هَلْ یَجِبُ الْعِدَّةُ عَلَی الزَّانِیَةِ؟؟

1⃣عَنْ إِسْحَاقَ بْنِ جَرِیرٍ عَنْ أَبِی عَبْداللَّهِ قَالَ: قُلْتُ لَهُ الرَّجُلُ یَفْجُرُ بِالْمَرْأَةِ ثُمَّ یَبْدُو لَهُ فِی تَزْوِیجِهَا هَلْ یَحِلُّ لَهُ ذَلِکَ قَالَ نَعَمْ إِذَا هُوَ اجْتَنَبَهَا حَتَّی تَنْقَضِیَ عِدَّتُهَا بِاسْتِبْرَاءِ رَحِمِهَا مِنْ مَاءِ الْفُجُورِ فَلَهُ أَنْ یَتَزَوَّجَهَا وَ إِنَّمَا یَجُوزُ لَهُ أَنْ یَتَزَوَّجَهَا بَعْدَ أَنْ یَقِفَ عَلَی تَوْبَتِهَا.

📚Al-Kafi, Vol. 5, p. 356

Ishaq ibn Jarir said: I asked Imam Sadiq (peace be upon him): A man commits adultery with a woman and then thinks of marrying her, is it permissible for him? He replied: Yes, provided he distances himself from her until her waiting period (idda) passes by ensuring the purity of her womb from the adulterous act. He can marry her after ensuring her repentance.

2⃣ عَنْ عَلِيٍّ : أَنَّ عُمَرَ سَأَلَهُ عَنِ امْرَأَةٍ وَقَعَ عَلَيْهَا أَعْلَاجٌ اغْتَصَبُوهَا نَفْسَهَا قَالَ عَلِيٌّ لَا حَدَّ عَلَيْهَا لِأَنَّهَا مُسْتَكْرَهَةٌ وَ لَكِنْ ضَعْهَا عَلَى يَدَيْ عَدْلٍ مِنَ الْمُسْلِمِينَ حَتَّى تُسْتَبْرَئَ بِحَيْضَةٍ ثُمَّ أَعِدْهَا عَلَى زَوْجِهَا فَفَعَلَ عُمَرُ

📚 Mustadrak al-Wasa'il, Vol. 15, p. 372

Omar... asked the Commander of the Faithful (peace be upon him) about men who forcibly take a woman and have intercourse with her; the Imam said: There is no punishment for her because she was coerced into the act, but place her with a trustworthy Muslim until she has one menstrual cycle and then return her to her husband. So Omar did just that!

3⃣عَنِ الْحَسَنِ بْنِ صَالِحٍ عَنْ أَبِی عَبْداللَّهِ قَالَ: نَادَی مُنَادِی رَسُولِ اللَّهِ فِی النَّاسِ یَوْمَ أَوْطَاسٍ أَنِ اسْتَبْرِءُوا سَبَایَاکُمْ بِحَیْضَةٍ.

Imam Sadiq (peace be upon him) said: The announcer of the Messenger of Allah (peace be upon him and his family) called out to the people on the day of the Battle of Hunayn: Ensure the purity of the captive women through one menstrual cycle!

4⃣ عَنِ السِّنْدِیِّ بْنِ مُحَمَّدٍ عَنْ أَبِی الْبَخْتَرِیِّ عَنْ جَعْفَرٍ عَنْ أَبِیهِ عَنْ عَلِیٍّ أَنَّهُ قَالَ: تُسْتَبْرَأُ الْأَمَةُ إِذَا اشْتُرِیَتْ بِحَیْضَةٍ وَ إِنْ کَانَتْ لَا تَحِیضُ فَبِخَمْسَةٍ وَ أَرْبَعِینَ یَوْماً.

The Commander of the Faithful (peace be upon him) said: When a slave woman is bought, she is ensured purity through one menstrual cycle, and if she does not menstruate, then for 45 days!

5⃣عَنْ أَبِی جَعْفَرٍ مُحَمَّدِ بْنِ عَلِیٍّ الْجَوَادِ أَنَّهُ سُئِلَ عَنْ رَجُلٍ نَکَحَ امْرَأَةً عَلَی زِنًا أَ یَحِلُّ لَهُ أَنْ یَتَزَوَّجَهَا فَقَالَ یَدَعُهَا حَتَّی یَسْتَبْرِئَهَا مِنْ نُطْفَتِهِ وَ نُطْفَةِ غَیْرِهِ إِذْ لَا یُؤْمَنُ مِنْهَا أَنْ تَکُونَ قَدْ أَحْدَثَتْ مَعَ غَیْرِهِ حَدَثاً کَمَا أَحْدَثَتْ مَعَهُ ثُمَّ یَتَزَوَّجُ بِهَا إِنْ أَرَادَ فَإِنَّمَا مَثَلُهَا مَثَلُ نَخْلَةٍ أَکَلَ رَجُلٌ مِنْهَا حَرَاماً ثُمَّ اشْتَرَاهَا فَأَکَلَ مِنْهَا حَلَالًا.

📚 Bihar al-Anwar, Vol. 10, p. 385

Imam Jawad (peace be upon him) was asked about a man who commits adultery with a woman, whether it is permissible for him to marry her. The Imam replied: He should leave her until he ensures her womb's purity from both his and others' seeds because he cannot trust that she has not committed the same act with others. If he wants, he can then marry her. It is like a palm tree from which someone eats forbidden fruit and then buys it to eat lawfully.

✅ According to the above narrations and others, an adulterous woman is also required to observe a waiting period, referred to in the narrations as 'istibra,' which is also mentioned in other contexts such as the buying and selling of slave women and captive women. The duration, according to most narrations, is one menstrual cycle for a menstruating woman and 45 days for a woman who does not menstruate but is of childbearing age and not menopausal.

✅ Therefore, a woman who, God forbid, commits adultery must ensure the purity of her womb by undergoing one menstrual cycle before getting married.
