1⃣عن حماد بن عیسی عن بعض أصحابنا عن أَبی الْحَسَنِ الْأَوَّلِ قال: الْإِمَامُ وَارِثُ مَنْ لَا وَارِثَ لَهُ.

📚 Al-Kafi, Vol. 7, p. 169

Imam Musa al-Kadhim (peace be upon him) said: The Imam is the heir of one who has no other heir.

2⃣عن أبان بن تغلب قال: قال أَبُوعَبْدِاللَّهِ مَنْ مَاتَ لَا مَوْلَی لَهُ و لَا وَرَثَةَ فَهُوَ مِنْ أَهْلِ هَذِهِ الْآیَةِ یَسْئَلُونَکَ عَنِ الْأَنْفالِ قُلِ الْأَنْفالُ لِلَّهِ و الرَّسُول

Imam Sadiq (peace be upon him) said: If a person dies without a guardian or heir, then they belong to the people mentioned in this verse (Surah Anfal, Ayah 1): 'They ask you about the spoils. Say: The spoils are for Allah and His Messenger!'

3⃣عن أبی الْحَسَنِ فی رَجُلٍ صَارَ فِی یَدِهِ مَالٌ لِرَجُلٍ مَیِّتٍ لَا یَعْرِفُ لَهُ وَارِثاً کَیْفَ یَصْنَعُ بِالْمَالِ قال مَا أَعْرَفَکَ لِمَنْ هُوَ یَعْنِی نَفْسَهُ

📚 Al-Tahdhib, Vol. 9, p. 390

When asked about what should be done with the property of a deceased person with no known heirs, Imam Musa al-Kadhim (peace be upon him) replied: 'You know well whose property this is!' referring to himself.

4⃣عن محمد بن مسلم عن أَبِی جَعْفَرٍ قال: مَنْ مَاتَ و لَیْسَ لَهُ وَارِثٌ مِنْ قَرَابَتِهِ و لَا مَوْلَی عَتَاقِهِ قَدْ ضَمِنَ جَرِیرَتَهُ فَمَالُهُ مِنَ الْأَنْفَال

Imam Baqir (peace be upon him) said: If someone dies without any relatives or a guardian who guaranteed their responsibility, their property is considered part of the Anfal.

5⃣عن خَلَّادٍ السِّنْدِیِّ عن أَبِی عَبْداللَّهِ قال کَانَ عَلِیٌّ یَقُولُ فِی الرَّجُلِ یَمُوتُ وَ یَتْرُکُ مَالًا وَ لَیْسَ لَهُ أَحَدٌ أَعْطِ الميراث هَمْشَارِیجَهُ

📚 Al-Kafi, Vol. 7, p. 169

Imam Sadiq (peace be upon him) said: Amir al-Mu'minin (peace be upon him) instructed that if someone dies, leaving property with no one to inherit, the inheritance should be given to his townsfolk.

6⃣عن داود عمن ذکره عن أبی عبداللَّه قال: مَاتَ رَجُلٌ عَلَی عَهْدِ أَمِیرالْمُؤْمِنِین لَمْ یَکُنْ لَهُ وَارِثٌ فَدَفَعَ أَمِیرالْمُؤْمِنِینَ مِیرَاثَهُ إِلَی هَمْشَهْرِیجِهِ

In the time of Amir al-Mu'minin (peace be upon him), a man who had no heirs passed away, and his inheritance was given to a townsman of his.

7⃣عن أبی الصباحِ قال قال لی أبوعبداللَّه نَحْنُ قَوْمٌ فَرَضَ اللَّهُ طَاعَتَنَا لَنَا الْأَنْفَالُ و لَنَا صَفْوُ الْمَال

📚 Al-Kafi, Vol. 1, p. 546

Abu Sabah said that Imam Sadiq (peace be upon him) told him: 'We are a people whom Allah has made it obligatory to obey! The Anfal and select property belong to us.'

8⃣عن مروک بن عبید عن أبی الحسن الرِّضا قال: قُلْتُ لَهُ مَا تَقُولُ فِی رَجُلٍ مَاتَ و لَیْسَ لَهُ وَارِثٌ إِلَّا أَخاً لَهُ مِنَ الرَّضَاعَةِ یَرِثُهُ قال نَعَمْ أَخْبَرَنِی أَبِی عَنْ جَدِّی أَنَّ رَسُولَ اللَّهِ قَالَ مَنْ شَرِبَ مِنْ لَبَنِنَا أَوْ أَرْضَعَ لَنَا وَلَداً فَنَحْنُ آبَاؤُهُ

📚 Al-Kafi, Vol. 7, p. 168

Marouk said: I asked Imam Reza (peace be upon him) about a person who dies leaving only a foster brother. Does he inherit? The Imam replied: Yes! My father informed me from his grandfather that the Prophet (peace be upon him and his family) said: 'Whoever drinks from our milk or nurses a child of ours, we are like their fathers.'

9⃣محمد بن الحسن فی النهایة قال: کان أمیرالمؤمنین یُعْطِی مِیرَاثَ مَنْ لَا وَارِثَ لَهُ فُقَرَاءَ أَهْلِ بَلَدِهِ وَ ضُعَفَاءَهُمْ و ذَلِکَ عَلَی سَبِیلِ التَّبَرُّعِ مِنْه

📚 Al-Nihaya, p. 671

Shaykh Tusi said: Amir al-Mu'minin (peace be upon him) used to give the inheritance of someone with no heirs to the poor and needy of his town as an act of charity on their behalf.

✅ Based on these and other narrations, if someone dies without heirs, their estate becomes part of the Anfal and, according to verses and narrations, is under the ownership of the infallible Imam of the time.

Since we are currently in the Imam’s absence, following the Ahl al-Bayt’s tradition, if the deceased has a foster brother or sister, inheritance is given to them (as in narration 8⃣). Otherwise, following narrations 5⃣, 9⃣, and others, it is given to the poor and needy of their hometown.
