Question 1835: Is it permissible to have intercourse with a woman who, during a temporary or permanent marriage contract, stipulated no intercourse, but after the contract has given permission for intercourse?
هَلْ یَحِلُّ الدُّخُول بِإِمْرَأَةٍ شَرَطَتْ فِی عَقْدِ المُتْعَةِ أَوِ الدّائِمِ بِعَدَمِ الدُّخُولِ ثُمَّ أَذِنَتْ بَعْدَ ذَلِکَ بِالْدُخُول؟
✅ Answer: Pay attention to the following narrations:
1⃣عَنْ عَلِیِّ بْنِ إِبْرَاهِیمَ عَنْ أَبِیهِ عَنِ ابْنِ أَبِی عُمَیْرٍ عَنْ عَمَّارِ بْنِ مَرْوَانَ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: قُلْتُ رَجُلٌ جَاءَ إِلَی امْرَأَةٍ فَسَأَلَهَا أَنْ تُزَوِّجَهُ نَفْسَهَا فَقَالَتْ أُزَوِّجُکَ نَفْسِی عَلَی أَنْ تَلْتَمِسَ مِنِّی مَا شِئْتَ مِنْ نَظَرٍ وَ الْتِمَاسٍ وَ تَنَالَ مِنِّی مَا یَنَالُ الرَّجُلُ مِنْ أَهْلِهِ إِلَّا أَنْ لَا تُدْخِلَ فَرْجَکَ فِی فَرْجِی وَ تَتَلَذَّذَ بِمَا شِئْتَ فَإِنِّی أَخَافُ الْفَضِیحَةَ قَالَ لَیْسَ لَهُ إِلَّا مَا اشْتُرِطَ.

Ammar bin Marwan said: I asked Imam Sadiq (peace be upon him): A man approaches a woman and asks her to marry him. The woman says: I will marry you on the condition that you can look at and request from me whatever you want, and you can obtain from me what a man obtains from his wife, except that you do not insert your organ into mine and you can seek pleasure in any other way because I fear disgrace. The Imam said: The man will have nothing except what has been stipulated.
2⃣عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: قُلْتُ لَهُ رَجُلٌ تَزَوَّجَ بِجَارِیَةٍ عَاتِقٍ عَلَی أَنْ لَا یَقْتَضَّهَا ثُمَّ أَذِنَتْ لَهُ بَعْدَ ذَلِکَ قَالَ إِذَا أَذِنَتْ لَهُ فَلَا بَأْسَ.

Ishaq bin Ammar said: I asked Imam Sadiq (peace be upon him): A man marries a young virgin girl on the condition that he will not break her virginity, then later the girl permits him. The Imam said: If the girl permits him, there is no problem.
✅ According to the above narrations, if a woman stipulates no intercourse in the marriage contract but later gives permission, there is no problem with having intercourse. If the one who made the condition withdraws it and gives permission, there is no issue affecting the validity of the contract, and there is no prohibition on benefiting from what was previously restricted by the condition.
