Question 1920: Does a wife inherit from the land of the house?

✅ Answer: Please consider the following narrations:

1⃣عن مُحَمَّدِ بْنِ مُسْلِمٍ عن أَبِی جَعْفَرٍ قال: النِّسَاءُ لَا یَرِثْنَ مِنَ الْأَرْضِ وَ لَا مِنَ الْعَقَارِ شَیْئاً

📚 *Al-Kafi*, Vol. 7, p. 127

Imam al-Baqir (peace be upon him) said: 'Women do not inherit from the land, house, or agricultural land!'

2⃣عن أَحَدِهِمَا أَنَّ الْمَرْأَةَ لَا تَرِثُ مِنْ تَرِکَةِ زَوْجِهَا مِنْ تُرْبَةِ دَارٍ أَوْ أَرْضٍ إِلَّا أَنْ یُقَوَّمَ الطُّوبُ وَ الْخَشَبُ قِیمَةً فَتُعْطَی رُبُعَهَا أَوْ ثُمُنَهَا إِنْ کَانَ لَهَا وَلَدٌ مِنْ قِیمَةِ الطُّوبِ وَ الْجُذُوعِ وَ الْخَشَبِ.

📚 *Al-Kafi*, Vol. 7, p. 128

Imam al-Baqir or Imam al-Sadiq (peace be upon them) said: 'A woman does not inherit from her husband's inheritance of the land of the house, except if the bricks and wood (inside it) have value. She may inherit one-fourth of its value, or one-eighth if there are children!'

3⃣عن مُحَمَّدِ بْنِ مُسْلِمٍ قال قال أَبُوعَبْداللَّهِ تَرِثُ الْمَرْأَةُ مِنَ الطُّوبِ وَ لَا تَرِثُ مِنَ الرِّبَاعِ شَیْئاً قَالَ قُلْتُ کَیْفَ تَرِثُ مِنَ الْفَرْعِ وَ لَا تَرِثُ مِنَ الْأَصْلِ شَیْئاً فَقَالَ لِی لَیْسَ لَهَا مِنْهُمْ نَسَبٌ تَرِثُ بِهِ وَ إِنَّمَا هِیَ دَخِیلٌ عَلَیْهِمْ فَتَرِثُ مِنَ الْفَرْعِ وَ لَا تَرِثُ مِنَ الْأَصْلِ وَ لَا یَدْخُلُ عَلَیْهِمْ دَاخِلٌ بِسَبَبِهَا.

📚 *Al-Kafi*, Vol. 7, p. 128

Muhammad ibn Muslim said: 'Imam al-Sadiq (peace be upon him) said: A woman inherits from the bricks, but she does not inherit from the land of the house.'

He said: 'I asked: How does she inherit from the secondary (bricks) but not from the primary (land)? Imam replied: The wife has no relation to them by lineage to inherit from them. She is a person who has entered into their property, but she is not from them. Therefore, she inherits from the secondary (bricks) but not from the primary (land), and no one is added to them because of her!'

4⃣عَنْ زُرَارَةَ [أَ]و مُحَمَّدِ بْنِ مُسْلِمٍ عن أَبِی عَبْداللَّهِ قَالَ: لَا تَرِثُ النِّسَاءُ مِنْ عَقَارِ الدُّورِ شَیْئاً وَ لَکِنْ یُقَوَّمُ الْبِنَاءُ وَ الطُّوبُ وَ تُعْطَی ثُمُنَهَا أَوْ رُبُعَهَا قَالَ وَ إِنَّمَا ذَاکَ لِئَلَّا یَتَزَوَّجْنَ النِّسَاءُ فَیُفْسِدْنَ عَلَی أَهْلِ الْمَوَارِیثِ مَوَارِیثَهُمْ.

📚 *Al-Kafi*, Vol. 7, p. 128

Imam al-Sadiq (peace be upon him) said: 'Women do not inherit from the land of the house, but the building and bricks can be valued, and one-eighth or one-fourth of its value is given to her.'

He said: 'This is because women should not marry and come to corrupt the inheritance of the heirs!'

5⃣عن شُعَیْبٍ عن یَزِید الصَّائِغِ قال: سَأَلْتُ أَباعَبْداللَّهِ عَنِ النِّسَاءِ هَلْ یَرِثْنَ الْأَرْضَ فَقَالَ لَا و لَکِنْ یَرِثْنَ قِیمَةَ الْبِنَاءِ قال قُلْتُ فَإِنَّ النَّاسَ لَا یَرْضَوْنَ بِذَا فَقَالَ إِذَا وُلِّینَا فَلَمْ یَرْضَوْا ضَرَبْنَاهُمْ بِالسَّوْطِ فَإِنْ لَمْ یَسْتَقِیمُوا ضَرَبْنَاهُمْ بِالسَّیْفِ.

📚 *Al-Kafi*, Vol. 7, p. 129

Shu'ayb said: 'I asked Imam al-Sadiq (peace be upon him) about women inheriting from the land. He said: No, but they inherit from the value of the building!'

I said: 'The people (general public) would not accept this!' Imam replied: 'When we are the rulers, if they do not accept, we will strike them with a whip, and if they do not correct themselves, we will strike them with a sword!'

6⃣عَنِ الْأَحْوَلِ عَنْ أَبِی عَبْداللَّهِ علیه السلام قال سَمِعْتُهُ یَقُولُ لَا یَرِثْنَ النِّسَاءُ مِنَ الْعَقَارِ شَیْئاً وَ لَهُنَّ قِیمَةُ الْبِنَاءِ و الشَّجَرِ و النَّخْلِ.

📚 *Al-Faqih*, Vol. 4, p. 348

Ahwal said: 'I heard Imam al-Sadiq (peace be upon him) say: Women do not inherit from the land, but they inherit from the value of the building, trees, and date palms!'

✅ Based on the above narrations and many others, a wife does not inherit from the land, house, or agricultural land of her husband. She only receives her share of the inheritance from the value of the building, doors, trees, and contents of the land.

✅ In *Al-Faqih*, Vol. 4, p. 349, it is narrated from Ibn Udhaynah that if the wife has children, she inherits from the land. However, this narration is neither connected to the Imam nor directly attributed to him, and it is in opposition to narrations such as 2⃣ and 4⃣. Therefore, the ruling above applies to the wife, whether or not she has children from her husband.

✅ It is evident from the narrations that the general public disagreed with this ruling, and one or two specific narrations in opposition to it are in agreement with the general public and have a taqiyya (precautionary) reason behind them.
