Question 1945: A person is hired as a worker and salesperson in a shop. If a thief comes and, with force and threats, steals some goods from the shop, is this worker liable?

1⃣عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِیَادٍ عَنْ مُحَمَّدِ بْنِ الْحَسَنِ بْنِ شَمُّونٍ عَنْ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ مِسْمَعِ بْنِ عَبْدِ الْمَلِکِ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ قَالَ أَمِیرُ الْمُؤْمِنِینَ صَلَوَاتُ اللَّهِ عَلَیْهِ الْأَجِیرُ الْمُشَارِکُ هُوَ ضَامِنٌ إِلَّا مِنْ سَبُعٍ أَوْ مِنْ غَرَقٍ أَوْ حَرَقٍ أَوْ لِصٍّ مُکَابِرٍ.

📚 Al-Kafi, Vol. 5, p. 244

Imam Sadiq (peace be upon him) said: Amir al-Mu'minin (peace be upon him) said: A worker who is also a partner is liable, except in cases of attack by wild animals, drowning, fire, or theft where something is taken by force!

2⃣عَلِیُّ بْنُ إِبْرَاهِیمَ عَنْ أَبِیهِ عَنِ النَّوْفَلِیِّ عَنِ السَّکُونِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: کَانَ أَمِیرُ الْمُؤْمِنِینَ یُضَمِّنُ الْقَصَّارَ وَ الصَّبَّاغَ وَ الصَّائِغَ احْتِیَاطاً عَلَی أَمْتِعَةِ النَّاسِ وَ کَانَ لَا یُضَمِّنُ مِنَ الْغَرَقِ وَ الْحَرَقِ وَ الشَّیْءِ الْغَالِبِ....

📚 Al-Kafi, Vol. 5, p. 242

Imam Sadiq (peace be upon him) said: Amir al-Mu'minin (peace be upon him) would consider workers, such as those in clothing, dyeing, and casting, responsible for people's goods out of precaution, but he would not hold them liable for losses due to drowning, fire, or natural disasters!

3⃣عَنْ صَفْوَانَ عَنْ يَعْقُوبَ بْنِ شُعَيْبٍ قَالَ: سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنِ اَلرَّجُلِ يَبِيعُ لِلْقَوْمِ بِالْأَجْرِ وَ عَلَيْهِ ضَمَانُ مَالِهِمْ فَقَالَ إِذَا طَابَتْ نَفْسُهُ بِذَلِكَ إِنَّمَا أَكْرَهُ مِنْ أَجْلِ أَنِّي أَخْشَى أَنْ يُغَرِّمُوهُ أَكْثَرَ مِمَّا يُصِيبُ عَلَيْهِمْ فَإِذَا طَابَتْ نَفْسُهُ فَلاَ بَأْسَ.

📚 Al-Tahdhib, Vol. 7, p. 221

Ya'qub bin Shu'ayb said: I asked Imam Sadiq (peace be upon him) about a man who is a hired salesperson for a group, and he is responsible for the goods of the people; the Imam said: If the worker is confident in his heart, there is no issue, but because I fear that he might be held liable beyond the wage he receives, I do not like to accept this responsibility for the worker, and I consider it undesirable!

✅ Based on the above narrations and others, a salesperson who has not guaranteed the goods of the shop owner and is not a partner of the shop owner is not liable for the goods of the shop owner, provided there is no negligence.

Additionally, natural events like floods, fires, and thieves who take goods by force do not create liability for the worker.

Therefore, in the case above, where a thief steals some goods from the shop by force and threat, the worker in the shop is not liable.
