Question 1881: If someone sells sewing patterns online and says they do not want them to be given to anyone other than the buyer, can they be given to less fortunate people after purchase or not?

1⃣عَنْ عَلِیِّ بْنِ إِبْرَاهِیمَ عَنْ أَبِیهِ عَنِ ابْنِ أَبِی عُمَیْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: سَأَلْتُهُ عَنِ الشَّرْطِ فِی الْإِمَاءِ لَا تُبَاعُ وَ لَا تُورَثُ وَ لَا تُوهَبُ فَقَالَ یَجُوزُ ذَلِکَ غَیْرَ الْمِیرَاثِ فَإِنَّهَا تُورَثُ وَ کُلُّ شَرْطٍ خَالَفَ کِتَابَ اللَّهِ فَهُوَ رَدٌّ.

📚 Al-Kafi, Vol. 5, p. 212

Halabi said: 'I asked Imam Sadiq (peace be upon him) about a condition regarding a slave that it cannot be sold, inherited, or gifted. The Imam said: 'It is permissible except for inheritance, as that is something that will be inherited, and any condition that contradicts the Quran is invalid.'

2⃣ عَنِ النَّضْرِ بْنِ سُوَیْدٍ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ إِلَّا کُلَّ شَرْطٍ خَالَفَ کِتَابَ اللَّهِ عَزَّ وَ جَلَّ فَلَا یَجُوزُ.

Imam Sadiq (peace be upon him) said: 'Muslims are bound by their conditions, except for any condition that contradicts the Quran, which is not permissible.'

3⃣عَنْ صَفْوَانَ عَنِ ابْنِ سِنَانٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنِ الشَّرْطِ فِی الْإِمَاءِ لَا تُبَاعُ وَ لَا تُوهَبُ قَالَ یَجُوزُ ذَلِکَ غَیْرَ الْمِیرَاثِ فَإِنَّهَا تُورَثُ لِأَنَّ کُلَّ شَرْطٍ خَالَفَ الْکِتَابَ بَاطِلٌ.

Ibn Sanan said: 'I asked Imam Sadiq (peace be upon him) about the sale of slaves with the condition that they cannot be sold or gifted. The Imam said: 'It is permissible, except for inheritance, as it will be inherited, because any condition that contradicts the Quran is invalid.'

4⃣عَنِ الصَّفَّارِ عَنِ الْحَسَنِ بْنِ مُوسَی الْخَشَّابِ عَنْ غِیَاثِ بْنِ کَلُّوبٍ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ جَعْفَرٍ عَنْ أَبِیهِ أَنَّ عَلِیَّ بْنَ أَبِی طَالِبٍ علیه السلام کَانَ یَقُولُ مَنْ شَرَطَ لِامْرَأَتِهِ شَرْطاً فَلْیَفِ لَهَا بِهِ فَإِنَّ الْمُسْلِمِینَ عِنْدَ شُرُوطِهِمْ إِلَّا شَرْطاً حَرَّمَ حَلَالًا أَوْ أَحَلَّ حَرَاماً

Amir al-Mu'minin (peace be upon him) said: 'Anyone who makes a condition with their spouse must honor that condition, for Muslims are bound by their conditions (they fulfill their conditions), except for any condition that makes something unlawful lawful or lawful unlawful.'

5⃣عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ سَمِعْتُهُ یَقُولُ مَنِ اشْتَرَطَ شَرْطاً مُخَالِفاً لِکِتَابِ اللَّهِ فَلَا یَجُوزُ لَهُ وَ لَا یَجُوزُ عَلَی الَّذِی اشْتُرِطَ عَلَیْهِ وَ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ مِمَّا وَافَقَ کِتَابَ اللَّهِ عَزَّ وَ جَلَّ

📚 Al-Kafi, Vol. 5, p. 169

Abd Allah ibn Sanan said: 'I heard Imam Sadiq (peace be upon him) say: 'Anyone who makes a condition that contradicts the Quran, that condition is not permissible for them or for the one upon whom it is made. Muslims are bound by their conditions (they are valid and executable) when they align with the Book of Allah.'

✅ Based on the above narrations and others, if someone makes a condition in a contract that does not contradict the Quran and does not make the lawful unlawful or the unlawful lawful, that condition is permissible and must be honored.

✅ In the case where the condition of exclusive use by the buyer in the sale of sewing patterns does not contradict the Quran and does not make the lawful unlawful or the unlawful lawful, if the seller conditions that the patterns not be given to anyone else, the mentioned condition must be honored.
