And can a father marry a woman who was previously in a permanent or temporary marriage with his son?

✅ Answer: Refer to the following verses and narrations:

قال اللَّه تعالی : وَ لَا تَنکِحُوا مَا نَکَحَ آبَاؤُکُم مِّنَ النِّسَاءِ إِلَّا مَا قَدْ سَلَفَ ۚ إِنَّهُ کَانَ فَاحِشَةً وَ مَقْتًا وَسَاءَ سَبِیلًا

📖 Surah An-Nisa, Verse 22

Translation: Do not marry women whom your fathers married, except what has already passed. Indeed, it is an outrageous act, despised, and an evil way.

قال اللَّه تعالی : حُرِّمَتْ عَلَیْکُمْ أُمَّهَاتُکُمْ.... وَحَلَائِلُ أَبْنَائِکُمُ الَّذِینَ مِنْ أَصْلَابِکُمْ

Translation: Forbidden to you (in marriage) are your mothers... and the wives of your sons who are from your own loins.

📖 Surah An-Nisa, Verse 23

1⃣عن حماد بن عمرو و أنس بن محمد عن أبیه جمیعا عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ آبَائِهِ فِی وَصِیَّةِ النَّبِیِّ لِعَلِیٍّ قَالَ: یا عَلِیُّ إِنَّ عَبْدَ الْمُطَّلِبِ سَنَّ فِی الْجَاهِلِیَّةِ خَمْسَ سُنَنٍ أَجْرَاهَا اللَّهُ عَزَّوَجَلَّ لَهُ فِی الْإِسْلَامِ حَرَّمَ نِسَاءَ الْآبَاءِ عَلَی الْأَبْنَاءِ فَأَنْزَلَ اللَّهُ عَزَّ وَ جَلَّ وَ لا تَنْکِحُوا ما نَکَحَ آباؤُکُمْ مِنَ النِّساءِ

📚 Al-Faqih, Vol. 4, p. 365

Imam Sadiq (peace be upon him) narrated from his ancestors that the Messenger of Allah (peace be upon him and his family) said to Amir al-Mu'minin (peace be upon him): O Ali! Indeed, Abdul Muttalib instituted five practices during the pre-Islamic era, which Allah confirmed in Islam: he made the wives of fathers forbidden to their sons, as Allah stated in (Verse 22 of Surah An-Nisa), 'Do not marry women whom your fathers married.'

2⃣عن زُرَارَةَ قال: قَالَ أَبُوجَعْفَرٍ فِی حَدِیثٍ وَ إِذَا تَزَوَّجَ الرَّجُلُ امْرَأَةً تَزْوِیجاً حَلَالًا فَلَا تَحِلُّ تِلْکَ الْمَرْأَةُ لِأَبِیهِ و لَا لِابْنِهِ.

📚 Al-Kafi, Vol. 5, p. 419

Imam Baqir (peace be upon him) said in a narration: When a man marries a woman lawfully, she becomes forbidden to his father and son.

3⃣عَنِ الْحَلَبِیِّ قال: سَأَلْتُ أَبَاعَبْداللَّهِ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَلَامَسَهَا قَالَ مَهْرُهَا وَاجِبٌ وَ هِیَ حَرَامٌ عَلَی أَبِیهِ و ابْنِهِ.

📚 Al-Kafi, Vol. 5, p. 418

Halabi asked Imam Sadiq (peace be upon him) about a man who marries a woman and consummates the marriage; the Imam said: Her dowry is obligatory, and she is forbidden to his father and son.

4⃣عن مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا أَنَّهُ قَالَ في حديث وَ لَا یَصْلُحُ لِلرَّجُلِ أَنْ یَنْکِحَ امْرَأَةَ جَدِّهِ.

📚 Al-Kafi, Vol. 5, p. 420

Imam Baqir or Imam Sadiq (peace be upon them) said in a narration: It is not appropriate for a man to marry the wife of his grandfather.

5⃣عن أَبِی الْجَارُودِ عَنْ أَبِی جَعْفَرٍ في حديث قَالَ:...فَسَلْهُمْ یَا أَبَا الْجَارُودِ هَلْ کَانَ یَحِلُّ لِرَسُولِ اللَّهِ نِکَاحُ حَلِیلَتَیْهِمَا فَإِنْ قَالُوا نَعَمْ کَذَبُوا وَ فَجَرُوا وَ إِنْ قَالُوا لَا فَهُمَا ابْنَاهُ لِصُلْبِهِ.

📚 Al-Kafi, Vol. 8, p. 318

Imam Baqir (peace be upon him) said to Abu Jarud in a narration: Ask them (i.e., the opponents) whether it would be permissible for the Messenger of Allah (peace be upon him and his family) to marry the wife of Imam Hasan or Imam Husayn (peace be upon them)?! If they say yes, they have lied and committed immorality, and if they say no, then Imam Hasan and Imam Husayn (peace be upon them) are the direct descendants of the Messenger of Allah (peace be upon him and his family)!

✅ Based on the above verses and narrations, once a man marries a woman, she becomes permanently forbidden to his son and father, and they can never marry her.

✅ The ruling on marriage in these verses and narrations is absolute, applying to both permanent and temporary marriages.

✅ There is no condition regarding consummation; whether the marriage was consummated or not, if a man marries a woman permanently or temporarily and then separates, she becomes permanently forbidden to his fathers and sons, who can never marry her.

✅ According to narrations such as 4 and 5, this ruling applies equally to fathers, grandfathers and ancestors, as well as sons, grandsons, and descendants.
