Question 1883: Does a will have to be written?

1⃣عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْداللَّهِ قَالَ: کَتَبَ أَبِی فِی وَصِیَّتِهِ أَنْ أُکَفِّنَهُ فِی ثَلَاثَةِ

Imam Sadiq (peace be upon him) said: 'My father wrote in his will that he should be shrouded in three pieces of cloth!'
2⃣عَنْ مَنْصُورِ بْنِ حَازِمٍ قال: سَأَلْتُ أَبَاعَبْداللَّه عَنْ رَجُلٍ قَالَ إِنْ حَدَثَ بِی حَدَثٌ فِی مَرَضِی هَذَا فَغُلَامِی فُلَانٌ حُرٌّ فَقَالَ أَبُو عَبْدِ اللَّه یَرُدُّ مِنْ وَصِیَّتِهِ مَا یَشَاءُ وَ یُجِیزُ مَا یَشَاءُ.

Mansur ibn Hazim said: 'I asked Imam Sadiq (peace be upon him) about someone who says: 'If something happens to me during this illness, my servant so-and-so is freed.' Imam Sadiq (peace be upon him) said: 'Anyone can revoke their will and can stipulate anything they wish!'
3⃣عن مُحَمَّدِ بْنِ عمر الساباطی قال: سَأَلْتُ أَبَاجَعْفَرٍ عَنْ رَجُلٍ أَوْصَی إِلَیَّ و أَمَرَنِی أَنْ أُعْطِیَ عَمّاً لَهُ فِی کُلِّ سَنَةٍ شَیْئاً فَمَاتَ الْعَمُّ فَکَتَبَ أَعْطِ وَرَثَتَهُ.

Muhammad ibn Umar said: 'I asked Imam Baqir (peace be upon him) about a person who makes a will and orders that every year something be given to his uncle, and the uncle dies. Imam (peace be upon him) said: 'Give it to his heirs!'
4⃣عن حنان بن سدیر عَنْ أَبِیهِ عن أَبِی جَعْفَرٍ قال: دَخَلْتُ عَلَی مُحَمَّدِ بْنِ عَلِیٍّ ابْنِ الْحَنَفِیَّةِ و قَدِ اعْتُقِلَ لِسَانُهُ فَأَمَرْتُهُ بِالْوَصِیَّةِ فَلَمْ یُجِبْ قَالَ فَأَمَرْتُ بِطَشْتٍ فَجُعِلَ فِیهِ الرَّمْلُ فَوُضِعَ فَقُلْتُ لَهُ خُطَّ بِیَدِکَ فَخَطَّ وَصِیَّتَهُ بِیَدِهِ فِی الرَّمْلِ وَ نَسَخْتُ أَنَا فِی صَحِیفَةٍ.

Imam Baqir (peace be upon him) said: 'I entered upon Muhammad ibn Hanafiyyah while his tongue was tied. I ordered him to write a will, but he did not respond. I then ordered that a basin be placed with sand and said: 'Write in it with your hand.' He wrote his will in the sand with his hand, and I copied it onto a paper!'
5⃣عن سَالِمَةَ مَوْلَاةِ أَبِی عَبْداللَّه قَالَتْ کُنْتُ عِنْدَ أَبِی عَبْدِ اللَّهِ حِینَ حَضَرَتْهُ الْوَفَاةُ فَأُغْمِیَ عَلَیْهِ فَلَمَّا أَفَاقَ قال أَعْطُوا الْحَسَنَ بْنَ عَلِیِّ بْنِ الْحُسَیْنِ و هُوَ الْأَفْطَسُ سَبْعِینَ دِینَاراً و أَعْطُوا فُلَاناً کَذَا وَ کَذَا و فُلَاناً کَذَا وَ کَذَا...
📚 Al-Kafi, Vol. 7, p. 55
Salimah, a servant of Imam Sadiq (peace be upon him), said: 'I was with the Imam at the time of his death. Then he lost consciousness, and when he regained it, he said: 'Give 70 dinars from one-third of my wealth to Hassan Ali, known as Aftas, and so much to so-and-so, and so much to so-and-so...!'
6⃣عن عَمَّارِ بْنِ مَرْوَانَ قال: قُلْتُ لِأَبِی عَبْداللَّه إِنَّ أَبِی حَضَرَهُ الْمَوْتُ فَقِیلَ لَهُ أَوْصِ فَقَالَ هَذَا ابْنِی یَعْنِی عُمَرَ فَمَا صَنَعَ فَهُوَ جَائِزٌ فَقَالَ لَهُ أَبُو عَبْدِ اللَّهِ فَقَدْ أَوْصَی أَبُوکَ و أَوْجَزَ...

Ammar ibn Marwan said: 'I said to Imam Sadiq (peace be upon him): 'My father is nearing death, and he was told to make a will. He said: 'This son of mine, Umar, whatever he does is permissible.' The Imam said to him: 'Your father made a will, and he did so briefly and concisely!'
7⃣عَنْ أَبِي الصَّبَّاحِ الْكِنَانِيِّ عَنْ أَبِي عَبْداللَّه قال: سَأَلْتُهُ عَنْ قَوْلِ اللَّهِ عَزَّوَجَلَّ يا أَيُّهَا الَّذِينَ آمَنُوا شَهادَةُ بَيْنِكُمْ إِذا حَضَرَ أَحَدَكُمُ الْمَوْتُ حِينَ الْوَصِيَّةِ اثْنانِ ذَوا عَدْلٍ مِنْكُمْ أَوْ آخَرانِ مِنْ غَيْرِكُمْ قُلْتُ مَا آخَرَانِ مِنْ غَيْرِكُمْ قَالَ هُمَا كَافِرَانِ قُلْتُ ذَوَا عَدْلٍ مِنْكُمْ قَالَ مُسْلِمَانِ
📚 Al-Kafi, Vol. 7, p. 3
Abu Sabah Kanani said: 'I asked Imam Sadiq (peace be upon him) about the verse: 'O you who have believed, when death approaches one of you and you make a will, let two just men from among you testify, or two from outside yourselves.' The Imam (peace be upon him) said: 'The two from outside yourselves are two non-Muslims (kafir), and the two just men from yourselves are Muslims.'
✅ From various narrations, some of which have been mentioned, it is clear that both written and oral wills are permissible, and the only requirement is that the necessary witnesses be present according to different conditions for it to be enforceable.
