Question 1799: Is it possible to enter into a contract of partnership with a farmer after the planting has been done?

1⃣عَنْ عِدَّةٍ مِنْ أَصْحَابِهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عُثْمَانَ بْنِ عِیسَی عَنْ سَمَاعَةَ فِی حَدِیثٍ قَالَ: سَأَلْتُهُ عَنِ الْمُزَارَعَةِ قُلْتُ الرَّجُلُ یَبْذُرُ فِی الْأَرْضِ مِائَةَ جَرِیبٍ أَوْ أَقَلَّ أَوْ أَکْثَرَ طَعَاماً أَوْ غَیْرَهُ فَیَأْتِیهِ رَجُلٌ فَیَقُولُ خُذْ مِنِّی نِصْفَ ثَمَنِ هَذَا الْبَذْرِ الَّذِی زَرَعْتَهُ فِی الْأَرْضِ وَ نِصْفُ نَفَقَتِکَ عَلَیَّ وَ أَشْرِکْنِی فِیهِ قَالَ لَا بَأْسَ قُلْتُ وَ إِنْ کَانَ الَّذِی یَبْذُرُ فِیهِ لَمْ یَشْتَرِهِ بِثَمَنٍ وَ إِنَّمَا هُوَ شَیْءٌ کَانَ عِنْدَهُ قَالَ فَلْیُقَوِّمْهُ قِیمَةً کَمَا یُبَاعُ یَوْمَئِذٍ ثُمَّ لْیَأْخُذْ نِصْفَ الثَّمَنِ وَ نِصْفَ النَّفَقَةِ وَ یُشَارِکُهُ.

In a narration, Sima'ah said: I asked him (meaning Imam Sadiq, peace be upon him) about the practice of muzara'a (sharecropping) and said: A man plants food crops or others on a piece of land, whether it's a hundred acres or more or less. Then someone comes to him and says: Take half the value of the seeds you have planted in the land, and let me cover half the costs for you, and make me a partner in it! The Imam said: There is no problem with this! I asked: What if the seeds he planted were not purchased with money but were from what he already had? The Imam said: It should be priced according to the current market price, and half of the value of the seeds and half of the costs should be taken from him, and then the partnership is established.
✅ Based on the above narration, it is possible to partner with a farmer even after the planting has been done.
