Question 1503: Is intercourse after purity from menstruation but before the ritual purification (ghusl) permissible?
✅ Answer: Please consider the following narrations:
1⃣عَنْ سَعِیدِ بْنِ یَسَارٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: قُلْتُ لَهُ الْمَرْأَةُ تَحْرُمُ عَلَیْهَا الصَّلَاةُ ثُمَّ تَطْهُرُ فَتَوَضَّأُ مِنْ غَیْرِ أَنْ تَغْتَسِلَ أَ فَلِزَوْجِهَا أَنْ یَأْتِیَهَا قَبْلَ أَنْ تَغْتَسِلَ قَالَ لَا حَتَّی تَغْتَسِلَ.

Saeed ibn Yasar said: I asked Imam Sadiq (peace be upon him): A woman is forbidden from praying due to menstruation, then she becomes pure, and she washes herself without performing ghusl. Can her husband have intercourse with her before she performs ghusl? The Imam said: No! Until she performs ghusl!
2⃣عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِی جَعْفَرٍ فِی الْمَرْأَةِ یَنْقَطِعُ عَنْهَا دَمُ الْحَیْضِ فِی آخِرِ أَیَّامِهَا قَالَ إِذَا أَصَابَ زَوْجَهَا شَبَقٌ فَلْیَأْمُرْهَا فَلْتَغْتَسِلْ فَرْجَهَا ثُمَّ یَمَسُّهَا إِنْ شَاءَ قَبْلَ أَنْ تَغْتَسِلَ.

Imam Baqir (peace be upon him) said regarding a woman whose menstruation stops in the last days: If her husband becomes sexually excited, he should command her to wash her private parts and then, if he wishes, have intercourse with her before she performs ghusl!
3⃣عَنْ عَلِیِّ بْنِ یَقْطِینٍ عَنْ أَبِی الْحَسَنِ مُوسَی قَالَ: سَأَلْتُهُ عَنِ الْحَائِضِ تَرَی الطُّهْرَ وَ یَقَعُ بِهَا زَوْجُهَا قَالَ لَا بَأْسَ وَ الْغُسْلُ أَحَبُّ إِلَیَّ.

Ali ibn Yaqtin said: I asked Imam Musa al-Kadhim (peace be upon him) regarding a woman who becomes pure and her husband has intercourse with her. The Imam said: There is no issue, but performing ghusl is preferred by me!
4⃣عَنْ عَبْدِ اللَّهِ بْنِ بُکَیْرٍ عَنْ أَبِی عَبْدِ اللَّهِ قَالَ: إِذَا انْقَطَعَ الدَّمُ وَ لَمْ تَغْتَسِلْ فَلْیَأْتِهَا زَوْجُهَا إِنْ شَاءَ.

Imam Sadiq (peace be upon him) said: When the menstruation stops, and the woman has not performed ghusl, her husband may have intercourse with her if he wishes!
5⃣عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِیرَةِ عَمَّنْ سَمِعَهُ عَنِ الْعَبْدِ الصَّالِحِ فِی الْمَرْأَةِ إِذَا طَهُرَتْ مِنَ الْحَیْضِ وَ لَمْ تَمَسَّ الْمَاءَ فَلَا یَقَعْ عَلَیْهَا زَوْجُهَا حَتَّی تَغْتَسِلَ وَ إِنْ فَعَلَ فَلَا بَأْسَ بِهِ وَ قَالَ تَمَسُّ الْمَاءَ أَحَبُّ إِلَیَّ.

Imam Kadhim (peace be upon him) said regarding a woman who is pure from menstruation but has not yet performed ghusl: Her husband should not have intercourse with her until she performs ghusl. However, if intercourse happens before ghusl, there is no issue, and he said: If she performs ghusl first and then has intercourse, that is preferred by me!
✅ Based on the above narrations and others, intercourse during menstruation is forbidden. However, when a woman becomes pure from menstruation, although it is recommended that she does not engage in intercourse before performing ghusl, permission for intercourse before ghusl has also been granted, and it is considered permissible. However, the Imam (peace be upon him) said that it is more preferred that ghusl be performed first, and then intercourse takes place.
✅ Some narrations appear to prohibit intercourse after purification but before performing ghusl, in line with the view of the Umayyads, but the allowance for intercourse after menstruation and before ghusl is clearly mentioned in Shi'a narrations, although it is more preferred by the Imam (peace be upon him) that intercourse occurs after ghusl.
✅ It is recommended for someone who intends to take advantage of the allowance for intercourse after menstruation but before ghusl to first instruct the woman to wash her private parts.
