Question 1582: I am financially capable of performing the obligatory Hajj, but for some reason, I am banned from leaving the country. Do I have any duty regarding Hajj?

1 عَنْ عَلِیِّ بْنِ أَبِی حَمْزَةَ قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ مُسْلِمٍ حَالَ بَیْنَهُ وَ بَیْنَ الْحَجِّ مَرَضٌ أَوْ أَمْرٌ یَعْذِرُهُ اللَّهُ فِیهِ فَقَالَ عَلَیْهِ أَنْ یُحِجَّ عَنْهُ مِنْ مَالِهِ صَرُورَةً لَا مَالَ لَهُ.

📚 Al-Kafi, Vol. 4, p. 273

Ali ibn Abi Hamza said: 'I asked the Imam (peace be upon him) about a Muslim who is prevented from performing Hajj due to an illness or a matter for which Allah accepts his excuse.' The Imam said: 'It is his duty to send a person who has not performed Hajj and has no money to Hajj from his own wealth!'

2 عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِی جَعْفَرٍ قَالَ کَانَ عَلِیٌّ یَقُولُ لَوْ أَنَّ رَجُلًا أَرَادَ الْحَجَّ فَعَرَضَ لَهُ مَرَضٌ أَوْ خَالَطَهُ سَقَمٌ فَلَمْ یَسْتَطِعِ الْخُرُوجَ فَلْیُجَهِّزْ رَجُلًا مِنْ مَالِهِ ثُمَّ لْیَبْعَثْهُ مَکَانَهُ.

Imam Baqir (peace be upon him) said: 'The Commander of the Faithful (peace be upon him) used to say: 'If a man intends to perform Hajj, but an illness befalls him or a sickness weakens him, and as a result, he is unable to go, then he should equip a person with his wealth and send him in his place!'

3 عَنِ الْحَلَبِیِّ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: إِنْ کَانَ رَجُلٌ مُوسِرٌ حَالَ بَیْنَهُ وَ بَیْنَ الْحَجِّ مَرَضٌ أَوْ أَمْرٌ یَعْذِرُهُ اللَّهُ عَزَّ وَ جَلَّ فِیهِ فَإِنَّ عَلَیْهِ أَنْ یُحِجَّ عَنْهُ صَرُورَةً لَا مَالَ لَهُ.

Imam Sadiq (peace be upon him) said: 'If a man is wealthy and an illness or a matter for which Allah Almighty accepts his excuse prevents him from Hajj, then it is certainly his duty to send a person who has not performed Hajj and has no money to Hajj on his behalf!'

4 عَنِ اَلْحَلَبِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: إِذَا قَدَرَ اَلرَّجُلُ عَلَى مَا يَحُجُّ بِهِ ثُمَّ دَفَعَ ذَلِكَ وَ لَيْسَ لَهُ شُغُلٌ يَعْذِرُهُ اَللَّهُ فِيهِ فَقَدْ تَرَكَ شَرِيعَةً مِنْ شَرَائِعِ اَلْإِسْلاَمِ فَإِنْ كَانَ مُوسِراً وَ حَالَ بَيْنَهُ وَ بَيْنَ اَلْحَجِّ مَرَضٌ أَوْ حَصْرٌ أَوْ أَمْرٌ يَعْذِرُهُ اَللَّهُ فِيهِ فَإِنَّ عَلَيْهِ أَنْ يُحِجَّ عَنْهُ مِنْ مَالِهِ صَرُورَةً لاَ مَالَ لَهُ.

📚 Al-Tahdhib, Vol. 5, p. 403

Imam Sadiq (peace be upon him) said: 'If a person is capable of performing Hajj but puts it off (and does not go) while not having an excuse that Allah would pardon him for, he has certainly abandoned one of the laws of Islam. But if he is wealthy and an illness, hardship, obstacle, or a matter for which Allah accepts his excuse prevents him from Hajj, then it is his duty to send a man who has not performed Hajj and has no money to Hajj on his behalf!'

✅ Based on the above narrations and others, if a person is financially capable of performing the obligatory Hajj but is prevented from going by an obstacle such as illness, a travel ban, or a matter for which he is excused in the divine court, it is his duty to equip a man who has not yet performed Hajj with his money so that he may perform Hajj on his behalf.
