃣ عَنْ أَبِی مَرْیَمَ عَنْ أَبِی جَعْفَرٍ أَنَّهُ سُئِلَ عَنِ الْمُتْعَةِ فَقَالَ إِنَّ الْمُتْعَةَ الْیَوْمَ لَیْسَتْ کَمَا کَانَتْ قَبْلَ الْیَوْمِ إِنَّهُنَّ کُنَّ یَوْمَئِذٍ یُؤْمَنَّ وَ الْیَوْمَ لَا یُؤْمَنَّ فَاسْأَلُوا عَنْهُنَّ.

Abi Sarah said: I asked Imam Sadiq (peace be upon him) about Mut'ah. The Imam replied: 'It is permissible, but marry only chaste women. Indeed, Allah Almighty says in Surah Al-Mu'minun (23:5): 'And they who guard their private parts.' Therefore, do not engage in relations where you cannot trust their morality.'

Imam Baqir (peace be upon him) was asked about Mut'ah. The Imam said: 'Mut'ah today is not like it was before! Previously, women were trustworthy, but today they are not! So investigate them before proceeding.'
✅ From the above narrations, it is clear that the Ahlul Bayt (peace be upon them) emphasized choosing women for Mut'ah who are believers, chaste, pure, trustworthy, and moral. They strongly discouraged temporary marriage with women known for adultery or corruption or those who cannot be trusted.
✅ One key point highlighted in these narrations is the consequence of marrying an immoral woman. If she bears a child and claims it belongs to the man, even if there was an agreement not to have children, the man cannot deny the child. Therefore, it is recommended to marry only chaste women for Mut'ah.
✅ Regarding the few narrations that mention the permissibility of Mut'ah with adulterous women, several points must be noted:
1. These narrations are rare and contradict the above narrations and the verse from Surah Al-Nur (24:3).
2. According to the narrations, a woman known to have recently committed adultery and who has not observed the waiting period ('iddah) cannot be married in Mut'ah. If she confesses to adultery during the contract period, relations must cease, as stated in narration 2⃣.

4. According to narration 3⃣, if a woman's character is uncertain, it is recommended to test her by offering a proposal for adultery. If she accepts, then marriage with her is prohibited.
